Court extends detention of ex-IDF top attorney to Wednesday, judge concerned she may obstruct probe

[Jpost] Tel Aviv Magistrate's Court Judge Shelly Kutin on Monday extended the detention of former IDF military advocate general Maj. Gen. (res.) Yifat Tomer Yerushalmi, until Wednesday, voiced concerns that she might obstruct the probe into the case against her.

Yerushalmi is being investigated for allegedly leaking a video relating to the Sde Teiman Palestinian prisoner abuse case, in a dramatic decision showing the continuing fall of one of the IDF's top officials until just days ago.

While the state prosecution had sought five additional days of detention to question Tomer-Yerushalmi regarding her role in the leak, her defense lawyers argued that five of the other suspects have already been questioned and that many of the text messages which incriminate her are already in the possession of the police when they seized those other suspects' phones.

Further, the defense lawyers argued that she has not tried to contact the other suspects to get them to obstruct the probe for over a week since her legal situation became clear to her, a sign that she will not do so going forward, which would support freeing her from detention.

However, the police pointed out that it is possible that all of the mysterious events surrounding her disappearance on Sunday night may have been an elaborate scheme to destroy her phone in the Mediterranean Sea, a major form of obstruction of the investigation.

The detention extension hearing for Tomer Yerushalmi also involves former chief military prosecutor Col. Matan Solomesh.

...Tomer-Yerushalmi is likely to be questioned on suspicion of obstructing an investigation, submitting a false document to the High Court of Justice, fraud and breach of trust, abuse of authority, and concealment of evidence.

Among other things, the two are accused of lying to two (consecutive) chiefs of staff and government ministers. There is also a chance to implicate Gali Baharav-Miara - Israel's answer to Ketanji Brown Jackson

Palestinian detainee at heart of Sde Teiman abuse scandal was released to Gaza in ceasefire deal
[IsraelTimes] The Palestinian security detainee at the center of the Sde Teiman abuse affair was released back to Gaza on October 13 in the framework of the ceasefire agreement between Israel and Hamas, lawyers for the defendants in the case announce.

The right-wing Honenu legal aid organization, which is representing two of the five defendants in the case, states that the Military Advocate General’s Office informed its attorneys today of the development.

“We call on the Military Advocate General’s Office to annul the indictments immediately,” says Honenu in response to the new information.

Five IDF reservists from the Force 100 Military Police unit were indicted in February this year on charges of causing severe injury, and assault under aggravated circumstances for their alleged role in the abuse of the Palestinian detainee which left him with broken ribs and a tear in his rectum.
