Dr. Francis Collins was not pardoned by President Biden, and he served as the director of the NIH until December 2021. When he then resign as NIH director and 4 months later in February 2022, he joined the Cabinet of Joe Biden as Acting Science Advisor to the President, replacing Eric Lander.

So YES! he can be brought to trial.
But at 76 years old he is worth more as a witness than a prisoner.

A person with only x# of years left, will run their mouth and tell all.
Because they want to have those last 5 or 6 years alive. Besides now the guilty see a loose end that needs quickly fixing. I can hear Hillary's phone ringing now.
