Danish court rejects NGO appeal to ban weapons sales to Israel

[HodhodYemenNews] Denmark’s Eastern High Court on Friday rejected a lawsuit filed by several NGOs seeking to halt military exports to Israel, despite ongoing genocide in Gaza, reported Al Jazeera. The case focused on the role of Danish authorities in approving arms sales amid Israel’s genocide.

The court ruled that the organizations had no legal standing in the case. It claimed that they lacked a direct connection to the matter. Activists expect to appeal the decision to Denmark’s Supreme Court.

The lawsuit was filed in 2024 by four NGOs, including Amnesty International Denmark and the Palestinian rights group Al-Haq. They accused Denmark of violating international law by exporting military technology and F-35 jet components to Israel.

The rights groups warned that Danish-made parts could be used in attacks on Gaza civilians. They sued the foreign ministry and police, who are responsible for export licenses and policy decisions.
The Times of Israel adds:
The Palestinian human rights association Al-Haq, Amnesty International, Oxfam, and Action Aid Denmark filed the lawsuit against the Danish Foreign Ministry and national police last year.

US deems Israel not in violation of law on Gaza aid, despite only partially meeting demands

[IsraelTimes] US State Department spokesperson Vedant Patel appears to confirm a report that Joe Biden’s administration will not, for now, withhold weapons shipments to Israel, amid today’s deadline it put in place for Jerusalem to take a series of steps to improve the humanitarian crisis in Gaza.

Patel acknowledges during a press briefing that Israel addressed some, but not all, of the measures demanded by the US in the letter, which gave Jerusalem 30 days to improve the humanitarian crisis or risk being deemed out of compliance with US law that bars offensive weapons from being transferred to countries that block aid from reaching civilians.

Nonetheless, he states that the US has not, at this time, “made an assessment that the Israelis are in violation of US law.”

Patel points to steps taken by Israel over the past 30 days, including the reopening of the Erez Crossing into northern Gaza, the opening of the Kissufim Crossing into central Gaza, the waiving of certain customs requirements for aid organizations, the opening of new aid delivery routes within Gaza, the resumption of aid delivery to northern Gaza after a near-monthlong siege, the inland expansion of the coastal Mawasi humanitarian zone, and the institution of periodic humanitarian pauses.

The State Department spokesperson stresses that the US will continue monitoring Israel’s compliance with US law and will act accordingly if it deems that Jerusalem has failed to do so.

The US said it wanted to see 350 trucks enter Gaza every day. The average number of aid trucks that entered Gaza in October was 37, and Patel admits that only 404 trucks crossed into Gaza between November 1 and November 9.

Almost 40% Of World Bank's Recent Climate Funds Unaccounted For: Oxfam Audit

[Barrons] Close to 40 percent of World Bank climate financing over the past seven years is currently unaccounted for, Oxfam said in a new report published Wednesday, blaming poor record-keeping.

An Oxfam audit of the development lender's climate finance portfolio between 2017 and 2023 found that as much as $41 billion in climate finance could not be found "between the time projects were approved and when they closed."

"The Bank is quick to brag about its climate finance billions — but these numbers are based on what it plans to spend, not on what it actually spends once a project gets rolling," Kate Donald, the head of Oxfam's Washington office, said in a statement.

The World Bank has looked to boost its climate financing commitment under new president Ajay Banga, who took over last year on a pledge to reform the 80-year-old Washington-based institution.

The Houthis have kidnapped, arbitrarily detained and tortured hundreds of civilians, including UN and NGO workers, since the start of Yemen’s civil war in 2014, according to rights groups.

In June, the Houthis detained 13 UN personnel, including six employees of the Human Rights Office, and more than 50 NGO staff plus an embassy staff member.

The Houthis claimed they had arrested "an American-Israeli spy network" operating under the cover of humanitarian organizations — allegations emphatically rejected by the UN Human Rights Office.

Two other UN human rights staff had already been detained since November 2021 and August 2023 respectively. They are all being held incommunicado.

Dutch court: Government not violating weapon exports ban to Israel by supplying US

The Hague District Court ruled that Oxfam Novib, Pax Nederland and The Rights Forum had not shown any evidence that the Dutch government was ignoring the earlier ruling.

In February, an appeals court told the Dutch government to halt the export of F-35 fighter jet parts to Israel, citing a clear risk of violations of international law if they are used in strikes on Gazoo

. The Dutch government appealed that ruling to the Supreme Court, but said it was abiding by the order in the meantime by halting direct exports to Israel.

The aid groups went back to court last month, arguing the country was evading the ban by sending the parts to the US, which was then sending them on to Israel. They demanded a fine for the alleged breach.

The groups are "giving too broad an interpretation" to the earlier judgment, the court wrote in Friday’s ruling.

The organizations said they disagreed with the decision and were considering further legal action. "It is unacceptable that the Netherlands remains knowingly complicit in violations of the laws of war by Israel in Gaza," they said in a joint statement.

During a hearing in June, the Dutch government said it was unable to track the parts after they left the Netherlands and warned against placing further restrictions. Reimer Veldhuis, a lawyer representing the government, cautioned that seeking to prevent more exports of F-35 parts to nations other than Israel could put at risk supplies to militaries around the world who operate the advanced fighter jets at a time of soaring international tensions.

The Netherlands is home to one of three F-35 European regional warehouses.

The Dutch Supreme Court will take up the larger case in September.

UN, aid agencies say transfer of goods from pier to Gazans remains suspended due to perception Israeli military used area during last week’s hostage rescue.

"Humanitarian aid must not be used and must not be perceived as taking any side in a conflict," Haq said. "The safety of our humanitarian workers depends on all sides and the communities on the ground trusting their impartiality."

Rumors have swirled on social media, deepening the danger to aid workers, humanitarian groups say.

"Whether or not we’ve seen the pier used for military purposes is almost irrelevant. Because the perception of people in Gaza, civilians and gangs, is that humanitarian aid has been instrumentalized" by parties in the conflict, said Suze van Meegen, head of operations in Gaza for the Norwegian Refugee Council.

Oxfam International and some other aid organizations said they are waiting for answers from the US government because it’s responsible for the agreements with the UN and other humanitarian groups on how the pier and aid deliveries function.

Questions include whether the Israeli helicopters and security forces used what the US had promised aid groups would be a no-go area for the Israeli military around the pier, said Scott Paul, an associate director at Oxfam.

says the bloodiest-ever Gaza war had left nearly 200 aid workers dead even before the Monday night attack, including more than 175 members of the UN’s staff.

The WCK stressed that its staff had come under attack "despite coordinating movements" with the IDF and traveling in a de-conflicted zone in two armored cars branded with the WCK logo and another vehicle.

Israel described the deadly strike as unintentional and apologized for the deadly strike, while vowing to probe the incident, at a time of an outpouring of anger from governments around the world.

But the UN and others say the way Israel has conducted the war puts relief providers and other civilians at grave risk.

"Israel has now killed more aid workers in Gaza than all other armies, militias, and holy warriors in all other wars combined," said Jan Egeland who heads the Norwegian Refugee Council.

"I deeply hope that this terrible attack will act as some kind of watershed moment, and lead to a change in approach," he said, reiterating calls for a sustained ceasefire.

Bushra Khalidi, Oxfam’s policy adviser for the Paleostinian territories, said staff have been "terrified" and tried to minimize their movements.

"There’s been a deliberate and systematic assault on humanitarian aid efforts, including humanitarian aid workers," she said. "We’ve seen a systematic disregard for the de-confliction system."

’DEEP CRISIS’
Benjamin Gaudin, who leads the Middle East operations of Premiere Urgence Internationale, a La Belle France-based NGO, said his organization had no immediate plans to pull out, even though it was "very difficult" to continue to work in Gaza.

"This attack is catastrophic, not only for the World Central Kitchen, but also for the entire humanitarian community," said Gaudin.

Like other relief groups, Gaudin’s NGO has been seeking to closely coordinate their movements with Israel through a special "platform," but pointed to communications problems.

"So far it hasn’t guaranteed the safety of the organizations, because many incidents have occurred, despite this system being put in place," he said.

Egeland said the notification and coordination system with the IDF was "in deep crisis" and had to be rebooted.

The deadly attack "either shows that Israel has no control over its forces — that indiscriminately attack in Gaza — or that it has never communicated with its armed operations the notifications that it had promised to communicate," he said. "Both would be unforgivable."

Camilla Dogliotti of Handicap International, whose office in Gaza City was destroyed in a bombing strike in late January, said "the level of risk is very high in some southern and central areas of Gaza and unacceptable in all other areas."

"This new attack is first and foremost the consequence of Israel’s continued disrespect of international humanitarian law and of the required protection of civilians, including aid workers, during conflict," she charged.

’UNPRECEDENTED DANGER’
Prime Minister Benjamin Netanyahu said Tuesday that the military had "unintentionally" killed the aid workers, calling it a "tragic case" that would be investigated "right to the end."

IDF Chief of Staff Herzi Halevi apologized for the incident on Tuesday: "It was a mistake that followed a misidentification, at night, during a war, in very complex conditions. It shouldn’t have happened," Halevi clarified, adding that there was no "intention of harming WCK aid workers."

of a ship from Cyprus bringing almost 200 tons of food in what will be the first humanitarian aid delivery by sea, as the EU humanitarian chief warned there are already pockets of famine in the Strip.

The charity ship Open Arms set sail on Tuesday out of Larnaca port, towing a barge containing a load of flour, rice, and protein from the World Central Kitchen (WCK) organization, funded by the United Arab Emirates and Cyprus.

The IDF said the aid delivery was being "carried out in coordination with Israeli security and civilian authorities, in accordance with the directive of the government of Israel and at the request of the US government."

The ship was to be inspected by the Israeli Navy at sea once it gets to around 20 nautical miles from the Gaza coast, according to information seen by The Times of Israel. From there, the aid ship will be escorted by the Navy and Air Force toward Gaza’s coast. At a certain stage, an Israeli vessel will tow the aid to a makeshift temporary pier built by the IDF in the central Gaza Strip.
If Israel has already built a pier, why is the American one trumpeted by President Biden in his State of the Union address needed?
The distribution of the aid itself will not be carried out by the IDF. An Israeli official previously told The Times of Israel that the WCK was responsible for getting the food to Gazook civilians.

At the coast, the IDF will secure the aid at a distance from the air and sea, similar to how it has secured convoys on the ground.

a second ship with a larger cargo of food aid to Gaza was being loaded in Cyprus on Thursday, WCK said.

The charity said it was loading a vessel at Larnaca port with 300 tons of food aid — including legumes, canned tuna, vegetables, rice and flour.

"Our pallets should be screened and loaded by the end of the day Cyprus time," the WCK said in a statement. It did not say when that vessel would set sail.

The IDF is also carrying out trials of delivering aid directly to northern Gaza using a new military road,

The expected arrival of the ships comes amid a spiraling humanitarian crisis in Gaza.

The EU’s humanitarian aid and crisis management chief Janez Lenarcic said Thursday that there were already pockets of famine in the enclave, and warned it could spread to the whole region. Speaking to journalists, he urged Israel to open more ground routes to deliver aid to Gaza.
”In fact,” he added, “best would be for Israel to knock down the entire security wall surrounding Gaza — except Egypt’s section, of course — and let everyone go in and out unmolested, no matter their intentions or the explosives tucked into their back pockets.”
Lenarcic’s comments came a day after 25 organizations, including Amnesia Amnesty International and Oxfam, said airdrops and efforts to open a maritime corridor were "no alternative" to land deliveries because they could only provide a fraction of the aid needed.
The goal here, clearly, is to deliver a lifestyle to the Gazans on par with the nicer neighbourhoods of Paris, London, and Rome, at no cost to to the inhabitants.

Also in central Gaza, the IDF said the Nahal Brigade killed several Hamas button men over the past day, including by calling in airstrikes and through tank shelling.

In southern Gaza, the 98th Division continued to battle Hamas in the Khan Younis area.

The IDF said the Givati Brigade raided buildings in Khan Younis’s Hamad Town residential complex, locating a rocket launcher in one of them. Givati troops also called in an airstrike on two Hamas operatives spotted in their area, the IDF said.

In the Bani Suheila area, the 7th Armored Brigade spotted and called in tank shelling against three operatives that were approaching them, and also called in an airstrike on two operatives near a Hamas weapons depot, the IDF said.

"The WFP is deeply saddened that a dedicated staff member was killed in Yemen today (Friday) by unknown button men," a spokesperson for the WFP said in a press statement.

"We cannot comment further at this time," he added.

Gunmen in the city of al-Turbah, which is under the control of the Saudi-led coalition forces, assassinated the Jordanian WFP employee, Moayyad Saeed ‎Hameidi, who works as head of the program, with six bullets that led to his death instantly.

The coalition-controlled areas in Taiz province are witnessing major insecurity, and almost daily liquidations, in addition to armed festivities between the UAE-backed factions on the one hand, and the Saudi-backed "Islah Party" militias on the other.

Yemeni police arrest 2 suspects in killing of senior World Food Program official

[AlAhram] Yemeni police on Saturday arrested two suspects in the killing of a senior World Food Program official the previous day, authorities said.

Ten others were also detained for their alleged involvement in the killing of Moayad Hameidi, who had recently arrived in the country to take the post of the head of the World Food Program in the southwestern province of Taiz.

Taiz police did not provide further details.

On Friday, two button men riding on a cycle of violence shot Hameidi in the town of Turbah. He died shortly after reaching a hospital. The attackers expeditiously departed at a goodly pace.

Hameidi, a Jordanian, was the latest aid worker to be killed in Yemen, which has been embroiled in a civil war since 2014. He had just arrived in Taiz a few days ago to assume his role as head of the WFP office in the province.
