Assuming it becomes law it allows for some amendments or postponing.

Unfortunately, California goes the other way and if their Nov 2026 referendum passes, it becomes retroactive to 1 Jan 2026.

unlike criminal law, tax law does do retroactive but almost always it is a tax cut

the people who end up paying would likely be exempt from any under withholding penalty

in any event the tax due wouldn't be until Apr 2027

given that the exodus of billionaires is on going, I'm not sure how partial residency would work for the unrealized gain tax

I would expect that every single billionaire who would stay in California is taking steps to contest whatever assessment the State makes both on the constitutionality of taxing unrealized gains and the way such is computed
