[NYPost] The deranged homeless man accused of savagely butchering Iryna Zarutska, a 23-year-old Ukrainian refugee, on a Charlotte light rail train has been found “incapable to proceed” on state murder charges.
According to a motion filed April 7, Decarlos Brown Jr. was evaluated Dec. 29 at Central Regional Hospital, and the subsequent report determined he was not competent to stand trial, according to WBTV. His attorney has asked the court to delay his competency hearing by 180 days.
The results were previously sealed in state court and were only revealed as the motion was filed.
Prosecutors did not object to the requested 180-day delay of Brown’s Rule 24 hearing, which was previously scheduled for April 30, which will determine whether he is fit to proceed with a potential death penalty trial.
Brown is also facing federal charges — and will remain in custody on that case, his lawyer Daniel Roberts said.
So will the state situation be superseded by federal laws about such things? What will they do if they, too, find him unable to stand trial?
A judge must now determine whether to accept the report’s findings, and the case against him will likely be delayed until his capacity is determined to be “restored” by the court, the station reported.
In the motion filed by Brown’s public defender, he claimed the court-required capacity hearing cannot take place with the accused killer in federal custody, and that the court also can’t order to have his capacity restored.
If a judge agrees Brown is incompetent to stand trial, state law mandates the charges be dismissed.
Ok. But does that mean he’ll be sent to a locked psych ward because he is a danger to the community, or will they again release him to the streets to kill again the next time his schizophrenic self gets the urge?
However, if the judge issues the ruling without prejudice, state murder charges could be refiled if he ever regains his capacity to be tried.
A similar situation happened in the Tar Heel State in 2020 when murder charges were dismissed without prejudice against Buford James Penley after he was determined to be incompetent by multiple psychologists, including one who worked for the DA’s office.
Under North Carolina law, a defendant is deemed capable to proceed to trial if they can understand the nature and object of the proceedings, comprehend his or her situation in reference to the proceedings, and assist in his or her defense in a rational or reasonable manner.
Brown has been in federal custody in Chicago since a grand jury indicted him on Oct. 22 for violence against a railroad carrier and mass transportation system causing death. He faces state charges of first-degree murder.
He’s been ordered to undergo a psychiatric evaluation pursuant to his federal case, but court filings viewed by the outlet last month show it hasn’t been completed and that the evaluation period has been extended.
The outlet reports that restoring competency can take a long time in North Carolina because of limited space in state psychiatric facilities, and said it’s not uncommon for defendants to wait a year or more for a bed to open up.
Brown, 35, whose mother told The Post is schizophrenic, was arrested at least 14 times in North Carolina for crimes ranging from assault and firearms possession to felony robbery dating back to 2007.
At the time of the senseless attack in late August, he was free on cashless bail after a magistrate released him with a “written promise” to show up for court after placing a bogus 911 call.
The horrifying caught-on-camera slaying became national news, and prompted President Trump to call for Brown to face the death penalty on federal murder charges.
Two months after the attack, North Carolina Gov. Josh Stein signed “Iryna’s Law,” which prevents cashless bail for some violent crimes and repeat offenders and improves checks on criminals released on bail.
Yes, but what does the new law require for a man too mentally ill to be tried, yet who remains a danger to the community?
In the video, Brown is seen seated on the train before Zarutska boards and unknowingly takes the seat in front of him, her blonde locks tucked beneath a black baseball cap from Zepeddie’s Pizza, part of her work uniform.
As she busies herself with her phone, completely unaware of the danger lurking inches behind her, Brown unfolds a pocket knife before looming over her and brutally stabbing her several times in the neck in the cowardly sneak attack.
Zarutska’s face contorted into a haunting look of horror as she bled out on the train. Bystanders barely seemed to notice the horrifying scene — and no one stepped up to render aid.
After the stabbing, Brown can be seen meandering through the Lynx Blue Line train as a trail of blood drops forms behind him. He was arrested at the scene a short time later.
During a welfare check last January, Brown asked cops to investigate a “man-made material” inside his body that was controlling his actions, according to an affidavit obtained by the Charlotte Observer.

All I see is a Liberal Socialist Democrat's (LSD's) and their controlled Media using a cover. To avoid reporting their actions and responsibility for the generating the situation, that likely played a major role in this.

Right now what the state would or would not do is irrelevant since the POS is in Federal custody. If the POS is determined to be incompetent to stand trial he'll either be sent to a psych facility that handles his type of mental illness or sent to a jail with a psych ward or wing.
Reagan was right & wrong when he closed the mental health facilities. "Warehousing" people not likely to harm themselves or others with a little care and proper medication should not be locked up for life. However people likely to harm themselves or others should not be out in society.

I go a step beyond you, Chantry. Those who do not accept the need to be medicated for their condition, and yet without medication are incapable of living a normal life — holding a job, caring for a home and themself — are better off warehoused, and society is better off without the low-functioning insane living on the streets. This mass homelessness nonsense has to stop — it is not kinder to those condemned to it.

It gives lawyers and psychiatrists a way to make a living at taxpayers expense.
But I'm sick and tired of hearing people blame Ronald Reagan for all the homeless nut cases and drug adddicts living on our streets, canyons and river beds. All they wanna do is blame Reagan. They don't want to actually do anything about it. If Reagan did something wrong, we've had forty, fifty or sixty years to fix it and yet it remains a problem. You can't keep blaming Reagan when subsequent politicians of all stripes, including Democrats, have had ample opportunity to fix the problem and failed.

His mother said he is schizophrenic, swksvolFF. Perhaps it could be controlled with medication, but he is homeless — free range and uninterested in help, a danger to all around him. Keeping him away from the unprepared is not punishment, but kindness.

The campfire argument goes: which is the greater general menace to society? A person who kills another in a cool, controlled, planned manner, or the person whose mind gets away and kills randomly? Basically, which should carry the greater penalty, 1st or 2nd degree murder?
I've heard both sides argued well, to the point I'm a third party of why make the distinction? I don't care if he was off meds, drunk, strung out, or doing what a book told him to do. I don't care what he was saying beforehand either. Fact is dude decided on a wind gust to murder somebody whose only provocation was crossing the murderer's path while minding their own business.
There's also the inside/outside the system, where outside are those with special conditions requiring medication, those who the system has failed and a pardon is necessary - those who are outside need a voucher from somebody inside the system, and those who vouch for a person outside the system should be held responsible when the 'suspect' is incapable of trial. That is, every person who signed off on Brown is accessory to murder (or murder as well, as some jurisdictions charge all involved in a crime with murder if there is a murder while crime is committed).
[NYPost] A former Army employee profiled by Politico was indicted Wednesday for allegedly sharing classified material with a journalist.
Courtney Williams, 40, held a top secret security clearance during the period she worked for a “special military unit” out of Fort Bragg, North Carolina, between 2010 and 2016, according to the indictment.
She is accused of repeatedly communicating with Seth Harp, a journalist and author, via phone calls and text messages between 2022 and 2025, during which she provided statements to Harp containing “classified national defense information” that he published in a book and magazine article published by Politico.

“I wish you had sent me a copy of what was to be published prior to publishing … I would definitely have been concerned with the amount of classified information being disclosed,” she wrote in one text message to the reporter, according to the indictment.
“I thought things I was telling you so you could have a better general understanding of how the [SMU] was set up or operated would not be published and it feels like an entire TTP was sent out in my name giving them a chance to legally persecute me,” she added.
Williams, per the indictment, noted, “I’m taking deep breaths, but have a feeling this is going to be more of a nightmare for my children than not.”
The former Army employee then lamented to her mother, “I might actually get arrested, and I don’t even get a free copy of the book,” according to another text message included in the charging documents.
When her mother asked why she might be arrested, Williams allegedly responded, “For disclosing classified information.”
Harp did not respond to The Post’s request for comment.
In a statement posted on social media, he described Williams as a “courageous whistleblower” and called her arrest “an outrage.”
In addition to the sensitive information she allegedly provided Harp, Williams is also accused of making “unauthorized disclosures of national defense information” on social media.
FBI Director Kash Patel said Williams’ arrest should “serve as a message to any would-be leakers: we’re working these cases, and we’re making arrests.”
“This FBI will not tolerate those who seek to betray our country and put Americans in harm’s way,” Patel wrote on X.

[Yahoo] Pastor charged with manslaughter after man drowned during baptism
A pastor has been charged with gross negligence manslaughter following the death of a man during a paddling pool baptism.
Robert Smith, 61, from Brixton, London, died during the ceremony held in the back garden of an address in Erdington, Birmingham, on October 8 2023.
Cheryl Bartley, 48, who is the pastor for the Life Changing Ministries church, has since been charged with one count of gross negligence manslaughter in relation to her role in the baptism, the Crown Prosecution Service said.
Emergency services were called to the address shortly after 1.30pm, but Mr Smith was pronounced dead at the scene.
It was reported at the time that Mr Smith was originally from Jamaica, had seven grandchildren and worked as a barber.
He is said to have suffered from Parkinson’s and had already been baptised, but wanted a second ceremony to become a “born-again believer”.
Following Mr Smith’s death, the pastor is said to have recorded a video in which she claimed to have seen the grandfather in heaven “dancing with Jesus”.
The ceremony was live-streamed on the church’s Facebook page, but the feed was cut short during the event, and the post has since been removed.
Life Changing Ministries describes itself as an Apostolic Church with an “Overseer and Founder” in Bartley.
It appears to be a small organisation with most of its activity conducted online. It is unclear whether the church has a permanent base.
Every Friday, Bartley puts on a “supernatural healing and deliverance” show on YouTube, in which she invites followers to join the call and be “set free”. The series is advertised with timings for both the UK and Jamaica.
Ms Bartley, of Erdington, will appear at Birmingham magistrates’ court on May 14.

[NYPost] Anthropic has triggered alarm bells by touting the terrifying capabilities of “Claude Mythos” – with executives warning that the new AI model is so dangerous it would cause a wave of catastrophic hacks and terror attacks if released to the wider public.
In a nightmarish analysis, Anthropic itself revealed that Mythos – if it fell into the wrong hands – could easily exploit critical infrastructure like electric grids, power plants and hospitals. The model has already “found thousands of high-severity vulnerabilities, including some in every major operating system and web browser,” according to the AI company.
Rather than a wide release, Anthropic, led by CEO Dario Amodei, has unveiled “Project Glasswing,” a plan to provide the model to a handpicked group of about 40 companies, including Amazon, Google, Apple, Nvidia, CrowdStrike, and JPMorgan Chase, which will receive early access to Mythos so they can use it to find and fix security flaws.
