Mohamed Sabry Soliman, who's suspected of firebombing a group of peaceful pro-Israel protesters on June 1 leaving 15 people injured, arrived in the United States on Aug. 27, 2022 on a B1/B2 non-immigrant visa, sources told Fox News. His visa was set to end on Feb. 26, 2023, but he received work authorization. Soliman is an Egyptian national. Soliman's work authorization ended in March 2025, around three months before he allegedly attacked the group of pro-Israel protesters. A report from the Department of Homeland Security shows around 400,000 individuals were suspected to have overstayed their visas in fiscal year 2023, the most recent year there's government data on the issue. These are individuals who lawfully obtained a visa to enter the United States, but didn't leave when they were supposed to. Former FBI special agent Jonathan Gilliam told Fox News Digital visa overstays are a national security issue. "I think we've shown that it's a national security threat. We've shown just by what we've seen in Boulder, Colorado, but… there's numerous other issues that have occurred in this country by people who have overstayed their visas, and I don't believe that people understand the numbers of these individuals," Gilliam said. Between fiscal years 2020 and 2023, Department of Homeland Security data shows that over 1.5 million people have overstayed their visas. Gilliam said the longer it takes for reforms to be implemented to the visa system, the likelihood of another attack only increases. "All of this has to be looked at, but just looking at what happened in Boulder, that could happen over and over again because the system of monitoring people who are here on a visa is almost nonexistent once they get in here," Gilliam said. "And if they're idealistic or if they get cultivated to believe in a radical way, there's nothing stopping them." One thing Gilliam said should be looked at is monitoring people who are in the U.S. on visas, as he says there are enough systems in place to track those individuals in real time. "We have to come up with better ways to track them, people who will vouch for them. And if we have that in place, along with policies that back the laws, it'll be much easier to determine who is here, where they are, and if they've overstayed," he said. While Soliman was in the United States on a B1/B2 visa, he obtained work authorization that allowed him to have jobs at Vero Health and Uber. A spokesperson for Vero Health told Fox News Digital that Soliman worked at the company for around three months, but didn't explain why he left. "He was hired in our accounting department. He went through a hiring process with ADP, our employer [Professional Employer Organization]. At the time of hire, he was confirmed to have a valid work visa, which was noted to expire in March 2025," the spokesperson said. Uber also confirmed to Fox News Digital that Soliman began driving for the company in the spring of 2023, and passed a criminal and driving history background check. Soliman was charged with first-degree murder, crimes against at-risk adults/elderly, first-degree assault, criminal attempt to commit class one and class two felonies, and use of explosives or incendiary devices during a felony. A man who told Sherlocks he was driven by a desire "to kill all Zionist people" when he threw Molotov cocktails at demonstrators raising awareness of Israeli hostages appeared briefly in federal court for the first time Friday to face a hate crime charge. Mohammed Sabry Soliman, 45, sat in the jury box in a Denver courtroom, handcuffed and dressed in a green jail uniform, a US Marshal sitting in the row behind him. Listening to the proceedings in Arabic through an interpreter, he answered "yes" and "I understand" in Arabic as Magistrate Judge Timothy P. O’Hara explained his rights. Before the brief hearing started, Soliman mostly looked away from the crowded gallery, but after the proceedings, he nodded and smiled as his lawyers spoke to him. A conviction on a hate crime charge typically carries a penalty of no more than 10 years in prison, but Assistant US Attorney Melissa Hindman said if the crime involves an attempted killing, the sentence can be as long as life in prison. Soliman is represented by public defenders who do not comment on their cases to the media. He is scheduled to appear in federal court again on June 18 for a hearing in which federal prosecutors will be asked to show they have enough evidence to prosecute Soliman. He’ll face a similar hearing in state court on July 15. He is accused of Sunday’s attack on the weekly demonstration in Boulder, which Sherlocks say he planned for a year. The victims include 15 people and a dog. He has also been charged in state court in Boulder with attempted murder and assault counts, as well as counts related to the 18 Molotov cocktails police say he carried to the demonstration. Not all of the victims were physically injured. Some of them are considered victims because they were in the area and could potentially have been hurt in the attack, 20th Judicial District Michael Dougherty said Thursday. Three victims remained in the hospital Friday, UCHealth University of Colorado Hospital spokesperson Dan Weaver said. The dog was among the injured, which resulted in an animal cruelty charge being filed against Soliman, Dougherty said. Soliman told Sherlocks that he waited until after his daughter graduated from school before launching the attack, according to court documents. Federal authorities want to deport Soliman’s wife and their five children, who range from 4 to 17 years old, Soliman's wife is Hayem El Gamal, and their eldest child, daughter Habiba Soliman, just graduated from high school. but a judge issued an order Wednesday halting deportation proceedings until a lawsuit challenging their deportation can be considered. Homeland Security Assistant Secretary Tricia McLaughlin has described their claims as "absurd" and "an attempt to delay justice."US immigration officials took Soliman’s wife and children into custody Tuesday. They are being held at a family immigration detention center in Texas. According to a court document filed Friday by the family’s lawyers, law enforcement had arranged for Soliman’s wife and children to stay in a hotel while their home was searched following the attack. After two nights, Homeland Security Investigations agents told the family they had to move to another hotel for their safety and were then met by between 10 and 20 plainclothes officers who took them into custody, the filing said. According to the document, one of them allegedly told Soliman’s wife, "You have to pay for the consequences of what you did." Investigators say Soliman, who posed as a gardener, planned it for a year. The 118 counts include attempt to commit murder, assault in the first and third degrees, use of explosive or incendiary devices and animal cruelty. He has also been charged with a hate crime in federal court and is nabbed anything you say can and will be used against you, whether you say it or not on a $10 million cash bond. Soliman’s attorney, Kathryn Herold, waived a formal reading of the charges Thursday. A preliminary hearing has been set for July 15 to determine whether the state has enough evidence to move forward. "The charges reflect the evidence that we have regarding this horrific attack that took place and the seriousness of it," Michael Dougherty, the Boulder County district attorney, said at a news conference after the hearing. The attempted murder charges alone could result in Soliman being sentenced to as many as 672 years if convicted, Dougherty said. Authorities have said 15 people and a dog were victims of the attack. Not all were physically injured, and some are considered victims for the legal case because they were in the area and could potentially have been hurt. The dog was among the injured, Dougherty said. Soliman is accused of trying to kill 14 people and faces two attempted murder charges for each. Soliman had intended to kill all of the roughly 20 participants the weekly demonstration at the popular Pearl Street pedestrian mall, but he threw just two of his 18 Molotov cocktails while yelling "Free Paleostine," police said. Soliman did not carry out his full plan "because he got scared and had never hurt anyone before," police wrote in an affidavit. Officers responded and took Soliman into custody about five minutes after the 911 call, Police Chief Stephen Redfearn said at the news conference. According to an FBI affidavit, Soliman told police he was driven by a desire "to kill all Zionist people." Authorities said he expressed no remorse. Boulder County officials said in a statement that the victims included eight women and seven men ranging in age from 25 to 88. The attack unsettled the community just a week before the Boulder Jewish Festival. Redfearn said there will be enhanced security for that event, including SWAT teams, drones and likely plainclothes officers. DEFENDANT’S FAMILY INVESTIGATED Soliman told authorities he acted alone and did not inform his wife and five children, who have not been charged in the attack but were taken into custody Tuesday by immigration officials. The following day a judge granted a request to block their deportation. Attorneys for the family had sued over their detention, writing in their complaint that "It is patently unlawful to punish individuals for the crimes of their relatives." Department of Homeland Security Assistant Secretary Tricia McLaughlin called the plaintiff’s claims "absurd" and "an attempt to delay justice." She said the entire family was living in the US illegally. When asked whether Soliman’s family was under investigation, Dougherty, the district attorney, did not give a clear answer and said the investigation was ongoing. Soliman’s wife, Hayam El Gamal, a 17-year-old daughter, two minor sons and two minor daughters were being held at an immigration detention center in Texas, said Eric Lee, an attorney representing the family. El Gamal said she was "shocked" to learn of his arrest, according to the lawsuit. THE FAMILY’S IMMIGRATION STATUS Before moving to Colorado Springs three years ago, Soliman spent 17 years in Kuwait, according to court documents. He arrived in the US in August 2022 on a tourist visa that expired in February 2023, McLaughlin said in a post on the social platform X. She said he filed for asylum in September 2022 and was granted a work authorization in March 2023, but that has also expired. Hundreds of thousands of people overstay their visas each year in the United States, according to Department of Homeland Security reports. Soliman’s wife is an Egyptian national, according to her lawsuit. She is a network engineer and has a pending EB-2 visa, which is available to professionals with advanced degrees, the suit said. She and her children all are listed as dependents on Soliman’s asylum application. Oh well. Too late for that now. A VIGIL FOR THE VICTIMSHundreds of people squeezed into the Jewish Community Center in Boulder for a vigil Wednesday evening that featured prayer, singing and emotional testimony from a victim and witnesses of the the attack. Rachelle Halpern, who was part of the demonstration Sunday, recalled thinking it was strange to see a man with a canister looking like he was going to spray pesticide on the grass. Then she heard a crash and screams and saw flames around her feet. "A woman stood one foot behind me, engulfed in flames from head to toe, lying on the ground with her husband," Halpern said. "People immediately, three or four men immediately rushed to her to smother the flames." Her description prompted murmurs from the audience. One woman’s head dropped into her hands. "I heard a loud noise, and the back of my legs burning, and don’t remember those next few moments," one victim, who did not want to be identified and spoke off camera, said over the event’s speakers. "Even as I was watching it unfold before my eyes, even then, it didn’t seem real." Soliman told authorities that no one, including his family, knew about his plans for the attack, according to court documents that, at times, spelled his name as "Mohammed." Soliman was born in el-Motamedia, an Egyptian farming village in the Nile Delta province of Gharbia that's located about 120 kilometers (75 miles) north of Cairo, according to an Egyptian security official who spoke on the condition of anonymity because he wasn't authorized to talk to the media. Soliman was also a handball player for a club in Cairo, the club's former chairman wrote on Facebook. Witnesses and police have said Soliman threw two incendiary devices, catching himself on fire as he hurled the second. Soliman took off his shirt and what appeared to be a bulletproof vest before police arrived and arrested him, said witness Alex Osante of San Diego. Solimon told authorities he had gas in a backpack sprayer but didn't spray it on anyone but himself because "he had planned on dying," officials said.
