Jhalakathi judge killer JMB man executed

[Dhaka Tribune] JMB member Asadul Islam Arif, who was given death penalty in Jhalakathi judges Jagannath Pare and Sohel Ahmed killing case, has been hanged in Khulna district jail.

The sentence was executed at 10:30pm on Sunday amid tight security, said Khulna Jail Super Kamrul Islam confirmed the Dhaka Tribune.

Khulna Deputy Commissioner Nazmul Ahsan, DIG Prisons (Jessore) Tipu Sultan, Magistrate Md Nur-e-Alam Siddique, Civil Surgeon Dr Md Abdur Razzak and Jail Superintendent Kamrul Islam were present during the execution.

Arif and six other JMB leaders including its founder Shayakh Abdur Rahman and second-in-command Siddiqul Islam alias Bangla Bhai were sentenced to death on May 29, 2006. The six were executed on March 29, 2007 after the Appellate Division upheld their sentence and the president turned down their mercy petitions.

The four others executed were Jama’atul Mujahideen Bangladesh (JMB) Majlish-e-Sura members Ataur Rahman Sunny, Abdul Awal Molla alias Omar alias Shakil Ahmed and Amjad Hossain alias Khalid Saifullah, and jacket wallah Iftekhar Hassan Al Mamun.

on July 10, 2007 and appealed against his sentence. Finally the Appellate Division rejected his appeal on August 28 this year.

He is the first death-row convict executed at the Khulna jail after a decade. On May 9, 2004, the jail authorities hanged top criminal Ershad Sikder.

Hailing from Bandorgachhia village of Barguna, Arif’s relatives were allowed to meet him at noon. He would be buried at his in-law’s village in Bagerhat’s Morelganj, family sources said.

Senior assistant judges of the Jhalakathi court Jagannath Pare and Sohel Ahmed were killed in a suicide kaboom at Purba Chadkati of the town when they were going to the court on a microbus on November 14, 2005 as part of the JMB’s all-out attacks on the courts and law enforcers across the country.

Sohel was struck down in his prime while Jagannath departed this vale of tears at a hospital. JMB member Mamun, who was injured in the attack, was arrested from the spot.

The JMB recently said that their members had conducted the suicide kabooms after the August 17, 2005 series blasts as the then "government did not respond to their call for establishing Islamic rule in the country positively."

After the execution of the six JMB leaders, its members rubbed out Jhalakathi public prosecutor Haider Hossain who represented the state in the case "as the first Dire Revenge."

SC upholds death for JMB man in Jhalakathi judges murder

[Dhaka Tribune] The Supreme Court has upheld the death penalty handed down to a member of banned murderous Moslem outfit Jama’atul Mujahideen Bangladesh (JMB) for carrying out a suicide kaboom that killed two judges in Jhalakathi in 2005.

A five-member Appellate Division panel headed by Chief Justice Surendra Kumar Sinha gave the verdict, rejecting the review plea filed by Asadul Islam on Sunday morning.

Senior assistant judges Jagannath Pandey and Sohel Ahmed were killed in the suicide kaboom on November 14, 2005.
The Appellate Division had upheld death sentence of seven JMB leaders, including its chief Abdur Rahman, second-in-command Siddiqul Islam alias Bangla Bhai and Asadul, in the case.

Fugitive top outlaw held in W Bengal

[Bangla Daily Star] West Bengal police arrested a top Bangladeshi outlawed leader from Nadia district early yesterday.

Sahin Alam Rumi alias Sahin Rumi, son of Sultan Rumi of Kalishankarpur in Kushtia, is the military commander of outlawed Gono Mukti Fouz.

Police said Sahin has been staying in India with a name of Sohel Ahmed Mondol alias Dipu for last several months.
Mr. Rumi has considerably more than his fair share of names. There must be men going around with none, to balance out.
A police team led by Sub-Divisional Police Officer Soumendranath Das raided the house of Mikail at Shantipur in Nadia at about 2:30 am and arrested Rumi.

Police recovered his passport, one ration card issued by West Bengal government, two mobile handsets and six SIM cards five of which are Bangladeshi and one Indian.

Indian police arrested Sahin as he is the accused in two murder cases filed with Bongaon Police Station in India.

When contacted Soumendranath told this correspondent that Sahin has been arrested as a main accused in a case filed for killing an Indian woman in Shantipur of Nadia on November 2009.

Indian police yesterday produced Sahin before a Bongaon court seeking a seven-day remand. The court granted five days' remand.

Around 55 cases including 25 killing cases have been recorded against Sahin with various police stations of Kushtia, Chuadanga and Jhenidah in last 10 years.

Police said Sahin himself claimed responsibility for those killings of local journalists and police over phones.

Final bell tolls for 6 JMB men

The president has rejected the mercy petitions of six of the seven Islamist militants condemned to death for killing two Jhalakathi judges in November 2005. With the rejection of the mercy petitions, there will be no obstacle to the executions of the militants.

Sources said the president rejected the mercy petitions on Sunday while the relevant documents were sent to the ministry concerned yesterday. Deputy Inspector General (Prisons) Maj Shamsul Haider Siddique told The Daily Star last night that he did not receive any official order regarding rejection of mercy petitions.
According to the jail code, if the president rejects clemency prayers by the condemned, the jail authorities are to reschedule the date of execution within 21-28 days from the date of receipt of the copy of his decision.
He, however, said the order would reach the jail through the law and home ministries and it may take two to three days.

The High Court (HC) on August 31 last year upheld the trial court verdict handing down death penalties to the seven convicts on May 29. The Supreme Court on November 28 last year rejected the six convicts' petitions seeking permission to appeal against the HC judgement.

Death warrants for six JMB men to be issued in three days

The jail authorities will issue death warrants for the six condemned members of Jamaatul Mujahideen Bangladesh (JMB) within the next three days in connection with the Jhalakathi judges murder case. The latest development came following receipt of a copy of the Supreme Court (SC) rejection of the condemned men's appeals against the death sentences by the jail authorities on Sunday, 54 days after the SC had delivered the order. The jail authorities started the process of executions yesterday. Executing the condemned now depends on a government clearance, although a number of provisions already exist to carry out the executions within 21 to 28 days following receipt of the court order by the jail authorities.

"We will fix the date of execution within the next two or three days."
The SC on November 28 rejected the six condemned JMB men's petitions seeking permission to appeal against a High Court (HC) judgment upholding the death sentences for killing two judges in a suicide bomb attack in Jhalakathi on November 14. On Sunday and yesterday, the jail authorities read out the SC rejection to all the six condemned JMB men, in accordance with the jail code. Inspector General (Prisons) Brig Gen Zakir Hasan told The Daily Star last night, "We will fix the date of execution within the next two or three days."

Jail authority sources said they are in a dilemma about whether they will follow the new jail code or the old one, because the two codes provide two different timeframes for carrying out executions after receiving court orders. The jail authorities will seek the help of the law ministry to clarify the matter, said jail authority sources.

Jail sources said, they are already aware that the families of at least three of the condemned JMB men, including JMB chief Abdur Rahman and another lynchpin Siddiqul Islam alias Bangla Bhai, are eager to submit petitions to the president for clemency. The IG (Prison) said, "I am also aware that some of the condemned are eager to submit mercy petitions, but I'm not sure who they are. Even if the families submit mercy petitions, they will be sent to the president for his consideration."

Hearing begins on condemned JMB men's appeal

Hearing of appeals of six condemned militant leaders of Jamaatul Mujahideen Bangladesh (JMB) including its chief Abdur Rahman and Siddiqul Islam alias Bangla Bhai in the Jhalakathi judges killing case began yesterday at the Appellate Division of the Supreme Court.

State defence lawyer Advocate Khalilur Rahman Bhuyian started reading out the paper-book (history of the case) that will continue today. The full bench of the Appellate Division comprising seven judges led by Chief Justice Syed JR Mudassir Husain heard the matter. The High Court (HC), on August 31, upheld the death sentences of seven JMB militants that had been awarded by a trial court of Jhalakathi.

On May 29, the Jhalakathi court sentenced Abdur Rahman, Siddiqul Islam, Ataur Rahman Sunny, Abdul Awal, Iftekhar al Mamun, Khaled Saifullah and Arif to death for killing judges Sohel Ahmed and Jagannath Pandey in a suicide bomb attack on November 14, 2005. Although militant leaders earlier repeatedly said they would not appeal against verdict, after the HC verdict, six of the seven condemned militants filed petitions for appeal in October at the eleventh hour of deadline for appealing. The other condemned, Arif, is still on the run.

Death sentence to 7 JMB kingpins upheld

The High Court (HC) yesterday confirmed death sentences to seven militant leaders of Jamaatul Mujahideen Bangladesh (JMB) including its five kingpins for killing two judges in Jhalakathi as it found the trial court's judgment appropriate. The government and state lawyers believe that the punishment to the seven Islamist militants can be executed before the ruling coalition government's tenure ends on October 28 provided the convicts do not appeal against the verdict with the Appellate Division within 30 days.

In the quickest disposal of a case in the history of Bangladesh, the trial of the sensational case for the first suicide bomb attack in the country was completed in just 131 days from framing of the charges in the lower court. Senior assistant judges Jagannath Pandey and Sohel Ahmed were killed in the suicide bomb attack at Purba Chadkati in Jhalakathi town on November 14 last year in the wake of a series of bombings by the militants across the country. On May 29, Additional District and Sessions Judge of Jhalakathi Reza Tarik Ahmed ordered for hanging the seven JMB men, including its chief Abdur Rahman and his top aide Siddiqul Islam alias Bangla Bhai, until death and acquitted one.

Other convicts in the case are JMB Majlish-e-Shura members Ataur Rahman Sunny, Abdul Awal and Faruk Hossain Khan alias Khaled Saifullah, suicide bombers Iftekhar Hasan Al Mamun and absconding Asadul Islam alias Arif. "The additional sessions judge did not commit any illegality by handing death sentences on the seven accused. There is no ground to interfere in the judgment passed by the additional sessions judge Jhalakathi," the HC bench comprising Justice Ali Asgar Khan and Justice Emdadul Haque said while confirming the death sentence in a crowded courtroom yesterday.

Security was beefed up on the Supreme Court premises yesterday but no special security was arranged for the two judges who delivered the verdict. "They [the seven convicts] carried out terrorist activities in the name of Islam. Islam does not support terrorist activities," the court said, adding that the prosecution has proved the case beyond reasonable doubt.

HC approves militant cases' priority hearing

The High Court (HC) yesterday granted government application seeking preparation of the 'paper book' on a priority basis for hearing of the death reference in the verdict on Jhalakathi judges killing case.

A Jhalakathi court awarded death penalty to seven militant leaders including Abdur Rahman and Siddiqul Islam alias Bangla Bhai. A division bench of the HC granted the application as the Attorney General's (AG) office moved it since the government wants quick disposal of cases, especially death references concerning militants. Explaining the urgency of preparing the paper book in its application, the government said, "For the national security, national interest, peace, tranquillity and smooth running of all the organs of the state including the judiciary, preparation of the paper book is very important.'
"Smooth running of the state" is a relative term in Bangla, of course...
Following the HC order, Deputy Attorney General (DAG) Md Helal Uddin Mollah, who moved the application, told newsmen, " I hope if everything goes smoothly, we will be able to prepare the paper book and submit it before the court for hearing within a month." The whole nation and the world want quick disposal of this case. So, it cannot be compared with other murder cases like the ones for land disputes etc, he stressed. The DAG said preparation of paper books for hearing of death references of different cases of 2003 now going on. If the paper book for the Jhalakathi case is prepared as in other common cases, then it will come up for HC hearing in 2009.

The Jhalakathi Speedy Trial Tribunal on May 29 sentenced to death Abdur Rahman, Bangla Bhai, Ataur Rahman Sunny, Abdul Awal, Khaled Saifullah, Asadur Rahman Arif and Iftekhar Hasan Al Mamun for killing two judges -- Sohel Ahmed and Jagannath Pande.
Sounds like the Speedy Trial Tribunal's supposed to be followed by the Speedy Execution Team.

8 top JMB militants indicted for murder of judges

Apr 23: Top eight militants, including JMB chief Shaikh Abdur Rahman, second-in-command Bangla Bhai, Ataur Rahman Sunny and Abdul Awal, were today (Sunday) indicted for the killing of two judges here in a bomb attack last November.

As Additional District and Sessions Judge Reza Tarique Ahmed asked Shaikh Rahman about his involvement in the killings, he quipped, "The two judges were killed in the district as per instructions of Allah."

The supreme leader of the banned Islamic outfit—caged in custody along with most members of his family and his top-order lieutenants, vowed to carry on their mission of dismantling the manmade judicial system if they survived. "If we remain alive, killing security forces, judges, lawyers and people who are seeking judgement under the existing law will be continued until establishing Islamic law," said Shaikh Rahman.

He told the court that they had tried to forewarn the judges against executing the manmade law through distributing leaflets across the country and serial bombings on August 17, 2005. "But they didn’t go to Imams to know about the Islamic law. And that’s why they were killed."

The four other JMB men charged are suicide-squad member Iftekhar Hasan Al Mamun, Khaled Saifullah alias Amjad, Asadul Islam Arif and Sultan Hossain Khan of Krisnakati of Jhalakati. The last one is accused of helping the JMB militants rent a house in this southern coastal district. Khaled Saifullah alias Amjad, one of the seven members of Majlish-e-Shura, JMB’s policymaking body, and Asadul Islam Arif are on the run.

The charge was framed when the eight were produced before the court today (Sunday) morning amid tight security. A total of 175 police and over 100 RAB members were deployed on the court premises. Shaikh Abdur Rahman, Siddiqul Islam Bangla Bhai and Ataur Rahman Sunny were brought to the court from Dhaka under RAB protection today while the rest were brought and kept in the district jail on Saturday for producing them before the court.

The court fixed April 26 for next hearings in the judges’ murder case. Depositions will start from the same date. Ataur Rahman Sunny, Abdul Awal and Iftekhar Hasan Al Mamun admitted to having been involved in the incident, but Bangla Bhai and Sultan Hossain Khan pleaded not guilty.

Senior Assistant Judges Sohel Ahmed and Jagannath Pandey were killed when JMB suicide bomber Iftekhar Hasan Al Mamun allegedly set off a powerful bomb on their vehicle on November 14 last year.

JMB bigs jugged for long, long, long time

A Barisal court yesterday sentenced top Jama'atul Mujahideen Bangladesh (JMB) leaders Ataur Rahman Sunny and Abdul Awal and suicide bomber Iftekhar Hasan Al Mamun to 40 years' rigorous imprisonment each for killing two judges in Jhalakathi.

Barisal Speedy Trial Tribunal passed the verdict on the day set for framing charges against the militants as the detained JMB leaders pleaded guilty. The trial, however, will continue as Sultan, a charge-sheeted accused, has denied the allegation brought against him and the rest four--JMB chief Abdur Rahman, Siddiqul Islam alias Bangla Bhai, Molla Omar alias Shakil Ahmed of Tangail and Amzad alias Khaled Saifullah of Pirojpur--are still at large.

Ataur Rahman Sunny, head of the JMB military wing, is also a younger brother of Abdur Rahman. Abdul Awal is a member of JMB Majlish-e-Shura (highest policymaking body) and Abdur Rahman's son-in-law.

Sohel Ahmed, 35, senior assistant judge of Nalchhiti upazila, and Jagannath Pandey, 38, senior assistant judge of the Sadar upazila, died and three people were wounded when Mamun blew up a microbus carrying the judges in Jhalakathi on November 14 last year. Police caught Mamun immediately after the blast and seized an unexploded bomb strapped to his thigh.
"Arrgh! Missed one!"
After the case filed under Explosive Substances Act was transferred to the Barisal court, Judge Abdul Matin fixed six consecutive dates for framing the charges. But until yesterday Sunny and Awal could not be produced before the court.

On taking seat, Judge Abdul Matin read out the allegations brought against the militants. He then asked each of the four detained accused--Sunny, Awal, Mamun and Sultan--for their versions. Sunny, Awal and Mamun instantly confessed to committing the crime. They also stated the statements they had made earlier to a magistrate were true. But Sultan Khan denied the allegation.

The judge convicted Mamun of carrying out a bomb attack on the two judges and awarded rigorous life imprisonment under section three of Explosive Substances Act and another 10 years in prison under section four. Both the sentences will take effect at the same time.

Sunny and Awal were declared guilty for aiding and abetting the bombing and sentenced each to 40 years in prison. The court framed charges against Sultan and the four on the run and fixed February 14 as the date for next hearing.

After the bombing on November 14, Mamun, who was undergoing treatment at Barisal Medical College Hospital for the injuries sustained in the blast, gave confessional statement to a magistrate the same day. Sultan Hossain, driver of the microbus, filed two cases, one for murder and the other under Explosive Substances Act, accusing Mamun. After investigation, Sohrab Hossain, officer-in-charge of Jhalakthi Police Station, submitted a charge sheet against the eight.

After the court order, the JMB military chief said they have been dealt out the sentences for trying to establish the rule of Allah. "We are not sorry for what we have done. We've dedicated our lives to working for Islam," he told the newsmen.

Bangla boom masterminds still free

Law enforcing agencies are yet to arrest the masterminds behind with the August countrywide serial bomb blasts although the government is continuously telling the people that hauling up of culprits involved is a ‘matter of time.’

Meanwhile, police arrested some top leaders of the banned Jama’atul Mujahideen Bangladesh (JMB) and they confessed to their involvement in the heinous activities.
"Ooch! Ouch! Anything! I'll tell you anything! Does it have to be true?!"
Experts wonder why the law enforcing agencies were taking time to nab the kingpins. At least 100 cases have so far been filed throughout the country in connection with the serial bomb blasts and only 40 charge sheets have so far been submitted, sources said.

Soon after the arrest of the military commander of JMB Ataur Rahman Sunny, younger brother of JMB chief Shaikh Abdur Rahman, on December 14, the law enforcement members as well as the government had claimed that the entire network of the JMB has been broken. As no major subversive act was committed after the arrest, it appears that the government claim was partially true.
"Cheez it Muggsy, lay low for a while til we get the G-men off our backs!"
The sources said they could sense a reshuffle in the central leadership, mainly in the military wing, by going through the threat letters issued by the JMB different parts of the country.

But sources fear that the JMB is taking time for regrouping as their kingpin Shiekh Abdur Rahman and its operational wing JMJB's chief Bangla Bhai are still at large and working behind the scene.

Meanwhile, two top arrested JMB leaders including Chittagong militant commander Javed Iqbal alias Mohammad gave statements under Section 164 to the metropolitan magistrate court on Friday. Metropolitan Magistrate Maksudur Rahman first started recording of the deposition of confessional statement of Operational Commander of JMB, Cox's Bazar district Naimuzzaman at around 3:30 PM.
"Ease off the pliers a moment, Ahmed, I need to get his jibbering on tape."
After completion of recording of the one hour statement of Naimuzzaman the magistrate turned to record deposition of statement from Javed Iqbal alias Mohammad at around 6:00 PM which is still going on till filing of this report at 7:15 PM.

A source linked with the investigation said that deposition of statement of the rest two JMB leaders Monirul Islam and Rafiqul Islam also seconds-in-command to Mohammad will also be recorded in turns.

The arrested JMB leaders have been produced before the court at around 3:00 PM under RAB escort and other law enforcers were also put on maximum alert.

Different satellite television channels have screened an exclusive appeal of Ataur Rahman Sunny, in which the JMB's military commander called upon his fellows to surrender and hand over their weapons and explosives to police and other law enforcing agencies. But a day after his (Sunny) appeal, an Ehsar (member of suicide squad) of JMB in Rangpur has threatened to launch fresh bomb attacks in Rangpur claiming that they were reorganising under new leadership.
Since all the old leadership is in jug or in Dr. Quincy's morgue.
Despite repeated screening of the appeal of Sunny in BTV, none of the JMB member have so far surrendered or handed over their weapons ignoring the appeal of the military commander.

Before its underground launching, the JMB has spread its organisation under the banner of Ahle Hadith Andolan led by grilled Dr Asadullah Al Galib. Shaikh Abdur Rahman's father Fazal Munshi was the founder of the party. After the death of Fazal Munshi, Dr Galib became the chief of Ahle Hadith Andolan. But soon a split took place over the leadership resulting in creation of another faction led by Shaikh Abdur Rahman.

Later, Shaikh Abdur Rahman formed the JMB and recruited hundreds of youths from all parts of the country in the name of carrying out an Islamic revolution.

As part of the 'test case' of Jehad, Shaikh Abdur Rahman has deputed one of his influential commanders Bangla Bhai, also the member of Majlish-e-Shura (top policy making body), at Bagmara in Rajshahi where he (Bangla Bhai) let loose a reign of terror. Bangla Bhai, under the banner of JMJB, has brutally killed a number of innocent people in the name of eliminating the outlawed party.

JMB first launched countrywide serial bomb attacks on August 17 apparently to declare their presence and strength killing two people. On November 3, they launched simultaneous bomb attacks on court premises in Chittagong, Laxmipur and Chandpur also killing three people. The outfit carried out its first suicide attack on judges in Jhalakathi on November 14 killing two judges – Sohel Ahmed and Jagannath Pandey.

On October 18, a judge of the Speedy Trial Tribunal in Sylhet, Biplab Goswami, narrowly escaped a bomb attack. The suicide bombers on November 29 carried out bomb attacks at District Bar Library in Gazipur and Chittagong court leaving 13 people dead. The banned Islamic outfit carried out another suicide attack on December 1 killing a man and injuring 20 people in front of Gazipur DC office. The suicide bombers carried out their last attack on December 8 in Netrokona where 10 people were killed and many others injured.

JMB suicide bomber on 10 days' remand

JMB suicide bomber Mamun Ali who killed two judges in Jhalakathi on November 14 was taken on 10 days' remand when he was taken to Jhalakathi yesterday from Dhaka after treatment. He was treated at Dhaka Medical College Hospital for injuries he sustained during the bomb attack.
I think we can confidently expect that his injuries were very painful, perhaps even resulting in a nice colostomy bag. Pray for sepsis.
Sohrab Hossain, Investigation Officer of the cases and Officer-in-Charge of Jhalakati Sadar police station prayed for 14 days' remand, court sources in Jhalakathi said when contacted over telephone. Jhalakati Sadar Upazila Magistrate Ismail Hossain granted 10 days' remand.
Ummm... Might we suggest they simply charge him? It's not like they don't have lots of evidence, to include his legs...
Senior Assistant Judges Shahid Sohel Ahmed, 35, and Jagannath Pandey, 38, were killed, one at the spot and the other on way to Barisal SBMCH in the suicide bomb attack. The judges were inside their microbus, just before leaving their Chandkati residence in Jhalakati town at about 9 am when two bombs went off, killing them and blowing up the vehicle. JMB (Jamaatul Mujahideen Bangladesh) suicide squad Mamun Ali, 23, milk seller Badsha Mia, 45, judge court peon Abdul Mannan, 40, and Lokman, 13, a student of class six were injured in that blast. Mamun Ali was caught by local people and handed over to Rab (Rapid Action Battalion). He is the son of Qamruzzaman, a 4th class employee at Rajshahi University.

Injured Mamun while being taken to Barisal tried to explode another bomb he was carrying but failed as RAB members and police foiled the attempt and recovered the bomb tied with his thigh.
