Sindh authorities given one-month ultimatum to restore law and order

The directives were issued after SHC Chief Justice Aqeel Ahmed Abbasi chaired a session on the law and order situation in Sindh earlier today.

Justice Abbasi ordered the provincial authorities to restore law and order across the province within a month. He also directed strict actions against "influential persons" who were involved in sabotaging the law and order situation.

The SHC chief justice also summoned a detailed report regarding the law and order in 15 days.

Following the SHC orders, Inspector General Police (IGP) Sindh Ghulam Nabi Memon said that the high court’s top judge was briefed on the situation and gave instructions. He added that the police department also gave a briefing to the high court regarding the implementation of previous court orders.

He admitted that street crimes were among key elements behind deteriorated peace situation in Karachi while bandidos of katcha (riverine) were also a big challenge to maintain law and order in other parts of the province.

"Discussions were also held on increasing patrolling of police contingents to curb street crimes in Karachi. There is a need to improve our criminal justice system, whereas, key points were also discussed regarding the interrogation process," he added.

The police presented the PTI leader before an anti-terrorism court (ATC) after arresting him a day earlier from outside the Sindh High Court (SHC).

The law enforcement agency was seeking the physical remand of the PTI leader but the court rejected the plea and instead granted bail to Sheikh.

As per the police, a case was registered against Sheikh in the Preddy Police Station a day earlier for interfering in the matters of the state, rioting and assault on police. It added that in the complaint it has been contended that during the PTI leader’s arrest, a day earlier, the police were attacked with sticks.

‘Victim of forced conversion’ records statement

[Dawn] A woman, mother of five, was handed over to her brother’s family after she in a statement under Section 164 CrPC claimed that she and her children were kidnapped by her husband, Sudheer Odh, who forced her to convert.

The woman, Ms Shahida, stated before the second sessions judge of Jacobabad on Saturday that her husband was a cheat and had embraced Islam thrice in the past. Her two sons and three daughters, along with her brother and other family members, were present in court.

She said she and Sudheer Odh got married some eight years ago. "A few days back, my husband kidnapped me and my children at gunpoint from my brother’s home, subjected me to torture and forced me to convert," she further stated.

Interior ministry cancels NOC of ARY News

[DAWN] The Ministry of Interior has cancelled the no-objection certificate (NOC) of ARY Communications Private Ltd, citing "adverse reports from agencies" as the reason behind the decision, it emerged on Friday.

The notification issued by the ministry, dated August 11, to the Pakistain Electronic Media Regulatory Authority (Pemra) reads: "The NOC issued in favour of M/S ARY Communications Private (Ltd). is cancelled with immediate effect and until further orders on the basis of adverse reports from agencies."

Reporting on the development, ARY News' English website called the cancellation by "the coalition government led by PML-N" an "economic murder of more than 4,000 media workers associated with the news channel". The report also called it a "a new move against the journalist fraternity", saying this was done without any notice.

"The channel’s administration condemned the suspension of its transmissions, saying the network is being victimised by the federal government," it added.

The decision from the Interior Ministry comes two days after the Sindh High Court directed Pemra and cable operators to immediately restore the transmission of ARY News, which had been suspended on orders of the government.

ARY News embroiled into a controversy after PTI leader Shahbaz Gill uttered "seditious remarks" against the Pakistain Army while talking to the TV channel earlier this week. Later on Tuesday, he was taken into custody at Banigala Chowk in the capital.

Gill was subsequently booked on charges of sedition and inciting the public against state institutions.

The ARY report published today also highlighted that the channel had issued a clarification that Gill’s statement was his personal opinion and had nothing to do with the channel’s policy.

But Nawabshah SSP Ameer Saud Magsi said that Shrimati Kareena had not been kidnapped she had eloped with Khalil Rehman Jono of Meer Mohammad Jono village and had married to him in a court in Karachi.

He said that Asghar Jono, father of Khalil, had been arrested after registration of FIR under Section 365-B on a complaint lodged by Sundurmal. Khalil and his father Asghar were nominated in FIR, he said.

The SSP shared a nikahnama purportedly of Shrimati Kareena and Khalil Rehman Jono and said the girl would be produced in Sindh High Court. The girl would decide to go wherever she wanted, he said.

Hindu Panchayat vice president Lajpat Rai rejected the SSP’s claim and said that police had registered an FIR but were rescuing the kidnapped girl. A delegation of Hindu community met the SSP but he had not helped them, he said.

Manomal, another Panchayat leader, said that the kidnapped girl was under pressure to change religion and was not being produced in any court.

He appealed to Asif Ali Zardari to help the Hindu community in the recovery of the girl. When the protestors reached close to Zardari House, police stopped them from advancing to the former president’s residence and persuade them to end the protest over assurance the girl would be produced in court.

Sheikh was acquitted by the Sindh High Court in April 2020 and since then Pearl’s family and Pakistain’s government have been fighting a legal battle to overturn the acquittal. Washington has also expressed its concern over the acquittal of Sheikh.

Sheikh has been in jug despite his acquittal under a special law allowing the government to detain people deemed a security risk.

The transfer comes more than a month after Pakistain’s Supreme Court ordered Sheikh moved to a safe house from a special jail cell for inmates sentenced to death.

Authorities say Sheikh will not be allowed to leave the safe house.

Pearl disappeared on January 23, 2002, in Karachi where he was investigating links between Pak terrorist groups and Richard C. Reid, dubbed the "shoe bomber." Reid had attempted to blow up a flight from Gay Paree to Miami with explosives hidden in his shoes. Sheikh was convicted of helping lure Pearl to a meeting in Karachi, during which he was kidnapped.

The SC had taken up an appeal moved by the Sindh government against the Sindh High Court’s Dec 24, 2020, order declaring illegal the provincial government’s June 29, 2020, notification of placing all accused on the Fourth Schedule of the Anti-Terrorist Act of 1997 pursuant to Section 11-EE with an observation that none of the accused was "enemy alien" as contemplated under Article 10(9) of the Constitution and as such their detention under this provision was found to be illegal.

The court also imposed 200,000 Pak rupees fine on him. Saeed, 70, has already been convicted for 21 years imprisonment in four terror financing cases of late.

Now, Saeed will have to undergo collective imprisonment of over 36 years in five terror financing cases at the Kot Lakhpat Jail Lahore.

His punishment will run concurrently in these cases.

US 'deeply concerned' at SHC order to release men charged in Daniel Pearl case

[Dawn] The US State Department on Friday expressed its reservations after the Sindh High Court (SHC) ordered that the four men charged in journalist Daniel Pearl's abduction and murder case be released immediately, terming their detention illegal.

In a message on Twitter, the state department said it was "deeply concerned" at the Dec 24 ruling of the SHC to release "multiple faceless myrmidons responsible for the murder of Daniel Pearl".

"We have been assured that the accused have not been released at this time," the statement added.

It said the department will continue to monitor any developments in the case and will continue to support the Pearl family "through this extremely difficult process" while honouring the legacy of Daniel Pearl as a journalist.

The statement came a day after the SHC struck down a preventive detention order issued by the Sindh government to keep four men behind bars after their convictions by a trial court were set aside around eight months ago in the abduction and murder case of US journalist Daniel Pearl.

The bench also barred the federal and provincial authorities from placing the men under any preventive detention order without prior permission of the SHC. However,

In April, the high court had acquitted all the appellants of the charges of murder and kidnapping for ransom and only found main accused Ahmed Omar Sheikh guilty of abducting the slain journalist and sentenced him to seven-year imprisonment. However,

the key suspect in Pearl’s slaying, should remain in custody. Sheikh was acquitted earlier this year of murdering Pearl, but has been held while Pearl’s family appeals the acquittal.

"The detention order is struck down," said Faisal Siddiqi, the family’s lawyer. He said Sheikh would be freed until the appeal is completed, but would return to prison if the family is successful in overturning the acquittal.

However, Siddiqi said the Sindh provincial government is appealing the order to release Sheikh.

Sheikh’s lawyer Mehmood A. Sheikh, with whom he is not related, called for his client’s immediate release.

Pearl’s parents and prosecutors lodged an appeal at Pakistain’s Supreme Court in May, putting the release of the four men on hold.

"The case has finally opened, it will be decided whether they should be convicted or acquitted. The case is heading to a final verdict," Faisal Siddiqui, the lawyer representing Pearl’s parents, told AFP.

The appeal, which has been repeatedly postponed in recent months, will hear opening arguments in the capital Islamabad on Wednesday.

Sheikh had been on death row for Pearl’s murder but was acquitted in April by the Sindh High Court which instead sentenced him to seven years for kidnapping — paving the way for him to walk free after already serving 18 years.

Three co-defendants who were serving life sentences in connection to the case were acquitted.

Pearl, who was Jewish, was South Asia bureau chief for The Wall Street Journal when he was kidnapped in Karachi in January 2002 while researching a story about Islamist hard boys.

A graphic video showing his decapitation was delivered to the US consulate nearly a month later.

Prosecutors said Sheikh lured Pearl into a trap by promising to arrange an interview with an Islamic holy man who police believed was not involved in the conspiracy.

Sindh High Court orders to shift Arzoo Raja to shelter home after medical reports declare her a minor

[DAILYTIMES.PK] After the medical reports determined Arzoo’s age to be around 14-15 years, Sindh High Court has ordered authorities to settle her at a shelter home.The court bench, comprising of two members Justice KK Agha and Justice Amjad Ali Sahito, heard the case on Monday, in which Arzoo’s reports by the medical bench were shared, declaring her underage. The bench was informed that the case is now registered under the Sindh Child Marriages Restraint Act 2013.
Arzoo Masih is the 13-year-old Christian girl forcibly converted to Islam and married to a 44-year-old.
According to reports, upon inquiry, Arzoo denied being forced to convert to Islam, and expressed the desire to live with her 44-year old husband.
