[NYT] When his convoy was ambushed during the 2003 invasion of Iraq, First Lt. Brian Chontosh ordered his Humvee driver to head straight into the oncoming machine gun fire. They punched through, landing in a trench full of heavily armed Iraqi soldiers. Lieutenant Chontosh and his Marines leapt out and he ran down the trench firing away, dropping one enemy soldier after another. First his rifle jammed, then he ran out of ammunition, so he switched to his pistol. He shot it dry, reloaded, and shot it dry again. So he picked up an AK-47 from a dead Iraqi, fired that dry, picked up another AK, fired that dry, picked up a rocket-propelled grenade, fired it, and led the group back to the Humvee, their attack having almost completely cleared the trench. Almost.
One Iraqi was playing dead, fiddling with the pin of a grenade. Lieutenant Chontosh had no ammo, but on the ground were a couple of M-16 rounds from when his rifle had jammed. He grabbed one, loaded, and before the Iraqi could pull the pin, Lieutenant Chontosh locked eyes with him and shot him dead. All told, according to the journalist Phil Zabriskie’s account of the ambush in "The Kill Switch," Lieutenant Chontosh had killed about two dozen people that day.

So President Trump, charitably speaking, mischaracterizes the facts and then goes on to make false allegations about the media. Then a news organization (also charitably speaking) calls out the the WH on said falsehoods. And right que the Trump propaganda sites come out swinging calling it fake news. How come no-one is accusing NSA Director Michael Flynn of taking bribes from Turkey's dictator Recep Erdogan? Not long ago, they did. Last November 18, Commentary Magazine's Noah Rothman called Flynn a "dubious choice" for the National Security Council because his consulting company had a Turkish client, adding that Flynn’s views on Turkey raised a "conflict of interest." Flynn had published an article in The Hill on Nov. 8 warning that America's dalliance with the messianic Turkish Islamist and alleged coup plotter Fetullah Guelen might undermine the country's relationship with NATO, at a time when Russia was giving Turkey the full court press.

Author Spengler nailed it, dead on. Flynn refused to be a Klingon surrogate at DIA like his lap-dog predecessors. There were other issues at DIA as well (not found in this article) dealing with DIA's clandestine collection capabilities. Klingon turf issues as it were. The new Director Mike Pompeo has his hands full.

Nope, their budget is completely reportable to OMB and the Prez. If Trump keeps Flynn, then they will identify and delete these problems in the next budget.

[Townhall] Read the judicial rules for radicals issued by the United States Court Of Appeals for the Ninth Circuit, in affirmation of the ban on The Ban.
It follows the Executive Order issued by President Donald Trump, with the imprimatur of 62 million voters, to protect the nation from foreign terrorists entering into the United States. Two states objected to the president's undeniably badly written Order, which, while upholding negative rights--and neither denying natural rights nor minting positive ones--was nevertheless replete with administrative errors.
Acting as coequal partners in the administrative tyranny the president is trying to break, the two states issued a temporary restraining order against "Protecting the Nation from Foreign Terrorist Entry into the United States." (I can already hear the election midterm ads.)
In the corner for the Deplorables was a government lawyer. August Flentje Esq. had "argued" (if you can call it that) for an emergency stay of the Washington State district court’s temporary restraining order against the president. The three Ninth Circuit jurists who heard the case said no.

[DailyHeadlines] Liberals and illegal aliens as well as jihadists are cheering the ruling from the Ninth Circus Court of Appeals. This is not surprising considering the fact that liberals never anticipate the consequences of their actions. This one could bite them in the ass.
In order to stop President Trump’s travel ban, the court had to rule that the president does not have the power to decide on who can and can’t get into the country and who can and cannot stay. They ruled that Trump does not have that power. But if Trump doesn’t have that power, neither did Barack Obama, meaning all of his various amnesty Executive Orders are null and void. Say, for instance DACA for the so called Dreamers.
Obama had the Dreamers register which is convenient because they will be easy to find and deport and if they are still living with their parents, the parents can be deported, too. The work permits given to other illegal aliens will also become vulnerable and there is a database on them also. All it would take is an EO from President Trump to that effect.
The more likely scenario if Trump and his administration were to go that way would be for the Supreme Court to agree to an emergency hearing based on the fact that the actions allowed by the 9th would be irreversible. At that point, one of two things would happen. Either the liberal justices would have to reverse their positions on votes they took during the Obama caliphate that gave him sole responsibility in making immigration decisions or they would have to uphold their previous rulings, effectively killing the 9th Circuit’s ruling.
The thing that may shock you if you haven’t followed SCOTUS decisions closely is that while Ginsberg and Sotomayor would have no problem disregarding the law, the swing vote that could lead to a 5-3 ruling in the court is the Obama appointee, Elena Kagan, who has ruled against Obama in some cases. She votes liberal but seems to resist voting that way when it’s a direct violation of the law.
Look for Trump to do two things. He will dump the justice department lawyers who (intentionally?) blew the case before the 9th Circus Court by not giving the judges the 24 names of terrorists who came from the 7 countries under the travel ban. Secondly, he will have them petition SCOTUS to lift the stay imposed by the 9th.

Another possibility is Ginsburg having to recuse herself because of statements she made during the campaign that showed her disdain for President Trump.

Legal Insurrection says "This legal dispute no longer is just about the Executive Order. Democrats have made clear that they will fight in court over almost everything the Trump administration does. The 9th Circuit has opened the door to this tactic on an issue that goes to the core of presidential authority."
If the Courts are to designate themselves the functional directors of the Department of Homeland Security, then such mandate must come from the Supreme Court, not the 9th Circuit.
Better install Gorsuch ASAP and even at that SCOTUS decisions are iffy--Alito and Thomas are about the only votes you can count on to follow the Constitution.
