Hafiz Saeed sentenced to five-and-a-half years in prison for terror financing | |

[DAWN] A Lahore anti-terrorism court convicted Jamatud Dawa leader Hafiz Saeed![]() in two terror-financing cases on Wednesday. He was slapped with a prison sentence of five-and-a-half years and a fine of Rs15,000 in each case. The sentences of both cases will run concurrently. The court also granted him the benefit of Section 382-B of the Code of Criminal Procedure (reduction of period of sentence of imprisonment). Malik Zafar Iqbal, the secretary of al-Anfaal Trust, has also been convicted in the same cases and has been awarded similar punishment. They were convicted under the Anti-Terrorism Act Section 11-F(2) ‐ pertaining to membership, support and meetings relating to a proscribed organization ‐ and 11-N (punishment under Sections 11-H to 11-K). Section 11H relates to fundraising for the purpose of terrorism, 11-I is about the use and possession of money or other property for terrorism, 11-J relates to funding arrangements which result in money being made available for terrorism, while 11-K relates to money laundering.
The unprecedented ruling came ahead of a meeting of a world financial watchdog, Financial Action Task Force (FATF), next week to decide whether to blacklist Pakistan over a failure to curb terrorism financing. Amid pressure from the FATF to take action against Saeed's militant groups, Pakistan charged him in December with collecting funds for his organizations, which are listed as terrorist organizations by the United Nations. He pleaded not guilty. "Hafiz Saeed and another of his close aides have been sentenced in two cases of terrorism financing," prosecutor Abdul Rauf Watto told Reuters. Saeed has denied any involvement and says his network, which spans 300 seminaries and schools, hospitals, a publishing house and ambulance services, has no ties to militant groups. Saeed and his group's charities had entered into the country's politics under a plan backed by Pakistan army in a bid to integrate the militants in mainstream society. They contested the 2018 general election under a new name, Milli Muslim League (MML), but did not secure any seats. [DAWN] Jamatud Dawa chief Hafiz Muhammad Saeed and his seven aides have approached the Lahore High Court challenging a case carrying charge of terror financing lodged by the Counter Terrorism Department (CTD) by ’wrongly’ showing them as members of the proscribed Lashkar-e-Taiba![]() Army of the Pure,an Ahl-e-Hadith terror organization founded by Hafiz Saeed. LeT masquerades behind the Jamaat-ud-Dawa facade within Pakistain and periodically blows things up and kills people in India. Despite the fact that it is banned, always an interesting concept in Pakistain, the organization remains an blatant tool and perhaps an arm of the ISI... (LeT). In a joint petition filed through senior lawyer A.K Dogar, the JuD leaders submitted that the facts narrated in the impugned FIR lodged on July 1, 2019 illegally described them as members of the LeT and levelled unlawful allegation of terror financing. The counsel referred to a 2009 judgment by a full bench of the LHC against the detention of Hafiz Saeed...founder of Lashkar-e-Taiba and its false-mustache offshoot Jamaat-ud-Dawa. The United Nations declared the JuD a terrorist organization in 2008 and Hafiz Saeed a terrorist as its leader. Hafiz, JuD and LeT are wholly-owned subsidiaries of the Pak intel apparatus, so that amounted to squat... at that time and stated that the petitioners were not members of the LeT. He stated that the LHC through another judgment issued in 2003 had held that Saeed had left the leadership of LeT on Dec 24, 2001 while the organization was banned on Jan 14, 2002. The lawyer pleaded that the claim of the government that the petitioners were the members of the LeT stood disapproved in the light of the two judgments. Therefore, he asked the court to quash the impugned FIR lodged by the CTD for being unlawful and of no legal effect. The other petitioners include Muhammad Ayub Sheikh, Zafar Iqbal, Syed Luqman Ali Shah, Hafiz Abdul Rehman Makki, Abdul Salam, Abdul Ghaffar and Abdul Qudoos Shahid. Govt bans 10 more organisations for alleged affiliation with proscribed outfits |

[DAWN] The interior ministry on Saturday announced that it has placed 10 more organizations on the list of proscribed outfits. According to a blurb issued by the ministry, the action was taken in pursuance of the National Action Plan (NAP). The newest additions to the list of banned outfits are Al Anfal Trust (Lahore), Idara-e-Khidmat Khalaq (Lahore), Al Dawatul Irshad (Lahore), Al Hamd Trust (Lahore and Faisalabad ...formerly known as Lyallpur, the third largest metropolis in Pakistain, the second largest in Punjab after Lahore. It is named after some Arab because the Paks didn't have anybody notable of their own to name it after... ), Mosque and Welfare Trust (Lahore), Al Madinah Foundation (Lahore), Muaz bin Jabal Education Trust (Lahore), Al Eesar Foundation (Lahore), Al Rehmat Trust Organisation (Bahawalpur) and Al Furqan Trust (Bloody Karachi ...formerly the capital of Pakistain, now merely its most important port and financial center. It is among the largest cities in the world, with a population of 18 million, most of whom hate each other and many of whom are armed and dangerous... ). The entities were designated as proscribed organizations for their alleged affiliation with banned Jamatud Dawa (JuD), Falah-e-Insaniyat ...the current false nose and mustache of Jamaat ud-Dawa, which was the false nose and mustache of Lashkar e-Taiba... Foundation (FiF) and Jaish-e-Mohammad ...literally Army of Mohammad, a Pak-based Deobandi terror group founded by Maulana Masood Azhar in 2000, after he split with the Harkat-ul-Mujaheddin. [DAWN] The Lahore High Court on Thursday restrained the government from extending harassment to the social welfare organizations of Hafiz Muhammad Saeed and also allowed lawful activities of Jamatud Dawa (JuD) and Falah-e-Insaniat Foundation (FIF). Justice Aminuddin Khan was hearing a petition moved by Hafiz Saeed ![]() ...founder of Lashkar-e-Taiba and its false-mustache offshoot Jamaat-ud-Dawa. The United Nations declared the JuD a terrorist organization in 2008 and Hafiz Saeed a terrorist as its leader. Hafiz, JuD and LeT are wholly-owned subsidiaries of the Pak intel apparatus, so that amounted to squat... challenging a notification of ministry of interior with regard to freezing bank accounts and taking over assets associated with both organizations- JuD and FIF‐under the Anti-Terrorism (amendment) Ordinance 2018. The petitioner’s counsel, A.K Dogar, said the government of Pakistain acted against these organizations under the pressure of foreign powers, including United Nations ...an organization originally established to war on dictatorships which was promptly infiltrated by dictatorships and is now held in thrall to dictatorships... and India. He contended that Pakistain was a sovereign independent state and made its own laws to govern its citizens. He said if there was a conflict between the laws of the land and any provision of United Nations Security Council Act, 1948, the law of the land shall prevail, he added. He pointed out that the FIF owned 369 ambulances, had helped 72,000 persons through its charity hospitals and treated 600,000 patients only in 2017. He said the JuD dug out 2,000 wells for supplying water in Tharparkar, Balochistan...the Pak province bordering Kandahar and Uruzgun provinces in Afghanistan and Sistan Baluchistan in Iran. Its native Baloch propulation is being displaced by Pashtuns and Punjabis and they aren't happy about it... and Baltistan. The counsel asked the court to declare the impugned notification of the interior ministry null and void with regard to taking over the assets of the organizations. The judge restrained the government from harassing the petitioner’s organizations and sought reply from the interior ministry by April 23. |

[DAWN] Attorney-General for Pakistain Ashtar Ausaf Ali on Wednesday presented ’sensitive’ documents before a judge of the Lahore High Court in his chamber to defend detention of Jamatud Dawa (JuD) chief Hafiz Muhammad Saeed![]() ...who would be wearing a canvas jacket with very long sleeves anyplace but Pakistain... Earlier, the AGP told the judge that the documentary material relied upon by the federal government to detain Mr Saeed was sensitive in nature and would not be appropriate to present in open court. He sought permission from the court to produce the relevant material in chamber and also requested it not to place the same on record of the case. After Justice Syed Mazahar Ali Akbar Naqvi allowed the request the AGP shared the documents with the judge in his chamber where Advocate Dogar was also present. Prior to the chamber’s proceedings, an officer of ministry of interior told the court that the JuD chief were tossed into the calaboose in the light of reports and recommendations by intelligence agencies. The judge would resume hearing today (Thursday). Challenging the detention of Hafiz Saeed, Advocate Dogar had contended that the government detained his client on the basis of mere apprehensions and hearsay. He argued that an order of preventive detention had to satisfy the requirements laid down by the Supreme Court in its many judgments but in the instant case sheer violation of laws had been committed by the government. He said imprisonment without trial and conviction was prima facie unlawful and unconstitutional. A provincial review board had approved an application of the government seeking extension in the detention of Mr Saeed for another 30 days starting from Oct 25. However, it's easy to be generous with someone else's money... the board did not allow further detention of four other JuD leaders. |

The counsel argued that an order of preventive detention had to satisfy the requirements laid down by the Supreme Court in many of its judgments but in the instant case blatant violation of laws had been committed by the government. He said imprisonment without trial and conviction was prima facie unlawful and unconstitutional. Other petitioners include Abdullah Ubaid, Malik Zafar Iqbal, Abdul Rehman Abid and Qazi Kashif Hussain. The home department previously told the court that activities of JuD leaders, if released, would pose a serious threat to the public safety and cause breach of public order. Hafiz Saeed, 37 others seek removal from ECL |

[DAWN] Jamatud Dawa (JuD) chief Hafiz Muhammad Saeed![]() ...who would be wearing a canvas jacket with very long sleeves anyplace but Pakistain... and 37 others affiliated with the organization have asked the Ministry of Interior to remove their names from the Exit Control List (ECL). In a letter written to the ministry’s concerned department on behalf of JuD chief and others, Advocate A.K Dogar pleads that a memorandum issued on Jan 30, 2017 placing 38 individuals on the ECL should be withdrawn. The lawyer stated the JuD had never been involved in any terrorist activity in Pakistain and was never blamed for any incident of terrorism or destruction of property. He argued that the JuD was an organization dedicated to welfare of the citizens as it had established 142 schools and four varsities in the country. He said Falah-e-Insaniat Foundation (FIF) was a sufficient proof to this effect. Advocate Dogar contended that no material had ever been produced by the federal or provincial governments against founder of Lashkar-e-Taiba and its false-mustache offshoot Jamaat-ud-Dawa. The United Nations declared the JuD a terrorist organization in 2008 and Hafiz Saeed a terrorist as its leader. Hafiz, JuD and LeT are wholly-owned subsidiaries of the Pak intel apparatus. He referred to an observation made by a full bench of the Lahore High Court hearing a petition of Hafiz Saeed and others against their detention in 2009. The bench had observed: "In the present case the Government is not in possession of any evidence that the petitioners are risk to the security of Pakistain and merely on the basis of the UN Resolution their liberty cannot be curtailed." The United Nations declared the JuD a terrorist organization in 2008 and Hafiz Saeed a terrorist as its leader. Hafiz, JuD and LeT are wholly-owned subsidiaries of the Pak intel apparatus, so that amounted to squat... Justice Erum Sajjad Gull heard the petition of Advocate Sarfraz Hussain as objection case and upheld an objection put by the registrar office on its maintainability. The office had stated that the petitioner had not furnished the impugned notification of Saeed’s detention. During the hearing, Advocate A.K Dogar appeared before the court and stated that a separate petition would be filed soon on behalf of Hafiz Saeed challenging his detention. Advocate Hussain had contended that Hafiz Saeed was detained in the light of the United Nations ...an organization which on balance has done more bad than good, with the good not done well and the bad done thoroughly... ’ resolution of 2008. However, corruption finds a dozen alibis for its evil deeds... he said, the resolution of the UN Security Council passed in 1948 for holding a plebiscite in India-held Kashmire had not been implemented so far. The lawyer stated that the JuD chief were tossed into the calaboose for keeping the Kashmire issue alive and the move was liable to be declared void as there was no nexus with anti-terrorism laws, which had been manoeuvered by the government to curtail the liberty of a Pak citizen at the behest of a foreign mission. He asked the court to get the JuD chief recovered from the illegal and improper detention and set him at liberty in the interest of justice. The government had placed Hafiz Saeed and four other members of his organization under house arrest last week for a period of three months. |

Man who moved LHC against JuD ‘Shariah court’ kidnapped, harassed |

![]() "I was heading to the high court on my cycle of violence when two bearded men intercepted me near Samanabad’s first roundabout. One of them took control of the bike, while the other sat behind me before heading towards Miani Sahib graveyard," Khalid Saeed told this scribe in a weak voice, lying on a bed of Services Hospital’s emergency ward, with blood marks on his clothes. A ’Shariat Court’ established by Jamatud Dawa (JuD) had summoned Mr Saeed on the ’complaint’ of his former partner in a property business, alleging misappropriation of his investment. Saeed had filed a writ petition in the LHC against the summons issued to him by the JuD ’court’. The court had heard the petition and directed provincial home secretary to look into the matter and decide it strictly in accordance with law after hearing version of the petitioner. Mr Saeed filed an intra-court appeal against the order that was fixed for hearing before a division bench on Tuesday. However, denial ain't just a river in Egypt... his counsel Advocate Maqbool Sheikh sought a short adjournment from the bench due to the incident. Mr Saeed said the kidnappers forced him to drink a glass of juice before throwing him near the Ghazi Ilamuddin’s shrine in semi-conscious state. "I could only called a friend for help before passing out," Mr Saeed said, adding the duo kept threatening him of dire consequences if he did not withdraw the cases and reconcile the matter. He was later shifted to the Services Hospital where doctors treated him in emergency ward. "We have washed his (Saeed’s) stomach and sent the samples of the retrieved fluid to laboratory for a detailed examination," a doctor in the emergency ward said. Personnel from the police-post at the hospital visited the victim and reported the incident to cop shoppe concerned. Later a sub-inspector from Lyyton Road cop shoppe visited Saeed at the hospital and recorded his statement. He told the victim that the first information report (FIR) of the incident would be lodged after issuance of laboratory report of the sample. Lahore DIG (operations) Dr Haider Ashraf said he was not aware of the incident yet and sought time for his official response. Later calls made to his mobile phone remained unanswered. The Qazi (judge) of "Dar-ul-Qaza Sharia" established by the religious organization had summoned Mr Saeed to it’s headquarters at Chauburji to defend himself against the allegations leveled in the complaint. However, denial ain't just a river in Egypt... the property dealer never obeyed the ’order’ and instead approached the LHC for remedy. The organization had denied establishing any court, saying it offered arbitration only and resolved disputes in the light of Shariah. It argues that offering arbitration to disputing parties was not illegal. |

Sharia court dispenses ‘justice’ in Lahore |

[DAWN] In a manifestation of people’s growing distrust in conventional judicial system and mounting influence of religious organizations in society, Jamatud Dawa (JuD) has set up ’Darul Qaza Sharia’ in the provincial metropolis to dispense ’justice’ among people in light of Sharia laws, Dawn has learnt. A legal expert Dawn talked to said this is in sheer violation of the Constitution of Pakistain. However, it was a brave man who first ate an oyster... the organization claims it offers arbitration only and resolves disputes in light of Sharia. The JuD is not a proscribed organization and claims to render social welfare services besides running charitable schools and hospitals in calamity-hit cities of the country especially. Organisers say it’s arbitration only Sources say the organization’s ’Arbitration Court of Sharia’ has been taking up complaints of citizens approaching it for justice and summoning the ’defendants’ in person or through a legal counsel with warnings of strict action under the Sharia laws in case of no response. A copy of official JuD summons available with Dawn bears two monograms ‐ Darul Qaza Sharia, Jamatud Dawa Pakistain and Saalsi Sharai Adalat-e-Aalia (Arbitration Court of Sharia). The ’court’ has been established at the organization’s headquarters, Jamia Qadsia, Chauburji under a Qazi (judge) who is assisted by Khadmins (court associates) to decide the complaints. The complaints are addressed to the chief of the religious organization who later refers them to Qazi for further proceedings. Sources say complainants approach the ’arbitration court’ in the hope of swift solutions as litigation before conventional courts takes much time especially in civil cases. The organization’s front man Yahya Mujahid defends the functioning of the ’Sharia Court’ saying it is not a parallel system to the constitutional courts of the country. "It is an arbitration court, which decides disputes with the consent of the parties," he said. He states disputes have been resolved in accordance with Islamic laws and that offering arbitration to confronting parties is not illegal. The front man failed to justify issuance of summons carrying a warning of strict action in case of non-compliance, when mentioned that there can be no coercion on any of the disputing party in arbitration. In one such case regarding a monetary dispute between two property developers, the ’Sharia Court’ has been issuing summons to the defendant. However, it was a brave man who first ate an oyster... the defendant has not appeared before the Qazi so far. He has written letters to judicial and executive authorities, including chief justice of Pakistain and prime minister, complaining about the unconstitutional summons being issued to him by the religious organization. The letters are yet to be answered whereas the JuD front man offers no explanation to the practice of serving summons. Pakistain Bar Council member Azam Nazir Tarar says the Constitution does not allow any private organization to use the word "court". The word can be used for Supreme Court, Federal Shariat Court, high courts and all other courts established by a high court only. "This is parallel judicial system and against the law of the land," he maintained in a talk with Dawn. He says conventional courts of the country are working under Koran, Sunnah and Sharia laws. The Constitution of Pakistain bars any law against Koran and Sharia, Mr Tarar maintains. Deputy Inspector General (Operations) Dr Haider Ashraf denies any knowledge of the existence of ’Sharia Court’ or having received any complaint in this regard. He says police will take action if they received any complaint as the law did not allow any parallel judicial system. |

'Seminary teacher injured in IED blast, not JuD leader' |

[DAWN] PESHAWAR: Rubbishing circulating intelligence reports, Senior Superintendent Police Operations Abbas Majeed Marwat on Sunday denied that Qari Salahuddin, who was apparently targeted by an Improvised Explosive Device (IED) earlier today, is a leader of the Kashmire-based Jamatud Dawa. Salahuddin is an Afghan national who teaches at a local seminary, the SSP said, echoing DSP Khalid's earlier claim of the same. Earlier in the day, an IED had detonated near Salahuddin's vehicle, injuring him and his driver-cum-guard, Abdul Shakoor, and a passerby, Deputy Superintendent Police Khalid said. The remote-controlled bomb contained three kilograms of kaboom, Bomb Disposal Squad officials said. Television footage showed a badly damaged car at the site of the kaboom, which was cordoned off as an investigation was initiated into the attack. Intelligence sources had claimed the IED targeted Qari Salahuddin -- actually Syed Salahuddin -- a freedom fighter and leader of Kashmire-based Jamatud Dawa. |
