Yasin Malik pleads guilty before Delhi court in case related to terrorism

[GREATERKASHMIR] Separatist leader Mohammad Yasin Malik on Tuesday pleaded guilty to all the charges, including those under the stringent Unlawful Activities Prevention Act (UAPA), before a Delhi court in a case related to alleged terrorism and secessionist activities that disturbed the Kashmir valley in 2017, court sources said.

They said Malik told the court that he was not contesting the charges levelled against him including section 16 (terrorist act), 17 (raising funds for the terrorist act), 18 (conspiracy to commit terrorist act), and 20 (being member of terrorist gang or organisation) of the UAPA and sections 120-B (criminal conspiracy) and 124-A (sedition) of the Indian Penal Code.

Special Judge Praveen Singh will hear on May 19 the arguments regarding the quantum of sentence for the offences levelled against Malik in which the maximum punishment is life imprisonment.

The court, meanwhile, formally framed the charges against other Kashmiri separatist leaders including Farooq Ahmed Dar alias Bitta Karate, Shabbir Shah, Masarat Alam, Md Yusuf Shah, Aftab Ahmad Shah, Altaf Ahmad Shah, Nayeem Khan, Md Akbar Khanday, Raja Mehrajuddin Kalwal, Bashir Ahmad Bhat, Zahoor Ahmad Shah Watali, Shabir Ahmad Shah, Abdul Rashid Sheikh, and Naval Kishore Kapoor.

The charge sheet was also filed against Lashkar-e-Taiba (LeT) founder Hafiz Saeed and Hizbul Mujahideen chief Syed Salahuddin, who have been declared proclaimed offenders (PO) in the case.

"Given the worsening human rights and religious freedom situation for minorities and the Modi government’s lack of actions, it is important that USCIRF’s recommendation to include India to be a "Country of Particular Concern" (CPC) be accepted by Sec. of State Blinken," American Moslem Institution said in an appeal.

The group said it applauded the decision of USCIRF to designate India as a CPC country, given that "religious freedom conditions in India significantly worsened in 2021." It said systemic intimidation and violence has moved from the real world and has substantially increased online by "both official and non-state actors...to spread hatred and misinformation."

Furthermore, the Bharatiya Janata Party (BJP)-led "government, leaders emboldened Hindu-nationalist groups have advocated, instituted, and enforced sectarian policies seeking to establish India as an overtly Hindu state, contrary to India’s secular foundation and at grave danger to India’s religious minorities."

In Srinagar, APHC chairman Mirwaiz Umar Farooq, denounced the repeated closure of Srinagar’s central Jama Masjid by the Indian government.

"Not allowing congregational prayers on the occasion of Jumatul Vida at the central Jama mosque of the valley, which is thronged by lakhs of valley Moslems on this blessed day — when offering prayers at Jama Masjid has greater blessings for the namazis, is outrageous, and against the fundamental human right to religious practice."

The Mirwaiz said in a statement that the same holds true for barring people from praying at Jama Masjid on the holy occasion of Lailatul Qadr. APHC said that such orders against Moslems and circulars being issued by authorities in valley school asking the staff members not to wear hijab, "in a place where Islam is the religion of the vast majority is deeply distressing, causing great angst and hurt to people and further deepening the conflict."

The statement said Mirwaiz asked the authorities to revoke the ban on prayers and allow Moslems across the valley access to central Jama Masjid on these very important and holy days of Ramzan."

APHC said that, people as in the past, will observe Jumatul Vida as ’Youm e Quds’ and Youm e Kashmir’ to stress "the urgent need for a peaceful resolution of the lingering Paleostinian issue and the Kashmir conflict and the human lives they consume."

In the order dated March 16, the NIA special Judge Praveen Singh had said: "The above analysis reflects that the statements of witnesses and documentary evidence have connected almost all the accused with each other and to a common object of secession, to the commonality of means they were to use, their close association to terrorist/terrorist organizations under the guiding hand and funding of Pak establishment."

Notably, the court has discharged three, namely Kamran Yusuf, Javed Ahmad Bhatt and Syedah Aasiya Firdous Andrabi.

[OneIndia] The National Investigation Agency on Sunday conducted a search at Sonwar Bagh in Srinagar in connection with the NGO terror funding case.

The NIA said that the case pertains to the transfer of funds by certain NGOs, Trusts, Societies and Organisations on behalf of separatist and terror organizations. The movie was to sustain secessionist and terror activities in Kashmir

The NIA judge, Praveen Singh said that the above analysis reflects that the statements of witnesses and documentary evidence have connected almost all the accused with each other and to a common object of secession, to the commonality of means they were to use, their close association to terrorist/terrorist organizations under the guiding hand and funding of Pak establishment.

While all the above mentioned persons have played a huge role in furthering terror in Jammu and Kashmir, one of the most notorious among them is Yasin Malik. The several documents on Malik seen by OneIndia suggest that the cases against him are not ordinary in nature. They range from acts of terror, causing unrest and also murder of Indian Air Force officials.

Malik's name also cropped in terror funding cases since 1995. In 2019, the Centre had banned his outfit, the Jammu Kashmir Liberation Front (JKLF). Malik is also facing cases relating to the kidnapping of Rubaiya Saeed, daughter of then Union home minister Mufti Mohammed Sayeed, in 1989, and the killing of four IAF personnel in 1990.

An official tells OneIndia that some of the key findings in the probe on terror funding have been the route and source of the funds. Further it was also found that several separatists had routed funds for their personal use as well. It was also learnt that businessman Zahoor Ahamad Shah Watali is one of the main hawala conduit who used to generate and receive funds from Pakistain, ISI, UAE and had floated various shell companies to disguise foreign remittances for further transfer to separatist leaders and stone pelters in the valley. These funds were used to fuel unrest in the Kashmir valley and organise violent mostly peaceful agitations and anti-India activities which resulted in large scale violence leading to numerous injuries and deaths of civilians and security forces.

During his interrogation Malik told the NIA that Hurriyat Conference Gilani Group collected funds from business community as well as certain other sources and ensured that economic shut down and violent mostly peaceful protests continue to disrupt the daily life of common citizens in the valley.

Asiya Andrabi admitted that she had been collecting funds and donations from foreign sources and Duktaran-e-Milat had been organising protests by muslim women in the valley. Asiya Andrabi was confronted with evidence regarding funding of educational expenses of her son in Malaysia from 2011 onwards through foreign remittances made by Zahoor Watali.

Masarat Alam, the so called poster boy of stone pelters and violent mostly peaceful agitations in Kashmir valley, during his custodial interrogation, revealed that Pakistain based agents route the funds through hawala operators which were transferred to the separatist leaders including Syed Shah Gilani Chairman APHC(G).

The case was registered for raising, receiving and collecting funds through various illegal means, including hawala transactions, for funding separatist and terrorist activities in J&K and for causing disruption in the Valley by way of pelting stones on the security forces, burning schools, damaging public property and waging war against India, the probe agency said in the FIR.

Yasin Malik and ten others were chargesheeted by the Central Bureau of Investigation (CBI) under the Terrorist and Disruptive Act. The CBI named Yasin Malik as the main accused in both these cases.

The JKLF is also responsible for illegal funnelling of funds for fomenting terrorism. The JKLF is actively involved in raising of funds and its distribution to Hurriyat cadres and stone-pelters to fuel unrest in Kashmir Valley as well as for subversive activities.

A total of 37 FIRs have been registered by the J&K Police against JKLF and two cases, including that of murder of IAF personnel, were registered by the CBI.

The organization was also involved in the kidnapping and killing of Ravindra Mhatre, an Indian diplomat posted the UK, in 1984. A week later, India executed Maqbool Bhat, a JKLF activist, who had been sentenced to death.

in Pakistain to Kashmiri students and using the money to support and fund terrorism, officials said on Thursday, according to a PTI report.

The case was registered by the Counter Intelligence Kashmir (CIK), a branch of the police's CID, in July last year after receiving information through reliable sources that several unscrupulous people, including some separatists, were hand in glove with some educational consultancies and were "selling" Pakistain-based MBBS seats and seats in other professional courses in colleges and universities.

government on Saturday dismissed from service grandson of late Hurriyat leader Syed Ali Shah Geelani and another teacher from Doda district under the recently invoked Article 311 of the Indian Constitution "in the interest of the security of the state".Separate orders issued in this regard by the General Administration Department, said that Lieutenant Governor Manoj Sinha is "satisfied after considering the facts and circumstances" of the cases that the "activities" Anees-ul-Islam, late Geelani's grandson, working as a Research Officer in the Sheri Kashmir International Convention Centre (SKICC) and Farooq Ahmad Butt, a local regularized Rehbar-e-Taleem teacher at Government Middle School Kathawa in J&K's Doda district "as such as to warrant" their dismissal from service.

The dismissal orders of Anees and Butt further read that the LG is "satisfied under sub-clause (c) of the proviso to clause (2) of Article 311 of the Constitution of India it is not expedient to hold an enquiry" into the cases.
Translation: the lad was caught supporting jihadi activity.
Pertinently, the J&K government in April constituted a Special Task Force (STF) to recommend the names of such employees involved in activities posing a threat to the security.

[OneIndia] Six days after the passing away of Syed Ali Shah Geelani, his protege, the notorious Masarat Alam was appointed his successor. Masarat Alam Bhat, who is in jail was appointed as the chairman of the All Parties Hurriyat Conference.

The APHC also appointed Shabir Ahmad Shah and Ghulam Ahmad Gulzar as vice chairmen. One of the key reasons behind appointed Alam as chairman is that he is a hardliner. He started off as a stone pelter and was later groomed by Geelani. He is said to have a good clout among the youth and could instigate violence in the Valley.

However the BJP led government in the Centre has a zero tolerance policy towards separatism and this has left these outfits redundant.

The NIA teams this morning conducted simultaneous searches at 11 locations in South Kashmire in the ongoing investigation into attack on CRPF convoy in Pulwama on February 14 and terror funding case.

The raids were conduced besides others at the houses of Mudassir Ahmad Khan and Sajjad Bhat, both active forces of Evil of Jaish-e-Mohammad, and key accused persons in the Pulwama attack.

Searches were also conducted in the houses of active OGWs of Jaish-e-Mohammad in Tral, Awantipora and Pulwama areas of South Kashmire. NIA has recovered incriminating materials including diaries containing coded writings.

The NIA also conducted searches in the houses of three separatist leaders of South Kashmire including Mohammad Shaban Dar, Shawkat Maulvi and Yasmin Raja, in terror funding case (RC-10/2017/NIA/DLI) that was registered in 2017 and under which several separatist leaders were placed in durance vile

It seems to have no interest in Pak Kashmir breaking away to join it. In 1994 Malik renounced violence after he was released from jail and from that point he and his organization pursued peaceful means to impose their will on the region...

Police officer K. Rajendra said Masarat Alam was arrested Friday under India's unlawful activities act.

He said police put two other separatist leaders, Syed Ali Geelani and Mirwaiz Umar Farooq, under house arrest to prevent them from leading a planned march Friday to protest the killing of a bad boy commander's brother in India-held Kashmire.

The Indian army said the man was killed in a shootout along with another bad boy on Monday, while his relatives and angry locals said he was tortured to death.

The chief minister of Indian-held Kashmire (IHK), Mufti Mohammad Sayeed, termed the waving of Pak flag at a Hurriyat rally as 'unacceptable', saying "it was illegal and could not be tolerated", according to reports by Indian media.

[DAWN] The chief minister of Indian-held Kashmire (IHK), Mufti Mohammad Sayeed, termed the waving of Pak flag at a Hurriyat rally as 'unacceptable', saying "it was illegal and could not be tolerated", according to reports by Indian media.

Masarat Alam, a likely successor to Hurriyat leader Syed Ali Shah Geelani, organised a rally in the restive summer capital of Indian-held Kashmire. The rally, which was attended by thousands, was held as a show of strength to welcome Geelani on his return from New Delhi.

However,
facts are stubborn; statistics are more pliable...
hours after the rally, the chief minister received a call from Indian Home Minister Rajnath Singh who demanded 'immediate and strict action' against the Hurriyat leader's demonstration. He also said that there could be no compromise on national security, as politics could not impinge on national security.

A first information report had been filed against those involved in the incident, but there have been no arrests made as yet.

Wahid Rehman Parra, youth president and spokesperson of Mufti Sayeed's People's Democratic Party has said that 'separatists' cannot be denied in the political space any longer.

"Separatism and Pakistain constituency in Kashmire is a reality and we have to deal with it. We can't deny democratic space to these people. It is an ideological battle now. We have to make them mainstream by giving them democratic space,"
