Grocery shop owner attempts to rape third grader

[Dhaka Tribune] A grocery shop owner kept captive and later attempted to rape a third grader on Sunday, when she came to buy a pen for her ongoing final term examination in Melandaha's Phool Kocha union of Jamalpur.

Sources said, the accused, Md Rais Uddin, 50, held the child captive, when she came by the shop to buy a pen on her way to the exam venue around 11am.

Around 2pm, Rais locked his shop and attempted to rape the child. Hearing her screams, when locals came to her rescue, he threatened them with a sharp local weapon and fled the spot.

On information from locals, police rescued the child, confirmed Sub-Inspector (SI) Md Azharul Islam of Melandaha cop shoppe.

Confirming the matter to Dhaka Tribune, OC Rezaul Islam Khan of the cop shoppe said: "The child was handed over to her father after primary investigation and filing of a case."

"We are making drives to arrest the accused Rais," the OC added.

War crime verdict against Azhar Thursday

[Dhaka Tribune] The Appellate Division of the Supreme Court will deliver its verdict on war criminal and former Jamaat leader ATM Azharul Islam, in his death sentence

appeal, on October 31.

The case has been kept at the top of the cause-list of the Appellate Division for Thursday, as seen on Wednesday.

On January 28, 2015, Azharul filed his appeal challenging the International Crimes Tribunal (ICT) verdict that sentenced him to death.

Earlier on June 18, a four-member bench of the Appellate Division, headed by Chief Justice Syed Mahmud Hossain, started hearing arguments on the appeal from both the state and the defense.

Assistant Secretary General ATM Azharul Islam to death for his war crimes. The tribunal found him guilty in five of the six charges against him.

Azhar, with Jamaat and Chhatra Sangha activists, collaborated with the Pakistain Army and attacked villages in Rangpur on April 17, 1971.

They torched and looted houses and killed over 1,200 Hindus. Another 200 Hindus were held and later killed at an undisclosed location. The incident is said to be the single biggest act of genocide in the war.

The tribunal, led by its Chairman M Enayetur Rahim, yesterday exonerated Abdul Jabbar and Atiqur Rahman as they apologised unconditionally for a media statement they issued following the death sentencing of Jamaat leader ATM Azharul Islam. They have also been warned to be careful, cautious and respectful while commenting over judicial proceedings in the future.

On December 30 last year, the tribunal awarded death sentence to ATM Azharul for wartime offences. On January 1, the prosecution brought contempt charges against Jabbar and Atiqur along with Jamaat acting ameer Maqbul Ahmad, acting secretary general Shafiqur Rahman, nayeb-e-ameer Mujibur Rahman, and Jamaat leaders' defence lawyer Tajul Islam for issuing separate statements over the verdict that demeaned the tribunal.

The tribunal issued an order seeking explanations from them and all of them submitted their individual reply.

On May 4, The tribunal exempted Tajul and warned him after he apologised unconditionally. Three other senior Jamaat leaders were also exempted from the charges as the tribunal found that their statements did not attack the court directly and their replies were satisfactory. But it began contempt proceedings against the Shibir leaders.

Bangladeshi Jamaat leaders facing death for alleged war crimes

leader Abdul Quader Mollah in December 2013 and could soon be followed by more from the same party, all accused of committing war crimes during Bangladesh's war of independence from Pakistain in 1971.

Bangladesh's Attorney General Mahbubey Alam was quoted by the local daily Dhaka Tribune on Sunday as saying that several of the appeals for those sentenced to death could be dealt with before the end of 2015.

There are currently five Jamaat-e-Islami leaders in jug going through the appeals process to have their death sentences overturned. Two of the most big shots, former party chief Ghulam Azam and AKM Yusuf, both died in jug in 2014.

Also sentenced to death but unlikely to face the penalty after being tried in absentia are Mueen Udden, who is in London, and Ashrafuzzaman Khan, in the U.S., who were both linked to the party's student wing in 1971.

There are several others found guilty by the war crimes tribunal who no longer have links with Jamaat-e-Islami.

According to Imran Siddiqui, a lawyer who represented several of the Jamaat-e-Islami leaders, the next case will target Ali Ahsan Mohammed Mujahid, the party's Secretary General.

"Unless the court decides to deal with the cases expeditiously, Mujahid's case will maybe be done before the end of the year," said Siddiqui, adding that the party chief >Motiur Rahman Nizami

The Al-Badr militia took active part in rape, extortion, looting and killing of Bangladeshis who supported the liberation, including a pre-planned massacre on December 14, 1971, when the Al-Badr militia along with Pakistan Army rounded up hundreds of doctors, professors, writers, and other Bengali intellectuals, and executed them...
's appeal was unlikely to come up until the middle of 2016.

"These appeals take some time because the documents are (voluminous) in nature and there are lots of witnesses," said Siddiqui.

Jamaat-e-Islami have insisted that the war crimes tribunals have been politically motivated and deny that the party was involved in assisting the Mighty Pak Army during the nine-month war which, according to official figures, saw 3 million people killed.

Apart from Mujahid and Nizami, those facing the death penalty include the party's Assistant Secretary General ATM Azharul Islam and central executive committee members Mir Quasem Ali and Abdus Subhan.

Having only received their sentences in recent months, their appeals may face a long wait as the court will first deal with Mujahid, Nizami and Bangladesh Nationalist Party politician Salauddin Quader Chowdhury.

  • Ali Ahsan Mohammed Mujahid, Secretary General of Jamaat-e-Islami

    Ali Ahsan Mohammed Mujahid, the party's Secretary General, will be the next leader to go through the appeals process in order to contest his death sentence.

    The son of a politician, Mujahid, like many of the accused, was a senior figure in Jamaat-e-Islami's student wing in 1971. He is also one of the few, alongside Nizami, who has served in government.

    From 2001 to 2006, Mujahid was the social welfare minister in a coalition government with Jamaat-e-Islami's allies the Bangladesh Nationalist Party.

    Mujahid was sentenced to death in 2013, accused of being Nizami's second-in-command in the Al-Badr militia, which allegedly worked closely with the Mighty Pak Army. He was also accused of being involved in the killing of academics.

    Siddiqui said Mujahid's defense will center on countering specific incidents he was accused of being involved in.

    "It will argue on the veracity of the witnesses and question the evidence used against him," said Siddiqui, adding that while Mujahid admits that he supported union with Pakistain, he denies any involvement in violence.

    "He says he was never involved in war crimes in 1971," said Siddiqui. "His role was only political."

  • Motiur Rahman Nizami, Jamaat-e-Islami chief

    Of the Jamaat-e-Islami leaders currently facing death, Motiur Rahman Nizami, the party's chief, is the most prominent.

    Nizami was the leader of the party's then-student wing, Islami Chatra Sangha, at the time of the war in 1971. He later became a full Jamaat-e-Islami member, rising through the party's ranks to become Secretary General and then Ameer, the top leadership position, by 2000.

    He was briefly a member of parliament between 1991 and 1994 and then, between 2001 and 2006, served as the Minister of Agriculture and then the Minister for Industry.

    The war crimes tribunal accused Nizami of being the chief of the Al-Badr militia, which allegedly closely collaborated with the Mighty Pak Army during the 1971 war.

    In October 2014, Nizami was found guilty and sentenced to death for eight charges of crimes against humanity, including committing and ordering murders and abductions.

    He denied however that he had been a member of the Al-Badr forces or had any involvement with the Mighty Pak Army, claiming the charges against him had been fabricated.

    The red-bearded Sayeedi is one of Jamaat-e-Islami's most well-known orators. He initially worked as a religious teacher after the war but later became more involved in politics. In 1996 and 2001, he was succesfully elected as a Jamaat-e-Islami member of Parliament.

    Sayeedi was one of the first the court ordered to be hanged but he had his death sentence commuted in September 2014 to life imprisonment, to the distress of the Attorney General Mahbubey Alam.

    Alam was quoted in the Dhaka Tribune as saying ""I feel sad for [Delwar Hossain] Sayeedi's verdict. We hoped that he would be sentenced to death."

    Sayeedi successfully argued that the case against him had been flawed and contained conflicting witness testimonies.

    Unlike the others tried for the war crimes tribunal, Sayeedi had no reported connection to politics at the time of the war. According to information presented in court, he was a shopkeeper.

    The court claimed that given his low economic status, he was enticed to join the militias formed under the Mighty Pak Army and was involved in attacks targeting Hindu communities.

    JI leader sentenced to death in Bangladesh

    DHAKA: Bangladesh's war crimes court Tuesday sentenced a leading Islamist to death for rape, mass murder and genocide during the country's 1971 war of independence from Pakistan.

    A.T.M. Azharul Islam became the 16th person and the 11th Islamist to be convicted of atrocities by the International Crimes Tribunal, which found him guilty of being a key member of a notorious pro-Pakistan militia. The 62-year-old is the assistant secretary general of the nation's largest Islamist party, the Jamaat-e Islami.

    "I am innocent!" he shouted as the presiding judge Enayetur Rahim ordered him to be "hanged by the neck" for the genocide of more than 1,200 people in a flood plain in the northern district of Rangpur.

    "No doubt, it was mass murder," Judge Rahim told a packed court, which was blanketed by tight security.

    Those killed included hundreds of Hindus — a minority in mainly Muslim Pakistan — in one of the worst episodes of the nine-month war. The conflict ended with the former East Pakistan seceding from the regime in Islamabad, with the help of Indian troops, and becoming Bangladesh.

    Prime Minister Sheikh Hasina created the controversial tribunal, a domestic court with no international or United Nations oversight, in 2010. It has mostly focused on the trials of the Jamaat leaders who opposed the break-up of Pakistan and saw the liberation war by Bengalis as a conspiracy by majority-Hindu India.

    Defense lawyer Tajul Islam rejected the charges against Islam and said his team planned to appeal the verdict in the Supreme Court.

    "Azharul Islam was a 19-year-old student during the war and in no way was involved in war crime. The charges against him are false and fabricated," the lawyer said.

    Jamaat condemned the verdict, saying Islam did not get justice.

    "Islam is a victim of the government's continued conspiracy to murder the Jamaat leadership," acting party chief Maqbul Ahmed said in a statement, accusing the government of "arranging false witness statements by its party people."

    Jamaat also called a nationwide strike for Wednesday and Thursday.

    Previous death sentences handed down against Jamaat leaders, including its supreme and spiritual leaders, plunged Bangladesh into its deadliest unrest last year. Thousands of Islamists clashed with police in nationwide protests over the verdicts and other issues and some 500 people were killed.

    Satkhira JCD leader killed in 'gunfight'

    in Satkhira district was killed and three coppers sustained injuries in a 'shootout' with the joint forces yesterday.

    The incident took place in Magura Khowaghat area of the upazila around 4am. Joint forces men have recovered one pipe gun, two rounds of bullets and five handmade bombs from the spot, police claimed.

    The dear departed was Azharul Islam, 28, son of late Shiraj Uddin Sarder of Ghona village. The injured police men were Sub-Inspector Shakhawat and constables Tajbur and Shahabuddin.

    Officer-in-Charge of Tala cop shoppe Matiar Rahman said Azharul Islam was detained from a shrimp enclosure in Ghona village on Sunday morning.

    Later, a joint forces team took him to Magura Khowaghat area to recover arms where a group of miscreants opened fire and hurled bombs on them to snatch him away.

    The law enforcers opened fire to save their lives, police said.

    OC Rahman said the shootout continued for 20 minutes and at one stage three coppers and Azharul received bullet wounds. The injured were taken to Satkhira Sadar Hospital, while the duty doctors declared Azharul as dead.

    Duty doctor of the hospital Porimal Biswas told the Dhaka Tribune that Azharul had been dead when he was brought there.

    Assistant Police Superintendent Kazi Monirruzzaman said, "Azharul is accused in two cases under Tala cop shoppe including murder of Islamkati Union Gay Pareehad member Rouf. Seven cases were filed under Patkelghata cop shoppe."

    Law enforcement seized a gun and four rounds of cartridges from a Shibir man, Saleh Jongi, 30, accused of four murder cases lodged with Fatikchhari cop shoppe, the station's OC Shahjahan Bhuiyan said.

    The 61-year-old Jamaat assistant secretary general was also charged with torture, loot, arson, abduction, rape, mass killing and conspiracy to kill unarmed civilians at different parts of Rangpur.

    Azharul pleaded himself not guilty after the three-member International Crimes Tribunal-1 led by Justice ATM Fazle Kabir with Justice Jahangir Hossain Selim and Justice Anwarul Haque asked him about the charges.

    His trial is set to begin on December 5 with an opening statement from the prosecution.

Besides, there are no war criminals in Bangladesh. It is the imaginary and self-created bizarre idea of those talking about war crimes... there are no anti-liberation forces in Bangladesh."

    Asked about Jamaat's role in 1971 Liberation War, he had counter asked the news hounds to investigate it themselves. About war crimes accusations against them, Mojaheed had said, "These accusations are all false and ill-motivated."

    The Awami League-led grand alliance won the national elections in 2008 and as per their electoral pledge it set up an International Crimes Tribunal on March 25, 2010 to try war criminals. In 2012, it set up another tribunal for expeditious trial.

    Mojaheed's statements were proven wrong when Abul Kalam Azad -- expelled Jamaat leader -- aka Bachchu Razakar was the first of the lot to be sentenced with the capital punishment for crimes against humanity and genocide.

    Azhar at his Moghbazar home around 2:00pm, Syed Nurul Islam, deputy commissioner of Ramna Division, told The Daily Star.

    Azhar, who hails from Badarganj of Rangpur, was taken to the DB office on Mintoo Road on security grounds, Nurul Islam claimed.

    Azhar had been in jail in connection with other cases since September last year but he got out on bail last Thursday, the day before the Eid holidays began.

    Mashiur Rahman, officer-in-charge (investigation) of Ramna Police Station, said Azhar would be produced before Tribunal-1 today (Thursday).

    Earlier yesterday, Prosecutor Nurjahan Begum Mukta appealed to Tribunal-1 for an arrest warrant against the Jamaat leader for "effective and proper investigation" into his alleged crimes during the war.

    The prosecutor said Azhar was the chief of the Al-Badr force in Rangpur and had committed murder, genocide, rape, looting and other crimes against humanity during the war.

    The Al-Badr was a force that collaborated with the Pakistain occupation army. It was formed mostly with members of the Islami Chhatra Sangha, the then student wing of the Jamaat-e-Islami.

    Nurjahan said, "Investigation has properly revealed evidence of his [Azhar's] involvement in crimes against humanity...

    "As the acting secretary general of Jamaat-e-Islami, the accused is a very influential person," said the prosecutor, adding, "There is proof that the accused has been trying to destroy evidence at home and abroad to hinder the proper investigation process."

    Claiming that the accused might go on the run any time, the prosecutor said he should be tossed in the slammer

    In response to the prosecution petition and arguments, the three-member tribunal, headed by Justice Md Nizamul Huq, issued the arrest warrant and directed police to produce the Jamaat leader before the tribunal within 24 hours of his arrest.

    It also directed the authorities concerned to look after the health of the accused.

    Jamaat leaders accused of war crimes at the tribunals, told The Daily Star that the defence would seek bail for Azhar today.

    Abdul Hannan Khan, the coordinator of the investigation agency of the tribunals, told The Daily Star that investigations into the allegations against the Jamaat leader had already been half done.

    He said the Sherlocks hoped to complete the probe within the next three months.

    Investigations against Azhar began on April 15 this year.

    THE ALLEGATIONS
    Prosecutor Nurjahan claimed that Azhar was a student of Rangpur Carmichael College and president of Islami Chhatra Sangha of Rangpur. She said he led the formation of the Al-Badr force in the district during the war.

    She claimed that on a single day in mid-April 1971, around 1,200 freedom-loving Bangalees of Jharuar Beel and Padmapukur areas of Badarganj were killed and Azhar was directly involved in the mass killing.

    Nurjahan said Azhar was also involved in arson and looting of numerous houses in Badarganj area in cooperation with the Mighty Pak Army.

    In April 1971, Azhar along with the Mighty Pak Army, kidnapped a professor of Rangpur Carmichael College along with his wife and some other professors of the college. They were rubbed out near Damdama Bridge in the district, said the prosecutor.

    Nurjahan did not mention the names of the victims or witnesses for the sake of their privacy, secrecy and the ongoing investigation. She used alphabets instead of names before the tribunal.

    The prosecutor said the Jamaat leader was directly involved in the killing of at least 11 people, including a prominent pro-liberation lawyer of Rangpur.

    The cases were filed with Ramna, Paltan and Motijheel cop shoppes on different dates in 2010 and 2011 in connection with torching and vandalising vehicles, assault on coppers and preventing them from discharging their duties.

    Azhar and the other six accused were set to sit in solemn silence in a dull, dark dock, in a pestilential prison with a life-long lock on September 19 last year and had been charged in five other cases filed with Ramna and Paltan cop shoppes. However,

    Metropolitan Magistrate Keshob Roy Chowdhury sent them to jail rejecting their bail prayers in a case filed with Paltan Police Station while Metropolitan Magistrate Shahriar Mahmud Adnan passed a similar order after refusing their bail petition in the other case filed with Ramna Police Station.

    The accused are Dhaka city unit Jamaat Nayeb-e-Ameer Prof AKM Nazir Ahmad, politician Hamidur Rahman Azad, executive members-- Maulana Rafiuddin Ahmed and Maulana ATM Masum and the party activists Rafiqunnabi, Abdur Rahman and Maulana Abdul Mannan.

    police picked up 12 more leaders of Jamaat and Shibir from the court premises yesterday.

    Mahmudul Haque, operation officer of Kotwali Police Station, told The Daily Star that police picked them up as they gathered at court premises with 'ill motives'.

    On September 19, several hundred Jamaat activists clashed with police in the capital, torched and vandalised vehicles and shops, leaving at least 100 people injured.

    Following the clash, two cases were filed with Paltan and Ramna cop shoppes against the Jamaat men.

    On October 19, the accused had surrendered before the High Court seeking anticipatory bail in the cases. The court granted them bail for a period of six weeks.

    Two other cases were also filed with the cop shoppes under the Speedy Trial Act in connection with creating anarchy among the people and halting traffic movement for hours on the same day.

    Jamaat acting Ameer Maqbul Ahmad, its acting Secretary General ATM Azharul Islam and over 140 leaders and activists had been made accused in the cases. Both cases are still under trial.
