Supreme Court orders school on Jamia Hafsa site

The Supreme Court (SC) on Tuesday told the government to build an educational institution on the site of the demolished Jamia Hafsa, and questioned as to why the government had tolerated a madrassa built on encroached land for years.

A four-member bench of the SC comprising Justice Javed Iqbal, Justice Fakir Muhammad Khokhar, Justice Mian Shakirullah Jan and Justice M Javed Buttar heard the suo motu case of the Lal Masjid and Jamia Hafsa operation.

Interior Secretary Syed Kamal, Islamabad Deputy Commissioner Chaudhry Muhammad Ali, and the Interior Ministry’s National Crisis Management Cell Director General Brigadier (r) Javed Iqbal Cheema appeared in court. “Why did the Capital Development Authority (CDA) turn a blind eye [to the madrassa] despite having a huge army of employees?” asked Justice Javed Iqbal in response to the arguments of respondents, who contended that a sizable portion of the madrassa was built on encroached state land.

The court told the authorities to address the grievances of the families of those killed in the operation. The Interior Ministry was also directed to speed up the process of DNA testing to identify the dead.

Kamal told the court that all those arrested during the Lal Masjid operation had been released except for head cleric Maulana Abdul Aziz and his daughter Tayyaba Dua. He also told the court that Dua would be released as well. He said 42 bodies had so far been identified by DNA testing and 20 remained.

People captured during operation against Lal Masjid: SC orders release of those not involved in serious crimes

The Supreme Court (SC) on Friday directed the government to release on bail the people arrested during the Lal Masjid operation except those involved in serious crimes, submit a detailed report on the total deaths and injuries, and provide treatment to Maulana Abdul Aziz’s wife Umme Hasaan.

A two-member SC bench consisting of Justice Muhammad Nawaz Abbasi and Justice Faqir Muhammad Khokhar ordered Islamabad Deputy Commissioner Chaudhry Muhammad Ali to ensure the early release on bail of all the persons under Section 188 and immediately lift the curfew in Sector G-6. The bench rejected the preliminary report of the administration regarding the total number of the dead and injured people, as it did not carry the names of the persons.

Deputy Attorney General (DAG) Tariq Khokhar told the court that 102 people including 91 civilians, 10 commandoes and one Rangers official died in the operation. He said that of 629 males arrested during the operation, 386 had been released. He said that 241 men were in the judicial custody, while two others were on physical remand. He said that three women – Umme Hasaan and her daughters Tayyaba and Asma – were detained under Section 224 of the Criminal Procedure Code. The court also ordered medical treatment for Umme Hasaan on her lawyer’s request.

No operation against them, Lal Masjid clerics told

The district administration on Thursday assured the Lal Masjid clerics that the government was not planning any action against them, Daily Times has learnt. Chief cleric Maulana Abdul Aziz and his deputy Abdur Rashid Ghazi were anticipating police action after madrassa students raided a massage parlour in F-8/3 and kidnapped seven Chinese nationals, including six women, and three Pakistanis.

The cleric brothers had threatened to declare jihad against the federal government after a heavy contingent of Rangers was deployed at Aabpara Community Centre on Thursday evening. “Deputy Commissioner Chaudhry Muhammad Ali and Assistant Commissioner Farasat Ali Khan have assured me over the phone that the government is not planning any action against us,” Ghazi told Daily Times.

Lal Masjid mullah threatens more abductions
Lal Masjid students on Thursday threatened more abductions if ‘illegal’ and ‘un-Islamic’ activities continued in Islamabad, Dawn News reported. The channel said Lal Masjid clerics threatened to kidnap Pakistanis and foreigners shrugging off the presence of rangers and police contingents outside the mosque. The channel reported Ghazi Abdur Rasheed of Lal Masjid as denying that the madrassa administration had declared suicide attacks legal. “Only in case of attack, we will defend ourselves, and suicide attacks can be the last option in self-defence,” he added.

Rasheed said the weapons the madrassa students had were licensed, but refused to disclose the number of weapons, the channel said. He said the Lal Masjid administration did not support the MMA ideology, as the party had brought no change in NWFP. “We do not want a Taliban-style government, but we are against the present system and want an Islamic welfare system in Pakistan,” the channel quoted him as saying.

Lal Masjid cleric agrees to resume negotiations

The Lal Masjid administration on Tuesday withdrew its decision to suspend talks with the government and announced that they had resumed negotiations to try and find a peaceful end to the standoff in the capital.

Lal Masjid chief cleric Maulana Abdul Aziz on Monday announced the suspension of the talks after two army helicopters flew over the mosque and adjacent Jamia Hafsa madrassa, took pictures of unveiled girl students and sprayed a gas on them that caused suffocation. He saw the incident as a prelude to a crackdown on the mosque and its two madrassas.

However, Abdul Rashid Ghazi, Aziz’s brother and deputy, told Daily Times on Tuesday: “We hope the talks will move forward in the right direction. I request Chaudhry Shujaat to institute an inquiry into the helicopter surveillance flights and spray of chemical gas on Jamia Hafsa.”

After the announcement that talks were back on, a committee, comprising clerics Maulana Nazir Faroqee and Maulana Zahoor Alvi chosen by Ghazi, along with Islamabad Deputy Commissioner Chaudhry Muhammad Ali, Capital Development Authority (CDA) Member (Planning) Nusratullah, Auqaf Department Deputy Director Malik Afsar and a representative of PML President Chaudhry Shujaat Hussain, visited the demolished Al-Safa Mosque in I-8 and met with the prayer leader of the mosque.

350 Opp activists held in Rawalpindi, Islamabad

Some 350 opposition activists were arrested from the twin cities on Tuesday, before the Supreme Judicial Council (SJC) resumes the hearing of the presidential reference against Chief Justice Iftikhar Muhammad Chaudhry today (Wednesday). Opposition parties said they would go ahead with plans to stage peaceful rallies across the country, including outside the Supreme Court (SC) building in Islamabad, while the government warned of stern action if the protestors disturbed law and order.

On Tuesday, police arrested at least 270 opposition activists, mostly of the PML-Nawaz and Muttahida Majlis-e-Amal, in Rawalpindi to thwart their protest plans. Hanif Abbasi, MMA MNA from Rawalpindi, has reportedly gone into hiding.

Islamabad police arrested around 80 activists of the Jamaat-e-Islami (JI) including Mian Muhammad Aslam, an MNA from Islamabad. The JI workers were shifted to Jhelum and Aslam to a rest house near Simly Dam.

Opposition leaders said the protests would go ahead despite the arrests. “The PPP will rally from its central secretariat despite the fact that hundreds of our workers have been arrested in Rawalpindi,” PPP MNAs Nayar Hussain Bukhari and Ghulam Murtaza Satti told a press conference in Islamabad.

“The government is hunting for our workers and we have asked them to go underground,” PML-N Information Secretary Ahsan Iqbal told Daily Times.

MMA Secretary General Liaquat Baloch said that thousands from his party would take part in the demonstration on Constitution Avenue, led by Qazi Hussain Ahmad.

Meanwhile, the administrations of Rawalpindi and Islamabad finalised security arrangements and deployed more than 3,000 security personnel in the twin cities.

Four walkthrough gates have been installed on Constitution Avenue for people proceeding to the SC. The district administration has banned the entry into Islamabad of private vehicles carrying loudspeakers.

Islamabad Deputy Commissioner Chaudhry Muhammad Ali said that activist carrying party flags would be denied entry into the SC building and trespassers would be arrested. And the government warned that any violence outside the SC would be dealt with “with an iron hand”. In view of possible violence, the district administration announced a local holiday for schools and colleges today.

Meanwhile in Karachi, the Sindh High Court issued an order to the entire legal fraternity to observe a full-day strike to protest against the presidential reference against the chief justice. “The SHC has issued orders to all the lawyers registered with it as well as the Karachi Bar Association to conduct a complete strike on Wednesday,” Advocate Taeeba said. Protesting lawyers will march towards Chief Minister’s House.

No deadline for action against Jamia Hafsa

The Islamabad district administration on Monday met with Interior Secretary Syed Kamal Shah to draw a strategy for the much-awaited crackdown on the administration and students of Jamia Hafsa and Jamia Fareedia but no date was set for the action.
That means it'll never happen.

In view of unconfirmed reports about the presence of a large cache of arms in Jamia Hafsa and Lal Masjid the interior secretary asked the Islamabad administration to find out how many boys of Jamia Fareedia were present in Lal Masjid.
Rao Mohammad Iqbal attended the meeting. Officials said the interior secretary asked the city administration to force the Jamia Hafsa girls out of the children’s library, which they have occupied since January 27. He also sought the arrest of students of both Jamia Hafsa and Jamia Fareedia for creating a law and order situation in the capital. But officials said that in view of unconfirmed reports about the presence of a large cache of arms in Jamia Hafsa and Lal Masjid the interior secretary also asked the Islamabad administration to find out how many boys of Jamia Fareedia were present in Lal Masjid. The secretary also directed that the Rangers and Punjab Police personnel who have came to Islamabad for the crackdown some two months ago be put on high alert.

MMA lawmaker and 14 activists released

The administration of the federal capital on Friday released 15 activists of the Muttahida Majlis-e-Amal (MMA), including National Assembly Member Mian Muhammad Aslam. Police arrested these activists from various parts of the city under Section 3 of the Maintenance of Public Order on March 16 when they were trying to reach the Supreme Court building to express solidarity with suspended Chief Justice Iftikhar Muhammad Chaudhry.

The administration held an emergency meeting on Friday, with Islamabad Chief Commissioner Khalid Pervez in the chair. The meeting, which was also attended by Police Inspector General Chaudhry Iftikhar Ahmed, Deputy Commissioner Chaudhry Muhammad Ali and other high-ranking officials, decided that extra police would be deployed in various markets of the city to stop those who would force shopkeepers to close their shops on March 26, sources told Daily Times. It also decided that police and Rangers would be deployed at key places in the city to maintain law and order.

However, the district administration of Rawalpindi hasn’t yet released MNA Muhammad Hanif Abbasi and 150 other activists of the MMA and Pakistan Muslim League-Nawaz. The administration reportedly fears that these people might create problems during a strike called by the Alliance for the Restoration of Democracy on March 26 to protest against Mr Chaudhry’s suspension. However, the people belonging to other political parties, who were arrested on March 21, have been released.
