[Daily Mail, where America gets its news] Bill and Hillary Clinton have declared themselves above the law as they refused to testify before Congress on Jeffrey Epstein.
The ex-president was scheduled to testify at a closed-door deposition in the House Oversight Committee's bipartisan investigation into Epstein at 10am Tuesday but failed to show. Hillary was slated to appear on Wednesday.
House Oversight's Republican chairman James Comer promised to bring contempt proceedings next week, setting off a potentially protracted and politically fraught legal battle that would be the first time in history a sitting or former president has been held in contempt by Congress.
In an astonishing letter to Comer, the Clintons launched a broadside at Donald Trump and the Republican lawmakers carrying out his 'cruel agenda.' "Do you KNOW who WE ARE??"
They claimed a legal analysis proved they were not required to testify and insisted the subpoenas were an extension of Trump's 'weaponization' of the law.
'The Justice Department has been used as a weapon, at the direction of the President, to pursue political opponents. And most recently and searingly, an ICE agent killed an unarmed mother only days ago,' the Clintons wrote.
'Every person has to decide when they have seen or had enough and are ready to fight for this country, its principles and its people, no matter the consequences. For us, now is that time.'
The Clintons cited the precedent set by Trump in October 2022, when he defied a congressional subpoena demanding his testimony over the Capitol riot.
An interesting argument. But is it likely to persuade those who hold power in this exchange?

Their testimony would only be good for entertainment. As somebody noted here yesterday, they would not recall much and, if they did, would invoke the Fifth. If a case can be built against them, it will have to be without their testimony even if they were to testify.

[NYP] The Justice Department was forced to use the "legal process" to obtain information related to Federal Reserve Chairman Jerome Powell’s congressional testimony about renovations at the central bank after he "ignored" requests from prosecutors, US Attorney Jeanine Pirro said Monday.
Pirro, the top federal prosecutor in Washington, DC, downplayed Powell’s shocking Sunday night suggestion that he was facing a criminal indictment after grand jury subpoenas were served to the Federal Reserve related to his June 2025 testimony to the Senate Banking Committee about the renovation project, which has been panned by President Trump.
“The United States Attorney’s Office contacted the Federal Reserve on multiple occasions to discuss cost overruns and the chairman’s congressional testimony, but were ignored, necessitating the use of legal process — which is not a threat,” Pirro wrote on X.

The Fed was to end the 'crashes' of the 19th Century. Instead it has been instrumental for the Great Depression, the Great Recession*, and several recessions. It has failed to fulfill its justification.

Democratic Sen. Mark Kelly sued the Pentagon on Monday over attempts to punish him for his warnings about illegal orders, claiming the Trump administration trampled on his constitutional rights to free speech.
Kelly, a former U.S. Navy pilot who represents Arizona, is seeking to block his censure last week from Defense Secretary Pete Hegseth, who said he censured Kelly over his participation in a video that called on troops to resist unlawful orders.
Hegseth said the Jan. 5 censure — by itself simply a formal letter with little practical consequence — was “a necessary process step” to proceedings that could result in a demotion from Kelly’s retired rank of captain and subsequent reduction in retirement pay.
Kelly asked the federal court in Washington, D.C., to rule that the censure letter, the proceedings about his rank and any other punishments against him are “unlawful and unconstitutional."
“The First Amendment forbids the government and its officials from punishing disfavored expression or retaliating against protected speech,” his lawsuit says. “That prohibition applies with particular force to legislators speaking on matters of public policy.”
U.S. District Judge Leon, who was nominated to the bench by Republican President George W. Bush, scheduled a hearing on Thursday in Washington, D.C., for Kelly's request for a temporary restraining order.
The legal action of a sitting U.S. senator suing the defense secretary is rare, if not jarring, and the latest effort from members of Congress to push back against what they see as an out-of-control executive branch.
The censure stemmed from Kelly’s participation in a video in November with five other Democratic lawmakers — all veterans of the armed services and intelligence community — in which they called on troops to uphold the Constitution and not to follow the Trump administration's military directives if they were unlawful.
The 90-second video was first posted on a social media account belonging to Sen. Elissa Slotkin. Reps. Jason Crow, Chris Deluzio, Maggie Goodlander and Chrissy Houlahan also appeared in the video.
Republican President Donald Trump accused the lawmakers of sedition “punishable by DEATH” in a social media post days later.
Kelly and the other lawmakers have not backed down from their video, which was released as the Pentagon began attacking suspected drug-smuggling boats in the waters near Venezuela. The attacks have now killed at least 115 people.
The Pentagon opened an investigation of Kelly in late November, citing a federal law that allows retired service members to be recalled to active duty on orders of the defense secretary for possible court-martial or other punishment.
Although all six lawmakers served in the military or the intelligence community, Hegseth said Kelly was the only one facing investigation because he is the only one who formally retired from the military and still falls under the Pentagon’s jurisdiction.
Hegseth, the Defense Department, Navy Secretary John Phelan and the Navy are named as defendants in the lawsuit. The Pentagon said in a statement it was aware of the lawsuit, but "as a matter of policy, the Department does not comment on ongoing litigation.”
Kelly said in a statement on Monday that he is “standing up for the rights of the very Americans who fought to defend our freedoms.” He accused Hegseth of trying to suppress dissent by threatening military veterans with depriving them of their rank and pay.
“That’s not the way things work in the United States of America, and I won’t stand for it,” Kelly said.

....Y'know, for a Naval Aviator with combat time, a test pilot, and astronaut...he ain't too bright.
The bottom line here is that this is black letter law - it's been reviewed and implemented and it's a military matter. This will be swatted down in fairly short order, and he'll just be in a deeper hole.
Now mind you, there is one thing he could have done which might have stopped this dead in its tracks, and that's stopped taking the retirement pay. On the other hand, that's going to be close to 10K a MONTH, and I guess his honor can't afford that.

Maybe Kelly can file his suit at 2AM on Saturday to a judge that, for some reason, is at his desk working. This traffic court judge will create a tortuous reasoning that will give him jurisdiction over a military matter based on vibes. The judge will be a dual Montenegrin citizen that was naturalized last Tuesday.

It's unconstitutional to hold two public offices at the same time. Drawing your 'retirement' pay says that you retain your commission. For the uninformed, military retirement is not exactly retirement. You are subject to recall to active duty, its more or less reduced pay on retainer. If he had suspended his retirement pay while in his elected office, he'd have an 'constitutional' argument, however his own position is unconstitutional.

So he cant do anything about his UCMJ actions, what he is going to do is try and get Heg for political attacks and say he weaponized the DOD. The "right" answer for the court is to tell him to appeal the summery board finding and let it go to trial, as the UCMJ provides. Its there he can claim persecution, racism and politics. However, during the trial he will have to step down as a senator.

The idea is to maneuver your enemy into terrain when you have an advantage. Our judicial system has proved to be hostile terrain for MAGA folks.
Kelly doesn’t have a case, but that won’t matter in our courts as they are today. We call the judges activists but really they are compromised. An impartial judge will not have contact about the case ex parte, but all the rulings are coordinated. You never see a liberal case get rebuffed unexpectedly. The liberal lawyers bring their case to a sympathetic judge 100% of the time. The corruption of the judiciary is massive. The judges that are being avoided for the lib cases are complicit in that they allow the system to be manipulated and say nothing.
