#2 I don't know how there could be a stronger case but we will see.

If Congress and President are Republican, a law could be passed.

But then if a Dem came later they could just ignore the law.

Pretty depressing.

#4 Procop, the simple (simplistic?) answer is the one that goes something like...

"That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness."

If the legal protections of the Constitution are inadequate, the fall back is the Declaration of Independence
