[CounterJihadReport] A Muslim legal group, girded with $1.8 million in grant money from George Soros’s Open Society Foundations (OSF), has helped influence major policy changes in the war on terror, including the Department of Homeland Security’s screening of individuals with suspected terror ties and the FBI’s training program for its agents working in counterterrorism. Internal records, made public by the hacking group DC Leaks, show OSF spent $40 million between 2008 and 2010 on programs aimed at weakening U.S. counterterrorism policy. Muslim Advocates’ Executive Director Farhana Khera played a key role in shaping the foundations’ spending. Khera co-authored a 2007 memo that “informed” the foundations’ U.S. Programs Board’s decision to create the National Security and Human Rights Campaign (NSHRC), a Sept. 14, 2010 OSF document discussing the program’s reauthorization, shows. Muslim Advocates was founded in 2005 as an offshoot of the National Association of Muslim Lawyers. It often criticizes U.S. counterterrorism strategies that use sting operations and informants as discriminatory.

[Al Arabiya Latest] A Muslim legal advocacy group in the United States is accusing federal agents at borders and airports of routinely selecting Muslim American travelers and those with ethnic backgrounds perceived as Muslim for searches and interrogations on the basis of race, religion and national origin without any "evidence or even suspicious wrongdoing." In a report issued in April Muslim Advocates, a non-profit group of the National Association of Muslim Lawyers (NAML) accused the Department of Homeland Security (DHS) and Customs & Border Protection (CBP) agents of privacy violations by carrying out "profound privacy intrusions" against law-abiding Muslim, Arab and South Asian Americans returning home from overseas travel without any cause. |

Muslims in Britain should be able to live under Sharia, says top judge |

![]() Lord Phillips of Worth Matravers, the Lord Chief Justice, strongly backed Rowan Williams, the Archbishop of Canterbury, over his suggestion earlier this year that aspects of Sharia law should be adopted in Britain. The archbishop's remarks sparked a national debate and led to calls for his resignation. Risking inflaming that controversy again, Lord Phillips has said that Muslims in Britain should be able to use Sharia to decide financial and marital disputes. So LP thinks that Muslims can use Sharia to trump British law? That is what they are saying. The judge did add that only the criminal courts should have the power to decide when a crime has been committed and when to impose punishment. And let Imams do their thing with respect to money, marriage, in effect, rights of the individual. But his suggestion that different religious groups should run their affairs according to different rules sparked warnings that community cohesion could be undermined. ![]() In a speech at the East London Muslim Centre in east London, Lord Phillips said it was 'not very radical' for Dr Williams to argue that Sharia law can be used to help govern issues like family disputes and the sale of financial products. Lord Phillips said: 'It is possible in this country for those who are entering into a contractual agreement to agree that the agreement shall be governed by law other than English law.' This is unbelievable, coming from a judicial muckity muck. Therefore, he said, he could see no reason why Sharia law should not be used to settle disputes in this country. He said: 'There is no reason why principles of Sharia law, or any other religious code, should not be the basis for mediation or other forms of alternative dispute resolution.' ![]() He added: 'It must be recognized however that any sanctions for a failure to comply with the agreed terms of the mediation would be drawn from the laws of England and Wales.' Fat chance of that happening. Sharia law suffered from 'widespread misunderstanding' in Britain, Lord Phillips said. 'Part of the misconception about Sharia law is the belief that Sharia is only about mandating sanctions such as flogging, stoning, the cutting off of hands or death for those fail to comply with the law,' he said. 'In some countries the courts interpret Sharia law as calling for severe physical punishment. There can be no question of such courts sitting in this country, or such sanctions being applied here.' The judge said Dr Williams had been misunderstood when it was reported in February that he said British Muslims could be governed by Sharia law. ![]() Volunteers, ya say? There is already scope in English law for some communities to use their own religious codes to resolve disputes. Orthodox Jews can use the Beth Din rabbinical courts to decide on matters including divorce. However some critics say that women marrying under Sharia law do not have the same rights as in English law, and could lead to them being treated as second class citizens as far as divorce settlements, custody of children and inheritance go. I think that the rights of women under Sharia law is well know. Muslim and Christian politicians expressed fears that at a time of heightened tensions, encouraging Muslims to live by their own distinct rules could make it harder for different communities to integrate. Understatement of the week. Khalid Mahmood, Labour MP for Birmingham Perry Bar and a practising Muslim, said that allowing Sharia law in parts of the UK would be divisive. ![]() The only one talking any sense here is a Muslim. 'The majority of British Muslims want to live only under British law and they would reject anything that means they are treated differently. A lot of Muslims came over to get away from this crap. 'What Lord Phillips and the archbishop are discussing is something that is completely outside their area of understanding.' Philip Davies, the Conservative MP for Shipley, said Lord Phillips' suggestion was 'totally unacceptable.' He said: 'It is very unhelpful for community cohesion. This is the sort of thing that builds up tensions in areas like mine, in places like Bradford. Sharia law has got no place in any shape or form in British law.' Andrew Selous, a Tory MP and chairman of the all-party Christians in Parliament group, said calls like those made by Lord Phillips and the archbishop were 'worrying.' He said: 'As far as people of all faiths are concerned, it is important that we are all equal under one United Kingdom law. It will lead to more community tensions rather than less.' Lord Ahmed, a Labour peer and practicing Muslim, said there was a 'big debate' among British Muslims about whether and how Sharia should apply in the UK. He said: 'There is a risk that this would make it harder for communities to integrate -- we all need to do more to integrate, and mainstream society has to do more as well.' 'We should have one law for everyone in the UK, but there may be very rare occasions when exceptions have to be made, like for marriage, divorce and food.' A Muslim lawyer said that raising the prospect of allowing people to live under Sharia law in Britain would 'alarm' people. No Shiite, Sherlock. Mahmud Al Rashid, spokesman from the Association of Muslim Lawyers, said: 'There is massive misunderstanding about what Sharia is. It is not a single law.' A spokesman for Dr Williams said: 'We welcome the speech given by the Lord Chief Justice as a positive and constructive contribution to this important and ongoing debate.' Cardinal Cormac Murphy O'Connor, the Archbishop of Westminster and leader of Britain's Catholics, said that people should live under the laws of the UK. A novel idea. Live under the laws of the country you live in. His spokesman said: 'As the Cardinal has consistently said and indeed said earlier this year, was that Britons should abide by and be subject to the law of the land.' Downing Street said the Government's position on the issue of Sharia law had been made clear at the time of the controversy over the Archbishop's speech. 'We think that British law should be based on British values and determined by the British Parliament,' the Prime Minister's spokesman said. Baroness Warsi, the Conservative shadow minister for community cohesion, backed the judge. She said: 'The Lord Chief Justice's speech is a very clear and unifying speech for our communities in Britain. 'I specifically endorse the points made by Lord Phillips that with equality of rights come responsibilities. It is absolutely essential that everyone in this country is treated equally by the law but it is important that everyone is equally subject to it, and that the same laws apply equally to everyone.' Five Thai terrorists get life in temple attack |

The Pattani Provincial Court yesterday handed down life sentences to five Officers found the charred bodies of the three victims. The attack sparked outrage across the country and threatened to further divide the Muslim and Buddhist communities in the southern border provinces. The remaining defendants were acquitted for lack of evidence. The five men escaped the death penalty as they had confessed to police. However, their lawyer Korde Kortae, of the Association of Muslim Lawyers, said he would appeal the verdict. In Narathiwat yesterday, a bomb aimed at a group of military officers sent to clear nails and spikes off a village road in Cho Airong district failed to explode, police said. The bomb was hidden near an electricity pole along the road where the nails and spikes were scattered. The device was wired to be set off by mobile phone but failed to detonate, officials said. In Rueso district, police arrested Hamadsulyadai Bayo, 25, who allegedly killed a villager in the district early last month. Police said they had evidence linking him to the murder even though Mr Hamadsulyadai strongly denied the allegation. In Pattani's Yarang district, four men ambushed a pick-up truck carrying security officials. The attack damaged the vehicle but no one was injured, police said. |

Set out that investigation has just commenced and ask for media and public to await the outcome of the investigation once it has been completed and not to rush to conclusions. 5. Set out that individuals are innocent until proven guilty in a court of law. 6. Ask for understanding and co-operation by the media in not adopting language that will stereotype the rest of the Muslim community and spread fear and misunderstanding in the wider community. 7. Throughout your statement avoid the use of language such as Islamic terrorists, Muslim terrorists, jihad etc but emphasise that individuals have been arrested accused of criminal activities and if found guilty will be sanctioned by the Criminal Justice system of the country accordingly. | |

NYT: Muslims Election Is Celebrated Here and in Mideast |

Keith Ellison wore his religion lightly on the campaign trail, mentioning it only when asked. But Muslims across America, and even overseas, celebrated his election Tuesday as the first Muslim in Congress, representing Minnesotas Fifth District in the House of Representatives, as a sign of acceptance and a welcome antidote to their faiths sinister image. Its a step forward; it gives the Muslims a little bit of a sense of belonging, said Osama A. Siblani, the publisher of The Arab American News, a weekly in Dearborn, Mich., a state with one of the heaviest concentrations of Muslims. It is also a signal to the rest of the world that America has nothing against Muslims. If we did, he wouldnt have been elected. Mr. Ellisons success was front-page news in several of the Arab worlds largest newspapers and high in the lineup on television news programs. Few of his supporters expect Mr. Ellison, a 43-year-old criminal defense lawyer who converted to Islam as a 19-year-old college student, to effect any policy shifts in areas of concern to Muslim Americans, particularly when it comes to foreign policy and civil rights. Mr. Siblani joked that even if all 28 new Democrats were Muslims, it is unlikely they would be able to sway the way Congress invariably votes in support of Israel. But many Muslims believe that just having a Muslim perspective around can make some difference. Congress needs to reflect the diversity of America, and that means its vibrant religious diversity as well, said Farhana Khera, the executive director of the National Association of Muslim Lawyers and a former senior Senate staff member. Its good to have diverse voices on the House floor, in committees and caucus meetings. It is good for the country to have different views aired, especially when the primary national issues relate to Islam and affect Muslims in this country and Muslims overseas. In a telephone interview, Mr. Ellison, who will also be the first black to represent Minnesota in the House, said his faith was particularly helpful in galvanizing the large community of Somali immigrants in his district, but the overall impact was difficult to assess. For some people, it might have been a problem and other people it was a bonus, Mr. Ellison said, noting that the campaign had received a fair amount of nasty e-mail and telephone calls denigrating Islam. He said that his priority was to represent his district, but that he hoped to do it in a way that touched a wider swath of Americans. I think a lot of Muslims feel highly vulnerable and feel that they are under a tremendous amount of scrutiny, he said when asked if he felt he was wearing a particular mantle, of representing Muslim interests. I am going to do it from a standpoint of improving the quality of civil and human rights for all people in America. Many Muslim American activists hope Mr. Ellison will inspire other Muslims to run for office, some even comparing his candidacy to John F. Kennedys breaking the taboo against a Roman Catholics being president. I think it has inspired American Muslims, said Adeeba Al-Zaman, 23, who flew from her home in Philadelphia to Minneapolis to volunteer to work in the last few days of Mr. Ellisons campaign. The fact that he won will probably motivate other Muslims that we have a shot and we matter and we are a part of the fabric of this society and we should be engaged because we have a chance. Ms. Al-Zaman also noted that with Mr. Ellison in office, Muslims would seem more normal, and that Congress and all Americans would see that we care about things like health care and education and everything else that all Americans care about. The sense of vindication is even stronger because Mr. Ellison was attacked on religious grounds by his Republican opponent, Alan Fine. In September, Mr. Fine said that as a Jew he was personally offended by Mr. Ellisons past support for Louis Farrakhan, the leader of the radical group Nation of Islam. Mr. Ellison denied any link to Mr. Farrakhan and reached out to Jews, eventually gaining some endorsements from Jewish groups. In the end, Mr. Ellison won 56 percent of the vote in his district, a Democratic stronghold that covers much of downtown Minneapolis and its immediate suburbs. Mr. Fine took 21 percent, as did Tammy Lee of the Independence Party. The incumbent, Martin Olav Sabo, is retiring Attacks on Mr. Ellisons religion helped galvanize Muslim Americans nationally, with supporters raising money from Florida to Michigan to California. His supporters were quick to point out that they backed Mr. Ellison not simply because he was a Muslim, but also because of his progressive platform, which included calls for universal health insurance and a withdrawal of forces from Iraq, and because he was running a positive campaign. Mr. Ellisons victory was widely noted in the larger Muslim world. The day after the election, it was the third headline mentioned on Al Jazeera, the most popular satellite news channel in the Middle East, right after a report that 18 Palestinian civilians had been killed by Israeli artillery in the Gaza Strip and a report on the overall Democratic sweep in the elections. The news garnered a rich variety of comments from Arab readers on the Web site of Al Arabiya, a satellite news channel based in Dubai. God willing in the next election, half of Congress will be from the rational Muslims, wrote one reader, while another said, May God make this the beginning of victory for Muslims on the very ground of the despots. A third wrote, We pray to God that you will be successful and will move forward in improving the image of Islam and the Muslims. Arab news reports highlighted the fact that Mr. Ellison would probably take the oath of office on the Koran, something which also upset Muslim-bashers in the blogosphere. Some suggested it meant he would pledge allegiance to Islamic law rather than to upholding the Constitution. Mr. Ellison said he had not really thought about the swearing-in ceremony and had tried to keep the campaign focused on issues rather than his religion. Groups Urge Sensitivity in Hezbollah Probe |

Leaders of the country's Muslim, Middle Eastern and South Asian communities are urging the FBI to use sensitivity if it investigates possible activities by the Islamic militant group Hezbollah on U.S. soil. Twenty-five groups, including the Islamic Society of North America and the American Arab Anti-Discrimination Committee, urged FBI Director Robert Mueller in a letter Wednesday to issue instructions to field offices and agents to avoid unwarranted profiling and respect the legal protections of people they may question. "We want the FBI, Khera, whose group is the charitable arm of the 500-plus-member National Association of Muslim Lawyers, said activists decided to send the letter after learning in recent days that the FBI has increased its focus on the worldwide activities of Hezbollah in light of the most recent fighting in the Middle East. The letter says that since the Sept. 11, 2001 attacks, the FBI has launched a number of interview programs that targeted Arab and Muslim men in particular. Some agents engaged in "harassing, unduly burdensome and improper questioning," it states. On Wednesday, Mueller told reporters at FBI headquarters in Washington, D.C., that the agency's efforts continued. But when asked if there was any indication Hezbollah is planning an attack in the United States or on U.S. interests abroad, he said, "At this juncture, no." FBI spokesman Stephen Kodak said the agency plans to reach out to the groups that sent the letter. He said there are no plans for large-scale interviews regarding Hezbollah. "We are sensitive to the cultural differences in dealing with the Muslim community," Kodak said, adding that the agency already has guidance about how to deal with the various groups. "Whether or not there's going to be special, additional guidance, that I don't know at this time." |

Ahmad Thomson, from the Association of Muslim Lawyers, said Mr Blair was the latest in a long line of politicians to have been influenced by the group which saw the attack on Saddam Hussein as a way to control the Middle East. A Government spokesman confirmed last night that ministers and officials consulted Mr Thomson on issues concerning Muslims but refused to be drawn on his views. "We talk to a lot of people, including many whose views we do not necessarily agree with," she said. Mr Thomson said: "Pressure was put on Tony Blair before the invasion. The way it works is that pressure is put on people to arrive at certain decisions. It is part of the Zionist plan and it is shaping events." Mr Thomson wrote a book in 1994 in which he said Freemasons and Jews controlled the governments of Europe and America and described the claim that six million Jews died in the Holocaust as a "big lie". In The Next World Order, Mr Thomson, a Muslim convert who was born Martin Thomson in Rhodesia, wrote: "When the majority of people in a predominantly Christian society cease to worship God, the result is fascism. "When the people in a predominantly Jewish society cease to worship God, the result is either communism or capitalism. A predominantly Christian society is concerned primarily with establishing a political ideology, whilst a predominantly Jewish society is concerned primarily with establishing an economic system." This, he suggested, led to the rise of Adolf Hitler. Mr Thomson, who was called to the bar in 1979, wrote: "The fascism of Hitler was the Christian element in the increasingly "Jewish" environment in which he and his followers found themselves." He also wrote that the Jews have no right to live in "the Holy Land" because they are not a pure race and therefore not the true biblical Israelites and that Saddam was used as an excuse for US troops - "including thousands of Jews" - to occupy Saudi Arabia. A Government source said: "It is by talking to people with varying views that we find out what the range of opinions is. It doesn't mean we agree with what they are saying." |

THE Inland Revenue is considering recognising polygamy for some religious groups for tax purposes. Officials have agreed to examine "family friendly" representations from Muslims who take up to four wives under sharia, the laws derived from the Koran.
