Florida Walmart shopper won't be charged for killing drugged-up Army vet after he threatened to ‘f‐ her s‐ up'

[NYPost] The Florida woman who shot and killed a drugged-up Army vet in a spat over a parking spot at a Walmart will not face charges after he allegedly hurled the N-word at her and threatened to “f— her s— up,” prosecutors revealed Thursday.
Bart Diguglielmo, a 62-year-old retired staff sergeant, was fatally shot in front of the supercenter in North Lauderdale just before 12:30 p.m. on June 30.
The shooter, identified as Melissa Payne, is immune from prosecution because she acted in self-defense due to the state’s “stand your ground” law, the Broward County state attorney’s office announced.
One witness said she had heard Diguglielmo threaten Payne before the shooting by saying “I’m gonna f— your s— up,” while another said he told her he was going to “mess her car up”, a legal memo stated.
Payne told deputies during a statement filmed on bodyworn camera footage and released Thursday that Diguglielmo had said “You n——” at her as the argument began.
“Florida is a Stand Your Ground State,” prosecutor Stephen J. Zaccor wrote. “MP (Melissa Payne) did not have to wait to be attacked before resorting to deadly force.
“She did not have to retreat as long as her fear was reasonable and no evidence has been presented to disprove that.”
Payne’s infant great-niece was in her vehicle during the incident, the memo said.
She was on the phone to her husband during the altercation and after firing told him, “Bae, I shot. Call the cops.”
A post-mortem later found that Diguglielmo had amphetamines, Delta 9 THC –– the psychoactive compound in cannabis –– and the SSRI antidepressant drug Sertraline in his blood.
Payne was briefly detained following the shooting and released after saying she was defending herself.
