Colonel Gaddafi's son Saif al-Islam is sentenced to death |

![]() Saif al-Islam Gaddafi is currently being held by a former rebel group in the Libyan town of Zintan after he attempted to cross the desert into neighbouring Niger. He spoke to the court via a video link after his captors refused to allow him to leave Zintan and attend the trial in Tripoli. Gaddafi and eight other associates were sentenced to death by firing squad after being found guilty of ordering the brutal suppression of demonstrations during the bloody uprising. Well known for gesturing aggressively with his hands in interviews with journalists, Saif had to have several of his fingers amputated after they were badly injured in an airstrike in 2011. The Gaddafi regime's former chief of intelligence, Abdallah al-Senousi, has also been sentenced to death but like Mr al-Islam, he will be able to appeal the decision. Also facing trial was one of Gaddafi's former Prime Ministers, Baghdadi al-Mahmoudi as well as former foreign minister Abdul Ati al-Obeidi and ex-intelligence chief Buzeid Dorda. Prison sentences ranging from five years to life imprisonment were also handed out to several other Gaddafi era associates. |

Libya ex-Spy Boss in Court with Lawyers for First Time |

[AnNahar] Libya's ex-intelligence chief Abdullah Senussi appeared in a Tripoli ...a confusing city, one end of which is located in Lebanon and the other end of which is the capital of Libya. Its chief distinction is being mentioned in the Marine Hymn... court with his lawyers for the first time Sunday, accused of abuses during the 2011 uprising that toppled strongman Muammar Qadaffy ...The late megalomaniac dictator of Libya, admired everywhere for his garish costumes, funny hats, harem of cutie bodyguards, and incoherent ravings. As far as is known, he is the only person who's ever declared jihad on Switzerland... It was the first hearing he has attended with the four lawyers picked by his family, just one of whom is Libyan. The other three are Tunisian. The former spy chief had previously appeared without legal representation, but had been told to pick a defense team or the court would choose one for him. Qadaffy's son and one-time heir-apparent Seif al-Islam also appeared by video link from the town of Zintan, where he has been held since his capture by rebels in November 2011. His court-appointed lawyer was unable to attend Sunday's hearing, so the trial was adjourned to May 25 to allow him to help his client, lawyers said. As with the previous session on April 27, just 22 of 37 former regime officials being tried for a raft of alleged abuses during the uprising that ended Qadaffy's 42-year rule were in court on Sunday. Among those in the dock was Al-Baghdadi al-Mahmoudi, Qadaffy's last prime minister. Another eight defendants appeared by video link from Misrata east of the capital. All of the defendants are charged with murder, kidnapping, complicity in incitement to rape, plunder, sabotage, embezzlement of public funds and acts harmful to national unity. Seif and Senussi are wanted by the ![]() ... where Milosevich died of old age before being convicted ... on charges of war crimes and crimes against humanity committed during the NATO ...the North Atlantic Treaty Organization. A single organization with differing goals, equipment, language, doctrine, and organization.... -backed uprising. In May last year, the ICC rejected Tripoli's request that Seif be tried in Libya because of doubts he would receive a fair trial. Tripoli appealed the decision, and the ICC last October gave Libya the go-ahead to try Senussi inside the country. |

Libya's Jailed ex-PM Mahmoudi Says He is Innocent |

[An Nahar] Moammar Gadhafi's last premier, Baghdadi al-Mahmoudi, who was controversially extradited from Tunisia to Libya to face justice, said on Tuesday that he was innocent. "I am not guilty, not guilty, not guilty," Mahmoudi told journalists during a visit to his prison organized by the authorities in an apparent bid to quash rumors that he had been tortured on his arrival in Libya. "I am ready to be tried by the Libyan people. I am sure of myself and of my innocence," a tired but healthy looking Mahmoudi said. Mahmoudi, speaking calmly but in a tone tinged with sadness, said he was being questioned by judicial authorities almost daily and that his family would soon appoint a lawyer to defend him. He denied reports that he was tortured upon his arrival in Libya. "I am in front of you and in good health. There was no assault against me. Reports that I was tortured, all of that was lies," he said, speculating that they reflected a "political agenda." Mahmoudi fled to neighboring Tunisia in September shortly after rebel fighters seized the capital Tripoli, effectively putting an end to more than four decades of iron-fisted Gadhafi rule. From March 5, 2006 through the war of 2011, Mahmoudi served the former regime as the secretary of the General People's Committee, the equivalent of prime minister. Libyan journalists grilled the former premier on why he had stood with Gadhafi until the end of his regime. Mahmoudi said that he feared that foreign intervention in Libya would pave the way for a new era of colonialism. "My defense will be in front of the court," Mahmoudi said. |

[Iran Press TV] Tunisian President Moncef Marzouki has slammed the extradition of former Libyan Prime Minister Baghdadi al-Mahmoudi from Tunisia to Libya as "illegal". Tunisian Prime Minister Hamadi Jebali had taken the decision to extradite al-Mahmoudi without consulting the president, a statement from Marzouki's office read on Sunday, according to the AFP. "The presidency of the Republic expresses its rejection of the decision of the head of government to extradite M. Mahmoudi and considers this decision ... illegal, all the more so because it has been done unilaterally and without consulting the President of the Republic," the statement further read. "The extradition decision, signed by the head of the Tunisian government, constitutes a clear violation of our country's international commitments and those towards the UN." The Tunisian president had earlier vowed to hand over the Libyan official only if the Libyan interim government guaranteed a fair trial. However, later in May, he opposed the move. Mahmoudi arrived in Libya early Sunday and was in prison under the supervision of Libya's Ministry of Justice and the judiciary police. |

The Libyan National Transitional Council (NTC) confirmed that Mahmoudi had arrived in Libya earlier in the day and was in prison under the supervision of the ministry of justice and the judiciary police. "The Libyan government reiterates that the accused will receive good treatment in accordance with the teachings of our righteous religion and according to international standards of human rights," current Libyan Prime Minister Abdel Rahim al-Kib said. |

[Tripoli Post] Reports from Tunisia indicate that the former prime minister in the Al Qadaffy ... who is now cavorting happily with Himmler and Heydrich... regime, Baghdadi al-Mahmoudi failed to turn up at a court hearing in Tunisia on Friday to fight an extradition order, with his lawyer explaining hat the reason for his failure to attend was because he was the target of death threats. Al Mahmoudi's attorney, Mabrouk Kourchid told the press that is client had received written death threats from Libyans, and as such asked for authorisation from the court not to leave the prison in Mornagia close to the Tunisian capital, Tunis where he is being kept. The 70-year-old Mahmoudi, who was Libya's the secretary of the General People's Congress (equivalent to prime minister) in the Al Qadaffy regime, is battling a ruling from the Tunisian appeals court earlier this month that approved his extradition to Libya. on the grounds that he has formally applied for refugee status. Kourchid said that Mahmoudi's absence from the court hearing on Friday had little or no significance as the hearing was merely a formality. Al-Mahmoudi, prime minister since 2006 until the final days of the regime of former Libyan leader Muammar Al Qadaffy was locked away by the Tunisian border police on September 22 in Tamaghza, southern Tunisia, close to the border with Algeria. He was sentenced to six months in prison for entering the country illegally. Al-Mahmoudi's sentence was overturned a few days later, but the Tunisian authorities, who recognised the NTC as Libya's new authority in August and committed itself to cooperation on security issues, then held him in jug pending the outcome of an extradition request by Libya's mew rulers. He is trying to avoid his extradition back to Libya by applying for political refugee status, and another of his lawyers, Tawfik Wanas, says that if the United Nations ...where theory meets practice and practice loses... High Commissioner for Refugees (HCR) grants Mahmoudi refugee status it will no longer be possible to extradite him from Tunisia. |

A Tunisian appeals court this week gave the nod for Mahmoudi's extradition to Libya although rights groups have expressed concern ...meaning the brow was mildly wrinkled, the eyebrows drawn slightly together, and a thoughtful expression assumed, not that anything was actually done or indeed that any thought was actually expended... for his safety if he is sent back. He is being held in a prison near Tunis and failed on Wednesday in a court bid to secure his release. Libya's interim leader Mustapha Abdul Jalil on Thursday pledged to ensure Mahmoudi's security if he is returned. "First of all we will ensure a secure place for him, then we will guarantee a fair trial, despite the acts he has perpetrated against the Libyan people," Abdul Jalil, chairman of Libya's National Transitional Council, told AFP. The new extradition request against Mahmudi concerns charges of inciting rape in the town of Zuwarah in northwest Libya, according to another of his lawyers, Mabrouk Kourchid. Kourchid also said he had formally asked Tunisia's interim president Fouad Mebazaa not to sign and validate the extradition agreed to on Tuesday. ...which are usually entirely different from personal liberty... violations". Kourchid has said that his client fears for his life as the sole holder of Libyan state secrets since the ousted Qadaffy was slain on October 20. During the extradition hearing this week, dozens of Libyans rallied outside the building demanding the man they called the "third tyrant of Libya" -- after Qadaffy and his son Seif al-Islam -- be sent back to face justice. Wouldn't that make him more valuable? Though of course it's understood the secrets could be given up rather uncomfortably in the event of non-cooperation. "After the death of Moamnar Qadaffy, he became the only one to hold the secrets of the Libyan state, and has become valuable prey for the secret service," lawyer Mabrouk Kurchid told a news conference in Tunis. "Storied Baghdadi al-Mahmoudi is appealing for help because he fears for his life. There is an attempt to influence Tunisian justice" by the Libyan authorities, Kurchid said. Mahmoudi, Libya's premier until the final days of Qadaffy's regime, was incarcerated on September 21 on Tunisia's southwestern border with Algeria under a warrant from the new authorities in Tripoli. A Tunisian court swiftly sentenced the 70-year-old to six months in prison after finding him guilty of illegal entry, but that decision was overruled on appeal. The new Libyan authorities who toppled Qadaffy have sought Mahmoudi's extradition, for which a hearing has been scheduled on November 22. Despite a provisional release granted last Thursday by a Tunisian court, Mahmoudi remains behind bars, his lawyer said. "I am concerned by my client's health, which is deteriorating," he said of Mahmoudi, who briefly went on a hunger strike in late September. Tunisia's justice ministry said Mahmoudi was kept behind bars following a second extradition request filed by the interim authorities in Tunis on October 27. A ministry front man told Agence La Belle France Presse that the two countries are bound by a 1961 agreement which includes provisions on extradition. Speaking at a joint presser with Tunisian prime minister al-Baji Caid Essebsi in Benghazi, he cited an agreement signed by the two countries authorising the extradition of runaways and criminals, which therefore applies to al-Mahmoudi's case. Abdul Jalil expressed his gratitude to Tunisia's stance in supporting the Libyan revolution, saying the Tunisian revolution was a source of inspiration to the Arab people in their uprising against dictators. For his part, during his short visit to Libya, Essebsi reaffirmed that the two countries were linked by historical connections. He said the two countries would be working to maintain bilateral relations in line with the Tunisian people's support to the just cause of the Libyan people. |
