Nawaz Sharif disqualified over conduct unbecoming: Supreme Court |
2017-11-08 |
[DAWN] The Supreme Court on Tuesday concluded that denying an asset or defending a trust deed ‐ supposedly written in 2005 in a font that became commercially available in 2007 ‐ was below the dignity and decorum of the office of the prime minister. Shades of Dan Rather! The court could not have shut its eyes when an asset, arising out of "Iqama" (work permit), surfaced during the investigation of the Panama Papers case, especially since a much higher level of integrity was expected from the holder of the highest elected office in the land, the apex court said, apparently answering the rhetorical question posed by ousted prime minister Nawaz Sharif ![]() in nearly every public speech since his disqualification. These observations came in a detailed 23-page judgement, authored by Justice Ejaz Afzal Khan, explaining the reasons why a five-judge Supreme Court bench had rejected a number of review petitions instituted against the July 28 verdict disqualifying Nawaz Sharif. |

But Sharif's ruling Pakistan Muslim League-Nawaz party, which has a majority in parliament, is expected to name a new prime minister to hold office until elections due next year. The Supreme Court ruled unanimously that Sharif was not fit to hold office after an investigative panel alleged his family could not account for its vast wealth. "He is no more eligible to be an honest member of the parliament, and he ceases to be holding the office of prime minister," Judge Ejaz Afzal Khan said in court. Prior to the decision, several cabinet ministers, including Sharif's closest allies, said the ruling party would respect the Supreme Court's verdict. "Go, Nawaz, Go," shouted supporters of the PTI opposition party who had gathered outside the court, and who jeered politicians from Sharif's party. |

JIT accused of tapping phones of witnesses |
2017-06-17 |
![]() "The reliance and reference to ’technical analysis’ is indeed an admission by JIT of phone tapping and monitoring of witnesses, a violation of the law and the Constitution," said the PM House in its rejoinder to the JIT application in which it had accused some government institutions of creating impediments in its work and tampering with relevant documents. The PM House’s rejection of allegations is part of Attorney General Ashtar Ausaf’s four-page rejoinder to the JIT application, submitted to the Supreme Court on Friday. A three-judge SC bench headed by Justice Ejaz Afzal Khan had asked the AG to submit his reply to the application. The PM House denied the allegations. No, no! Certainly not! that it tutored witnesses and persons who were being summoned by the JIT -- constituted under the April 20 Supreme Court judgement to probe allegations stemming from Panama Papers leaks. In its application, the JIT had alleged that witnesses were being tutored at the behest of the Sharif family and confidential letters were being leaked by misusing the PM House. The chief executive officer of the Ittefaq Group -- a close associate of the prime minister -- directed Tariq Shafi, the cousin of Nawaz Sharif ... served two non-consecutive terms as prime minister, heads the Pakistain Moslem League (Nawaz). Noted for his spectacular corruption, the 1998 Pak nuclear test, border war with India, and for being tossed by General Musharraf... , to come to the Prime Minister House prior to appearing before the JIT, it alleged. In its denial, the PM House said, if needed, the persons being named were willing to file rejoinders. Similarly, it denied that the PM House had leaked summons issued by the JIT and said the summons might have been leaked by the team itself or the JIT staff. Nevertheless, it said, such summons were matter of public knowledge and their leak did not in any manner hamper investigations as alleged. The AG’s reply also contained the rejoinder of the Intelligence Bureau (IB) which denied hacking the Facebook account of a JIT member, Bilal Rasool, or his family members or any other member of the team. "Low-downs on members of JIT was done under the standard operating procedures," it said and also denied the allegations. No, no! Certainly not! that IB field staff were found loitering outside the residence of Mr Rasool on May 24. |

Ownership of London flats yet to be established: SC |
2017-01-21 |
[NATION.PK] The Supreme Court observed today that it was yet to be established whether the Sharifs owned their London properties before 2006. JI lawyer who began his submission Friday said that Sharif family’s assets grew manifold in the reign of Pakistain Moslem League-Nawaz (PML-N). The court asked: "Is there any rule that prohibits PM from having own business? If not, then why you are dragging the court on just assumptions". The counsel replied that there is no such law. Justice Khosa, who is heading a five-judge larger bench of the apex court in Panamagate case, told Jamaat-e-Islami ... The Islamic Society, founded in 1941 in Lahore by Maulana Sayyid Abul Ala Maududi, aka The Great Apostosizer. The Jamaat opposed the independence of Bangladesh but has operated an independentbranch there since 1975. It maintains close ties with international Mohammedan groups such as the Moslem Brotherhood. the Taliban, and al-Qaeda. The Jamaat's objectives are the establishment of a pure Islamic state, governed by Sharia law. It is distinguished by its xenophobia, and its opposition to Westernization, capitalism, socialism, secularism, and liberalist social mores... counsel Taufiq Asif that unless the conflict of interest was established mere allegations of the premier’s involvement in business would not take the petitioner anywhere. Justice Ijazul Ahsan asked the JI counsel whether there was any code of conduct prohibiting the prime minister from partaking in business activities while remaining in office. The JI counsel insisted that the premier's speech in the national assembly be considered a confessional statement. "The prime minister's speech should be taken to be a confession. There is no other way," he asserted. Justice Ijaz remarked that explanations on personal allegations against the premier could be demanded at the National Assembly. When the counsel referred to the Zafar Ali Shah case judgment, Justice Ejaz Afzal Khan observed that this was a submission by the AGP that could not be used against the Sharifs. Another judge. Justice Azmat Saeed Sheikh told the JI counsel that they can not deliver a verdict on the basis of assumptions. |

Kohistan video girls may be dead, probe body tells SC |
2016-12-03 |
And here it is, only six years later.![]() ...a backwoods district of Khyber Pakhtunkhwa distinguished by being even more rustic than is the norm among the local Pashtuns.... , Shoaib Khan, expressed fears that the five girls involved in a 2010 video scandal might not be alive. No! Re-e-e-e-ally? "The view taken and expressed... is the outcome of human observations, not free from error, maybe right or wrong, and can lead to an inference that either the girls are not alive or they have fled away and gone into missing being well aware of [the] consequences of traditional approach of their elders in such cases," the report said. That was a pretty mush-mouthed statement, though my opinion is the outcome of human observations, not free from error, maybe right or wrong, yadda yadda and yadda. The girls in question were Ms Amina, daughter of Sarfaraz, Ms Begum Jan d/o Mubeen, Ms Siran Jan d/o Saeer, Ms Bazeega, wife of Idrees, and Ms Shaheen w/o Habibullah. May they rest in peace, especially since they didn't go that way. On Nov 10, a two-judge Supreme Court bench headed by Justice Ejaz Afzal Khan had ordered the district and sessions judge to visit Sartay, Pallas -- a village in Kohistan district -- along with the local district coppers and a senior woman police officer to find out if the girls were still alive. No doubt some girls were produced, probably not the girls they were claimed to be. The directions had been issued by the court on an application filed by Dr Farzana Bari, a human rights One man's rights are another man's existential threat. activist and director of the gender studies department of Quaid-e-Azam University. Actually the idea of Islamic gender studies sounds pretty frightening. Dr Bari was part of a three-member commission that had visited Kohistan back in 2012 to probe into the allegations of murder of the girls shown clapping in a video clip. Having fun, were they? No wonder they were killed. The brazen hussies dropped their veils, too! In her fresh statement, Dr Bari had sought a direction for production of the girls before the court in-camera and for verification of their identity by experts. "Oh, sorry, judge! Can't do it. They seem to have stepped out for a moment!" The report submitted to the court said that any definite answers about the girls being alive required an exhaustive inquiry to be carried out by government agencies and through forensic means. "Forensic" would seem to imply DNA testing or something, which if you recalled was pronounced by the Council of Islamic Ideology of Pakistain not to be definitive evidence of rape. The commission, however, regretted that two of the girls produced before its members were not the girls allegedly visible in the video clip. "That one seems to have gained quite a bit of weight in the past six years. That one's eye color has changed." "It would not be unsafe to conclude and presume that other girls produced before us were also not [the] girls visible in the video scandal," the report said. "Okay, judge. We'll send some more. You see the ones you're looking for, let us know!" "Now the question arises, whether owing to their non-production before us, would it be safe to hold them dead? That's a pretty good bet. Keeping in view the history of the case, failure of the elders in producing the actual girls, especially Siran Jan and Bazeega, before us, the reply [to] the query would be certainly in positive [sic]. Meaning the judge thinks they've been murdered, too. But contrary to this conclusion, all the elders of the area were unanimous that the girls were alive," the report added. "Oh, yeah, sure. Trust us on that! It's not like we'd have the little darlings bumped off!" The report said the National Database and Registration Authority (Nadra) was contacted for furnishing family trees of the girls’ fathers. Luckily, it was discovered that Siran Jan and Bazeega got their identity cards issued in 2010 when the incident happened. Fingerprints and photos shouldn't be considered proper Islamic evidence, either. The commission tried to convince the local elders to allow the girls to be photographed but they did not agree on the pretext that the girls had already "faced defamation" and any fresh pictures could create more problems for them. "We're only looking out for them, y'understand, judge?" "Keeping in view the sensitivity of the people, overall atmosphere and gravity of the situation, it was not deemed suitable to insist on requirement of pictures," the report said. "Mahmoud, all those guys over there have knives! Put your camera away! Quick!" The commission said that one of the girls, Amina, was asked about burn marks on her thumbs. She replied that she had been injured while doing some kitchen work. "[T]his does not appeal to reason because [of] burning of two thumbs at a time without any damage to the index or other fingers...," the report said. Now, would a proper Moslem scorch the thumbs of a maiden of tender years? Does that sound like the sort of thing a devout fellow with a turban would do? Another girl, Siran Jan, and her father were unable to tell her age. "By appearance she was not more than 16/17 years and in the year 2010 she must be 9/10 years. On the contrary, as per Nadra record her date of birth was Feb 2, 1993 -- contradictory to her appearance. Video snap of this girl was not clear therefore cannot be compared with her photo. "But she don't look 23!" "She just don't look her her age!" "However, a hangover is the wrath of grapes... the third girl, Begum Jan, resembled the video picture but she too was looking about 16/17 years [old] with no mole marks on her upper lip as appearing in her photo shoot. When asked about the mark, she said it was made with [the help of] antimony/kajal," said the report. "And how'd you change your shoe size?" "The fourth girl, Bazeega, also resembled the photo and her apparent age was also compatible with her age as appearing in the photo. "Got a pretty good fit on that one!" "The last girl, Shaheen, and alleged controller of the video, disclosed her age as 13 years but her elders said it was 16 years." "Don't listen to her, judge! She can't count higher'n two when she's wearin' mittens!" The report said that despite clear directions, the husbands of the girls, except for Shaheen’s, were not produced before the commission. "[About] their absence, elders of the girls advanced lame excuses, except for the husband of Siran Jan, who is reportedly in jail." "For what?" "Um... Murder." The commission noted that after marriage, girls routinely went through a number of changes but its members noticed no such effects on the girls’ faces. You mean they still look like they did six years ago? |

Candidate threatens self-immolation |
2015-04-26 |
[DAWN] RAWALPINDI: An independent candidate for the cantonment board elections has threatened self-immolation after he was not allotted an election symbol of his choice. Mohammad Afzal Khan was associated with the PPP but decided to contest the elections as an independent candidate from Ward 3, Namak Mandi. He plunged into distress after his appeal for the election symbol of "zebra" was dismissed and he was allotted "tubelight". Khan had filed a petition with a local court for the allocation of "zebra" as the election symbol and launched his election campaign. However, those who apply themselves too closely to little things often become incapable of great things... the court directed him to approach the Election Commission of Pakistain (ECP) which has already decided not to allot "zebra" as an election symbol to anyone because of its similarity with "lion", the symbol of the ruling PML-N. When the candidate approached the ECP, he was allotted the symbol of "tubelight". After the decision of the commission, Khan reportedly started sending text massages to his supporters that he would kill himself within the next 24 hours. Sources said the local police and the administration had been intimated about the text messages being sent by the candidate. Despite repeated attempts, Khan could not be contacted as his mobile phone remained switched off. |
