Judge rules Montana law defining sex as only male or female is unconstitutional
[FoxNews] The judge 'apparently needs a dictionary to discern the difference between a noun and a verb,' a spokesman for Gov. Gianforte said

A judge ruled that a Montana law which defined "sex" in state law, when referring to a person as only male or female, was unconstitutional, saying that the law's description did not explicitly state its purpose.

District Court Judge Shane Vannatta struck down the 2023 law on Tuesday after a group of plaintiffs who identify as transgender, nonbinary, intersex and other identities sued, arguing the law denies legal recognition and protection to people who identify as gender-nonconforming, according to The Associated Press.

Vannatta did not address the claim of a lack of legal recognition and protection, but did say that the bill's title did not adequately explain whether the word "sex" referred to gender or sexual intercourse and that it did not indicate the words "male" and "female" would be defined in the body of the bill.

"The title does not give general notice of the character of the legislation in a way that guards against deceptive or misleading titles," Vannatta wrote.

#7  Last week during the weeklong heat wave a stretch of downtown expressway was abruptly closed so that a failed piece of pavement could be replaced. There was no explanation of exactly why that happened. I go over that stretch twice a day & it was fine up until the closure a few hours later. I think it was because of the sustained heat. Local officials said nothing about the cause. Patch was fully functional after the repaving.

Consider the impact, and simplicity, of simultaneous railroad locations at key choke points, like the Cajon Pass for example. And consider how simple to do so at remote, unobserved locations by small teams of imported military-aged men among the 8 million illegals over the past 3.6 years.

Curious idea, but since the days of intermediate warehousing of commodities like food have been replaced by "just-in-time" logistics and "retail swipe to production demand" at centralized production locations, widespread interdiction by key rail arterial routes could produce enormous impact and shortages, with consequent disruption and public unrest. Who might find that useful?

#11  To #6 - when rails were jointed every 39', expansion and contraction of the steel took place in the joints. When the joints were eliminated, with welded rail, the changes in rail length are restrained, so instead of movement, you get stress in the rail (50-60,000 psi, IIRC).

Ties and ballast are the restraint; too much (hot) stress leads to a track buckle and a derailment. Excessive cold stress leads to a 'pull-apart' which does not always lead to a derailment, since the rail alignment is maintained.

Requirements are well-understood in the business, but mistakes happen in rail installation or track maintenance. Extreme weather highlights the 'mistakes'.

SCOTUS Hands DOJ another J6 Loss
[Townhall] In a 6-3 opinion, the Supreme Court handed down a massive blow to federal prosecutors, concluding, per SCOTUS Blog’s Amy Howe, that for the statute to be used in this way, there must be evidence to the fact that "the defendant impaired the availability or integrity for use in an official proceeding of records." In a blow to the narrative that the Supreme Court is rogue and right-wing, Justice Ketanji Brown Jackson joined the majority. Justice Amy Coney Barrett dissented.

The question before the court was whether the "obstruction of an official proceeding" statute could be used in how the Justice Department weaponized it to go after hundreds of January 6 defendants. The plaintiff, Joseph Fischer, a former police officer, argued that the statute only pertained to evidence tampering in a congressional investigation.

The court reverses the D.C. Circuit, which had adopted a broader reading of the law to allow the charges against Fischer to go forward. The case now goes back to the D.C. Circuit -- which, the court says, can assess whether the indictment can still stand in light of this new and narrower interpretation.

The former spies, whose letter was drafted specifically to give Biden, now 81, a "talking point" at the second and final debate of the 2020 campaign, said they merely suggested that files from Hunter’s hard drive were bogus, but didn’t assert it as a fact — days after bombshell reports by The Post showed the elder Biden was involved in his family’s Chinese and Ukrainian business relationships.

SCOTUS overturns Chevron - Delivers a Kill Shot to Big Government
[PJ] Also overturned J6 Obstruction Law use. Presidential Immunity decision on Monday
Today, the Supreme Court ruled to overrule the so-called Chevron deference in a 6-3 decision. The ruling is a HUGE victory for those who hate the massive power the administrative state has amassed in recent decades.

Chief Justice John Roberts, writing for the majority, concluded: "Chevron is overruled."

In the most basic terms, the Chevron deference (also called the Chevron doctrine) allows the courts, through a two-step process, to defer to "reasonable" administrative agency interpretations if a federal statute is unclear or ambiguous. It was/is essentially a get-out-of-jail-free card for presidents and agency hacks who liked to claim that a law says whatever they want it to say. It gave federal agencies broad authority to regulate everything from health care to immigration to women's sports to Covid jabs.

According to Ballotpedia:

The principle derives its name from the 1984 U.S. Supreme Court case Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc. which concerned disagreement over a change in the Environmental Protection Agency's interpretation of a permitting provision of the Clean Air Act of 1977. The case established a two-step review approach used by courts to analyze an agency's legal interpretations. Under the review process, courts consider (1) Congress' clear intent in passing a law and (2) (if the court finds ambiguities in the law) whether an agency's rule was reasonably construed and not arbitrary, capricious, or manifestly contrary to the statute.

Amy Howe at SCOTUSblog wrote:

Chevron, Roberts explains, [Chevron] "defies the command of" the Administrative Procedure Act, the law governing federal administrative agencies, "that the reviewing court--not the agency whose action it reviews--is to decide all relevant questions of law and interpret ... statutory provisions. It requires a court to ignore, not follow, the reading the court would have reached had it exercised its independent judgment as required by the APA."

Chevron's presumption that statutory ambiguities are implicit delegations of authority by Congress to federal agencies "is misguided," Roberts explains, "because agencies have no special competence in resolving statutory ambiguities. Courts do."

Roberts notes that today's decision does "not call into question prior cases that relied on the Chevron framework. The holdings of those cases that specific agency actions are lawful--including the Clean Air Act holding of Chevron itself--are still subject to statutory stare decisis despite our change in interpretive methodology."

The high court had consolidated two cases—Loper Bright Enterprises v. Raimondo and Relentless, Inc. v. Department of Commerce—and heard oral arguments in January of this year.

Howe reports, "The vote is 6-3 (although 6-2 in Loper-Bright because Jackson is recused). Kagan dissents, joined by Sotomayor and Jackson as it applies to Relentless, from which she is not recused."

Both cases concern the National Marine Fisheries Services (NMFS) interpretation of a federal fishing law (George W. Bush's Magnuson-Stevens Act) requiring government monitors to accompany certain fishing boats. At issue: Who would pay for the monitors—the agency requiring them or the fishermen themselves? The statute is unclear on that point, and using the Chevron deference, the lower court ruled that the NMFS had the right to require the fishermen to pay for the $700-a-day monitors on trips that often last several days.

After losing at the U.S. Court of Appeals for the District of Columbia, the plaintiffs argued before the Supreme Court that the lower court's decision “perceives ambiguity in statutory silence, where the logical explanation for the statutory silence is that Congress did not intend to grant the agency such a dangerous and uncabined authority.” They added, "Whether by clarifying Chevron or overruling it, this Court should grant review and reverse the clear agency overreach at issue here."

Most of us learned in school (I hope!) that the judicial branch interprets the law. It's explained in both Marbury v. Madison and Alexander Hamilton's Federalist 78. The Chevron doctrine takes some of that power to interpret from the courts and hands it to unelected bureaucrats. The word "deference" in Chevron means that the court defers rulemaking to "experts" in the administrative state.

#8  Well it must be said that a lot of the underlying problem is that some legislation is written poorly (maybe poorly on purpose). Also, there are laws where previous judicial decisions have made the law incomprehensible.

The Chevron decision, made in 1984, was on such a case where the issue was what was a 'source' of pollution for the purpose of requiring a lengthy govt review. Chevron argued it was only a 'source' if it was a new or rebuilt facility. An environmental org said it was a source even if Chevron did a minimal alteration of the source. The EPA (this was in 1984 under Reagan) argued for Chevron's position and the SCOTUS agreed.

Biden Lies in Debate, Says No US Troops Killed During His Presidency
[THEGATEWAYPUNDIT] Thirteen U.S. troops were killed in a terrorist attack at the Kabul airport during Biden’s disastrous retreat from Afghanistan in August 2021. Three U.S. troops from a guard uniy in Georgia were killed in a terrorist attack in Syria in just six months ago.

Biden said at the debate, "The notion that we were this safe country. The truth is I’m the only president this century that doesn’t have any, this, this decade, that doesn’t (have) any troops dying anywhere in the world like he did."

Biden was confronted by Steve Nikoui, the Gold Star father of Marine Lance Cpl. Kareem M. Nikoui who was killed in the 2021 Kabul airport attack, during the State of the Union last March.

The names of the U.S. troops killed in the attack (via the Guardian):

Eleven US marines, one solder and one sailor were lost in the country’s deadliest day in Afghanistan in a decade.

The marines were: S Sgt Darin T Hoover, 31, of Salt Lake City, Utah; Sgt Johanny Rosariopichardo, 25, of Lawrence, Massachusetts; Sgt Nicole L Gee, 23, of Sacramento, Caliphornia, an impregnable bastion of the Democratic Party,; Cpl Hunter Lopez, 22, of Indio, California; Cpl Daegan W Page, 23, of Omaha, Nebraska; Cpl Humberto A Sanchez, 22, of Logansport, Indiana; L/Cpl David L Espinoza, 20, of Rio Bravo, Texas; L/Cpl Jared M Schmitz, 20, of St Charles, Missouri; L/Cpl Rylee J McCollum, 20, of Jackson, Wyoming; L/Cpl Dylan R Merola, 20, of Rancho Cucamonga, California; and L/Cpl Kareem M Nikoui, 20, of Norco, California.

The sailor who was killed was Navy Hospitalman Maxton W Soviak, 22, of Berlin Heights, Ohio.

The soldier was SSgt Ryan C Knauss, 23, of Corryton, Tennessee.

Excerpt from the Department of Defense statement on the deadly attack in Syria January 28, 2024:

Three U.S. soldiers were killed yesterday in Jordan, while more than 40 other service members were maimed following an uncrewed aerial system attack at a military base near the Syrian border. Those service members were in Jordan to support Operation Inherent Resolve, which is the U.S. and coalition mission to ensure the defeat of ISIS.

The three soldiers killed are Sgt. William Jerome Rivers of Carrollton, Georgia; Spc. Kennedy Ladon Sanders of Waycross, Georgia; and Spc. Breonna Alexsondria Moffett of Savannah, Georgia. All three were assigned to the 718th Engineer Company, 926th Engineer Battalion, 926th Engineer Brigade, Fort Moore, Georgia.

The attack occurred in the early morning at the logistics support base located at Tower 22 of the Jordanian Defense Network. Approximately 350 U.S. Army and Air Force personnel are deployed to the base. The three soldiers were killed when a one-way uncrewed aerial system impacted their container housing units.
