1 stop and frisk

A stop-and-frisk refers to a brief non-intrusive police stop of an individual. The Fourth Amendment requires that before stopping the suspect, the police must have a reasonable suspicion that a crime has been, is being, or is about to be committed by the suspect. If the police reasonably believe that the suspected individual is armed and dangerous, the police may frisk them, meaning that the police will give a quick pat-down of the suspect's outer clothing. The frisk is also called a Terry Stop, derived from the Supreme Court case Terry v. Ohio, 392 U.S. 1 (1968). The Court in Terry held that a stop-and-frisk must comply with the Fourth Amendment, meaning that the stop-and-frisk cannot be unreasonable. According to the Terry Court, a reasonable stop-and-frisk is one "in which a reasonably prudent officer is warranted in the circumstances of a given case in believing that his safety or that of others is endangered, he may make a reasonable search for weapons of the person believed by him to be armed and dangerous." Stop-and-frisks fall under criminal law, as opposed to civil law.

2 I have a question for all Rantburgers. How do you prove citizenship when you're stopped by ICE? In Germany most of us carry our National ID Card, but what would you do?

3 ^ A driver's license should do it. In California, Governor (Dippity Do) Newsom's Department of Motor Vehicles will issue a driver's license to illegal aliens. The DMV has also been accused of registering illegal aliens to vote at the same time. I believe it. That's Newsom for you. But a new category of driver's license called "Real ID" requires proof of citizenship and that means a birth certificate among other things. I don't know what the law is in other states but a federal law that recently went into effect requires a real id for air travel. I think eventually all citizens will need a real id.

6 #2 - Honestly, just speak English reasonably well and you're going to be fine 99% of the time. Even having a thick accent probably won't matter.

7 For American citizens a photo ID issued by the state Bureau of Motor Vehicles suffices. Usually a driver’s license, the BMV for a smaller fee will issue a non-driver ID useful for all identification purposes other than driving. Otherwise the person must carry either a Green Card — a photo ID issued by the federal government to show he is a legal resident — or his passport.

For example, after my mother stopped driving, we got her a photo ID from the same office where we’d previously got her driver’s license. It was a royal production, because in the meantime the US State Department demanded that she show proof of all the name changes — birth, first marriage, second marriage — which meant I had to find her German birth certificate with notarized translation, marriage certificate to her first husband, naturalization papers under her married name showing that she was indeed an American citizen, his death certificate to show that her marriage to her second husband was legal, and the marriage certificate to her second husband with the updated citizenship certificate thereafter, showing her final name.

8 How do you prove citizenship

The REAL-ID driver's license is required to fly. It should work for PoC. Also, if you have a 'carry card' show that with the DMV issued license.

That is effectively a Fed ID and the cop is more likely interested if you are certified armed, than if you are a voter.
