On Friday, Troy McAlister's attorney, Scott Grant, asked the court to grant mental-health and substance-abuse diversion under California Penal Code 1001.36, which could allow McAlister to enter treatment instead of facing decades in prison if Judge Michael Begert rules that he qualifies.
In deep-blue San Francisco, residents rallied to protest what they say would undermine accountability.
''91 felonies, 2 deaths, No more chances,'' signs read outside San Francisco's Hall of Justice. ''Judge Begert chooses politics over public safety. Justice NOW.''
The case of McAlister, 50, has long been a lightning rod of restorative justice reform, forcing elected officials to confront whether policies meant to show compassion to offenders put the public at risk.
The motion has sparked protests outside San Francisco's Hall of Justice, with community members and victims' families calling the diversion request an ''insult to justice.''
Some have even threatened to recall Begert if diversion is granted.

[NY Post] A middle school gym teacher who described himself as a "pig" before being jailed for repeatedly raping a 15-year-old girl was killed by another inmate in his North Carolina cell Sunday.
Ernest Nichols, 60, was convicted in 2011 and sentenced to 15 years behind bars for statutory rape. He was originally arrested on a staggering 27 charges, including a laundry list of sex offenses, WRAL reported.
Nichols was found dead in his cell at the Greene Correctional Institution in Maury, NC around 6:50 a.m., sending the prison into a lockdown.
By Tuesday, the Green County Sheriff’s Office served a murder warrant to fellow inmate Wilbert Baldwin, who is already serving a sentence for second-degree murder, the outlet reported.
Nichols worked at Ranson Middle School in Charlotte for 14 years, but was swiftly suspended without pay and banned from the grounds when administrators learned of the accusations, WBTV previously reported.

[MSN-CNN] A notable flood threat is on tap for some of the driest areas of the United States as an ailing former Hurricane Priscilla combines with another storm system to create a long-lasting rainfall event.
More than an October’s worth of rain could fall within days in some areas of the Southwest as the week comes to a close. And another tropical system following on the heels of Priscilla early next week could pile onto the flood threat.
It’s all happening in part because Priscilla, now a tropical storm, will juice up the atmosphere over the Southwest US with near-record levels of moisture for this time of year.

[Daily Mail, where America gets its news] A huge asteroid came within 300 miles of hitting Earth, and scientists only noticed after it had already skimmed past the planet.
The 9.8-foot (three metre) space rock, dubbed 2025 TF, flew over Antarctica in the early hours of October 1. "Nearly the height of an NBA basket!"
Passing at an altitude of just 265 miles (428 kilometres), the rock came closer to the Earth's surface than the orbit of the International Space Station.
However, space agencies only realised the near-miss had occurred when the asteroid was detected by the Catalina Sky Survey a few hours later.
While a miss this close might sound alarming, the European Space Agency (ESA) claims there was never any serious danger.
Based on its estimated size, 2025 TF would have most likely burned up or exploded in the atmosphere rather than slamming into the surface.
ESA said in a statement: 'Objects of this size pose no significant danger.
'They can produce fireballs if they strike Earth’s atmosphere, and may result in the discovery of small meteorites on the ground.'
