U-turn by Pak prosecutors in Mumbai terror case

(PTI) In yet another twist in the trial of seven Pak suspects linked to the Mumbai terror attacks, prosecutors have done a U-turn on a proposal to drop a legal move to get Ajmal Kasab and Fahim Ansari declared as "proclaimed offenders" or runaways.

The Federal Investigation Agency has decided to pursue a petition filed in the Lahore High Court to challenge an anti-terrorism court's decision not to declare Kasab and Ansari as runaways.

Prosecutors had recently told the anti-terrorism court, which is conducting the trial of the seven suspects, that they planned to withdraw the petition.

The High Court will take up the FIA's petition tomorrow, an official in the prosecution team said. "We have now decided not to withdraw the appeal," the official, who did not want to be named, told PTI.

Pakistan seeks India's help for Mumbai attacks trial

[Dawn] Islamabad on Saturday urged India to help find a way to progress the trial in Pakistain of seven suspects linked to the 2008 Mumbai attacks.

The suspects include the alleged criminal mastermind of the attack on India's financial capital, Zakiur Rehman Lakhvi, and Lashkar-e-Taiba (LeT) operative Zarar Shah.

The trial has almost stalled as New Delhi has refused to give the court access to lone surviving attacker Mohammad Ajmal Kasab --who is on death row in India --and Indian national Fahim Ansari, a conspirator.

An anti-terrorism court in Rawalpindi indicted the seven men on the eve of the first anniversary of the attack, which ended a fragile peace processor session with Pakistain.

But Pak officials have since implied that the trials cannot proceed unless Kasab, who was sentenced to death in Mumbai in May, is handed over as a witness.

Kasab was convicted on March 31 on charges including murder and waging war on India.

Pakistain interior minister Rehman Malik told reporters after meeting the Indian high commissioner and speaking to Indian Home Minister P. Chidambaram on the telephone: "The trial is stuck and actually we do not want to give an impression to the international community that perhaps it has been delayed.

"We proposed to India while talking to Mr Chidambaram that how about that we move our case to our trial court and request them to appoint a commission of relevant officials to record the statements of the witnesses," he said.

"And this has been happening in the past and so using that facility we request to the court and if they give permission, will they (India) be able to accept," Malik said. Chidambaram replied that "they will be considering it", Malik said.

Malik said he underlined the importance to the trial of Kasab and Ansari appearing in court in Pakistain.

Daily Jinnah wrote that PM Azad Kashmir Raja Farooq was being defiant (ankhain dikha rahe) against the very agencies who had helped him become prime minister of AJK. Raja Farooq had caused a feud between the Rajputs and others by inducting his Rajput relatives into institutions in his control and had been disloyal to the family of Sardar Qayyum of his party who had been his benefactors.

Sardar Farooq issued orders that a permit from the said agencies was not required.

Famous actress Nur was quoted by daily Pakistan as saying that she was seeking a divorce from his Hindu husband Vikram because he had gone back to being Hindu after marrying her on the pledge of remaining Muslim. She said now he was pressuring her to turn Hindu. She has claimed her big dowry back from him too.

Reported in Jang leader of Dobandi madrassa Faruqia in Uttar Pradesh Maulana Nurul Huda was in a plane in Deoband when he talked to someone in Arabic, saying the plane was about to take off, blow it up. A lady suiting next to him called the hostess and told her what he had said, after which he was taken off the plane for investigation. (In Urdu, ‘fly' and ‘explode' have the same meaning.)

According to Jang the Friday sermons in Lahore had the top clerics saying that Yuhood-o-Nasara could not be the friends of Muslims. Hafiz Said of Ahle Hadith Jamaatud Dawa at his Masjid Qadisiya said that the Prophet PBUH was the only superpower in the world, and the Jews and Christians were the enemies. The same message was given by Ahle Hadith leader Ibtisam Ilahi Zaheer. This was followed by Maulana Amjad Muhammad Amjad at Jamia Rehmaniya in Lahore.

The leader was also holding regular meetings with the terrorists in an under-construction madrassa in Ahmadpur Sial. Funds for the terrorists are being collected in Jhang and youths trained and sent out to commit terrorism

Head of the International Khatm-e-Nabuwwat Conference Sahibzada Zahid Mehmud Qasimi complained to daily Nawa-e-Waqt that after the government cancelled the Arabic compulsory course in schools, thousands of teachers of Arabic were without jobs. He said the religious parties were united but the political parties - although separated - were both hostile to the religious parties. He said Nawaz Sharif during his sojourn in Saudi Arabia had started learning Arabic.

Reported in daily Islam the TV anchor of a channel was holding discussions with Ahmadis and was asked to include the anti-Ahmadi clerics too. The TV anchor was Qadiani-pasand but when he got to know that a grand scholar of Khatm-e-Nabuwwat was on his to the studio he got cold feet and cancelled the show.

Farooq Haider and Manzur Wattoo

Writing in Jang Rauf Klassra stated the he saw two personalities during the last session of Prime Minister Gilani's Kashmir Committee session. Prime Minister of Azad Kashmir Raja Farooq Haider was sitting on a back seat while Minister for Kashmir Affairs Manzur Wattoo was right in front near PM Gilani. He was struck by the contrast: Farooq Haider was a fearless and upright man while Wattoo had, according to NAB earlier in the week, paid crores of rupees as fine to NAB to avoid being prosecuted for corruption.

Adviser sickens before advice

Famous columnist Haroon Rashid recorded in Jang that he had travelled all the way from Islamabad to Lahore to meet Chief Minister Shehbaz Sharif and was all ready to give his precious advice on how to run Punjab but suddenly he was taken ill (tabiyat biggar gai) and he excused himself and returned from Lahore without the valuable advice having been transmitted to Mr Sharif.

According to Jarrar, Lashkar Tayba terrorist undergoing trial in Pakistan Zakiur Rehman Lakhwi will be let off by the court because the Indian court had acquitted two Indian terrorists Fahim Ansari and Sabahuddin in the trial of Ajmal Kasab. (Lashkar Jhangvi terrorists Akram Lahori and Malik Ishaq are said to be all set to be released from jails in Pakistan.)

Surviving Mumbai gunman convicted over attacks

A Pakistani national has been convicted over his role in the deadly Mumbai (Bombay) attacks by an Indian court.

Mohammad Ajmal Amir Qasab, 22, the sole surviving gunman, was found guilty on charges including murder, waging war on India and possessing explosives.

The attacks in November 2008 left 174 people - including nine gunmen - dead, and soured ties between India and neighbouring Pakistan.

India blames Pakistan-based militants Lashkar-e-Taiba for the attacks.

After initial denials, Pakistan acknowledged that the attacks had been partially planned on its territory and that Qasab was one of its citizens.

Two Indian men - Fahim Ansari and Sabahuddin Ahmed - who were accused of helping the gunmen plan the attacks, were acquitted by the presiding judge at the court in Mumbai.

The judge will begin hearing arguments about sentencing on Tuesday. The prosecution is seeking the death penalty for Qasab.

Qasab's 271-day trial was conducted amid tight security in a purpose-built court on the jail premises in Mumbai where he was being held.

Closed-circuit TV evidence showed Kasab and an accomplice opening fire on passengers at one of Mumbai's busiest train stations, an assault that left dozens of people dead.

Over the past 14 months, the trial witnessed a number of twists and turns.

Qasab originally denied the charges against him but last July, in a dramatic outburst in court, he admitted his role and asked to be hanged. He later retracted this plea, saying he had been tortured by police into making it, and the trial continued.

In November, the main lawyer representing Qasab - who was arrested on the first day of the attacks - was removed from the case after the judge said he was delaying proceedings.

Late last year, Pakistan charged seven people in connection with the attacks, including the suspected mastermind Zaki-ur-Rehman Lakhvi, who is alleged to head Lashkar-e-Taiba.

Pakistan hands six dossiers to India over Mumbai attacks

ISLAMABAD: Pakistan on Sunday handed over to India six dossiers on its own investigation into the Mumbai attacks, with a request that India hand over Ajmal Kasab and an Indian national, Fahim Ansari so that their testimonies could be recorded in Pakistan. Top Foreign Office officials handed over the dossiers to the Indian deputy high commissioner, APP reported.
It seems to me India handed over the dossier of their interrogation of Mr. Kasab ages ago, along with what their investigation had revealed, and asked that certain individuals be turned over to them for trial. This sounds like a long-delayed tit for tat.
The government asked India to hand over the lone surviving gunman of the 2008 Mumbai attacks so that it could complete its own trial of seven suspects linked to the assault, officials said.

"We have sought India's help that he (Ajmal Kasab) should be handed over to us so that the trial here can go forward," Foreign Office spokesman Abdul Basit told AFP.

Islamabad is holding seven suspects linked to the November 26 to 29 attack on India's financial capital, including alleged mastermind of the operation, Zakiur Rehman Lakhvi, and Lashkar-e-Tayyaba (LT) operative Zarar Shah. India and Washington have both blamed the Mumbai attack on the LT.

Since the indictment, officials have implied that the seven suspects' trial cannot proceed unless Kasab, who was convicted in Mumbai last month after a year-long trial, is handed over as a witness.
If that ever happened, which it won't, the Pak courts would find something in his testimony to cause all defendants to be found innocent as the driven snow, at which time they'd be released, given some rehab, and be sent to Kashmir, to be shot in the back by their own people when they infiltrate the border, just to make sure they never blab.
When asked how India could extradite Kasab and Ansari to Pakistan, Basit replied, "It is not extradition per se. It is a legal requirement since the court has asked that Kasab be produced before it."

Interior Minister Rehman Malik has also said that Kasab is required to appear in Rawalpindi. "Kasab's statement is of paramount importance in the Mumbai attack case, which is an important document and our courts need it," APP quoted him as telling reporters late on Saturday.

Malik said India would also be requested to send to Rawalpindi the officials who recorded Kasab's statement in Mumbai.

Interpol notices sought against Kasab, Ansari

[Geo News] Pakistan has approached the Interpol on Saturday seeking Red Corner notices for arresting Ajmal Kasab and Fahim Ansari, currently undergoing trial in India. This was stated by Special Public Prosecutor Malik Rab Nawaz Moon as an anti-terrorism court conducting the trial of the seven 26/11 attack accused, adjourned the hearing in the case till April 17. During the proceedings, the prosecution said the government had been approached to ask Interpol to issue Red Corner notices for Ansari and Kasab.

Three suspected Mumbai lawyer killers arrested

[Dawn] Three men accused of killing the lawyer for a suspect in the 2008 Mumbai attack have been arrested, but their motive appears to be unrelated to the ongoing terror trial, police said on Tuesday.

Joint police commissioner Rakesh Maria said the men arrested late Monday were affiliated with an Indian gang. They are accused of murdering attorney Shahid Azmi on Feb. 11.

Maria said Azmi's death apparently had nothing to do with his representation of Fahim Ansari, who is accused of providing maps that helped 10 Pakistan-based gunmen carry out the November 2008 attack on Mumbai that left 166 dead.

Maria added that the motive is still under investigation.

The suspects -- Devendar Jagtap, Pintoo Devram Bhagal and Vinod Vichare -- are all Indian citizens working with underworld leader Chotta Rajan, an Indian now living in Malaysia, Maria said.

One suspect remains at large, he said.

Kasab requests trial by international court

[Dawn] Almost 11 months after he was picked up as the lone surviving militant for a horrific terror attack on Mumbai, Pakistani gunman Ajmal Kasab told the trial court on Monday that he had no faith in the Indian judiciary and asked for his case to be transferred to an international court, local reports said. But Judge M. L. Tahaliyani rejected 22-year-old Kasab's plea saying 'it is misconceived'.

'I have no faith in Indian court and this case may be transferred to an international court,' Kasab said in an application to the court. He had moved the application written in his own hand in Urdu. The application was filed through jail authorities who translated it into Marathi and produced before the court.

The judge asked Kasab whether he had written the application and he replied 'Ji huzoor' (Yes, Sir). The trial of Kasab, whom police formally charged in February with several offences including 'waging war' against India, began on March 23 via a video link with his Arthur Road prison in Mumbai.

In a separate development, the judge also rejected the plea of co-accused Fahim Ansari to stay the proceedings on the ground that he had filed a petition in the Bombay High Court seeking transfer of the 26/11 case to some other court alleging that the recording of evidence was incorrect.

'This is yet another attempt by the accused to delay the trial,' noted Judge Tahaliyani while rejecting Fahim's plea to stay the proceedings. 'Fahim is perhaps being instigated by outsiders,' the court noted. Fahim is facing the charge of conspiring with other accused in the terror attacks.

Police say they recovered maps of 26/11 terror locations which he allegedly handed over to LeT conspirators in Pakistan. The court has also issued contempt notice to Fahim asking him why contempt action should not be taken against him for making allegations against it in the application.

Meanwhile, disappointed at the Lahore High Court's decision to scrap terror cases against Jamaatud Dawa chief Hafiz Saeed, India said it would take up the issue with Pakistan as it was given to understand that formal investigation would be conducted against him.

Maintaining that Pakistan should investigate Hafiz Saeed in the Mumbai attack case, Indian Foreign Minister S. M. Krishna said India had provided evidence about his being the 'brain behind' the strike but he was not booked in that case.

'Our talks with Pakistan foreign minister was somewhat on this line that formal investigation would be done on Hafiz Saeed with reference to Mumbai,' Mr Krishna told reporters.

Pakistan 'not obliged' to arrest Hafiz Saeed: Malik

[Dawn] Pakistan has said that it is 'not obliged' to immediately arrest Lashkar-e-Tayyaba founder Hafiz Saeed even if an Interpol Red Corner notice has been issued against him and claimed that evidence provided by India in their three dossiers was 'not sufficient' to link him to the 26/11 attacks.
Nor will it ever be sufficient...
'Pakistan needs to examine the evidence provided by India on the basis of which Interpol issued a Red Corner notice against Hafiz Saeed. Certain procedures are required to pursue the notice,' Interior Minister Rahman Malik said.
"What procedures?"
"Certain procedures."

In an interview to Saudi Daily Arab News, Malik said even if a Red Corner notice has been issued against Saeed, the government was 'not obliged to immediately arrest him'.
"Maybe some day. But don't count on it too hard."
'We are free to make our own investigations against the man, and then take steps accordingly,' he said.

Malik claimed that the evidence provided by India in three dossiers 'is, in our considered view, not sufficient to link Hafiz Saeed to the (Mumbai) attack and to punish those who are guilty.'

'We appeal to India to share information with us, and also to keep faith in our legal system and judiciary,' he said and reiterated his claim that India could have averted the Mumbai attacks by sharing information with Pakistan. 'Let me tell you, India could have prevented the terror attacks in Mumbai if they had shared intelligence with us after the arrest of two terrorists - Fahim Ansari and Sabah Uddin,' he said.

Disabled by bullet, child points finger at Kasab

A 10-year-old girl permanently disabled by the bullets of Mohammed Ajmal Kasab today went up to the witness box and identified the Pakistani as the man who went on a killing spree at Chhatrapati Shivaji Terminus on 26/11.

Reprimanded repeatedly for grinning during court proceedings, Kasab looked subdued for the first time. He avoided any eye contact with the child on crutches — who told the court she wouldn’t lie after taking oath in God’s name — and her father, among the first witnesses to narrate what happened at the terminus, where the four-day terror attack began.

Kasab and his partner Ismail Khan, gunned down later that night, are accused of slaughtering at least 72 people, 58 of them at CST alone.

Devika Rotawan, daughter of small-time dry-fruit seller Natwarlal Rotawan, walked into the heavily fortified special court at Arthur Jail on crutches helped by her father and elder brother Jayesh, 12.

Dressed in a red-and-orange frock, Devika, whose right leg is part amputated due to the bullet injury, remained composed and confidently began narrating the sequence of events as she sat in the witness box.

On 26/11, the girl had accompanied her father and Jayesh to the station to catch a train to Pune, where her eldest brother Bharat lives.

Kasab’s lawyer Abbas Kazmi objected to the testimony of the girl, who was not listed as a witness earlier, saying it was an attempt by the prosecution to emotionally charge court proceedings.

Judge M.L. Tahaliyani overruled the objection, saying: “Devika is a natural witness and her account would be a true deposition of her experience.”

Before recording her testimony, Devika took the mandatory oath with Tahaliyani asking her if she understood what that meant. “What happens if you take an oath and lie?” the judge asked in Hindi. She replied, in Hindi, that it is sinful to take God’s oath and lie.

The young girl, who lives in a Bandra slum, narrated how they heard a loud explosion when they were in the main waiting hall and saw two gunmen fire indiscriminately.

“We were at VT (the old name of CST) station as we were going to meet Bharatbhai when we heard the noise. My father said we should leave and began running. My brother (Jayesh) ran in another direction. One of the bullets hit my right leg, and I do not remember what happened after that,” Devika said in Hindi.

Prosecutor Ujjwal Nikam then asked her if she could identify the gunman among the three accused: Kasab sat in a corner of the dock along with Fahim Ansari and Sabahuddin, accused of facilitating the attacks.

“Yeh is side mein baitha hai woh (He is sitting on this side),” a confident Devika said, pointing a finger at Kasab.

Kazmi objected to her testimony and accused her of deposing falsely.

Pat came Devika’s reply: “Bhagwan ki kasam kha kar main jhoot nahin bolti (I don’t lie after taking God’s oath).” Kazmi didn’t question her further.

Throughout Devika’s deposition, Kasab, wearing a grey T-shirt and blue track pants, remained seated with his head down. He did not look at either Devika or Natwarlal, whose testimony earlier brought out the pain of a helpless father.

The 45-year-old man narrated how he ran to safety clutching Devika, and later rushed her to adjacent St George’s and JJ hospitals.

With tears welling up, Natwarlal asked for Kasab to be hanged. “This scoundrel has shot my daughter, spoilt her life and killed so many others. Don’t keep him here. Hang him to death,” he screamed.

Judge Tahaliyani tried to calm Natwarlal, who, however, couldn’t control himself. “The bullet injury has broken my daughter’s leg. She can’t walk without crutches. Doesn’t Kasab have parents?” he asked, glaring and pointing at the gunman.

The prosecution also examined Farooqi Khaliluddin, who was injured in a grenade explosion at CST. “This tiny man was in a jovial mood while he fired,” said Khaliluddin, who, along with his son Razak, a medicine student in Moscow, received shrapnel injuries. Assistant police inspector Bharat Bhosale, who injured his hand during the CST firing, also deposed.

Qasab sentence could be as low as 3 years

[Iran Press TV Latest] An Indian court has demanded an inquiry to conclude whether the lone surviving gunman of Mumbai attacks, Ajmal Amir Qasab is of legal age to be prosecuted.

Judge ML Tahiliyani commissioned special public prosecutor Ujjwal Nikam to call on doctors and jailor to investigate Qasab's age. The court also ordered jail authorities to take Qasab for ossification test as well as dental test to determine his age.

The radiologist and dentist, who will conduct the tests, have been asked to submit their reports ahead of April 28.

Qasab will take the tests under heavy security, his defense attorney, Abbas Kamzi, said. Once the inquiry establishes Qasab as juvenile, then the case will be transferred to the juvenile court.

The lawyer outlined that the maximum punishment prescribed under Juvenile Justice Act is three years imprisonment.

The prime suspect in the Mumbai terror attacks case, Qasab, had earlier said that he was juvenile pushing for his case to be transferred to the Juvenile Justice Court. His plea was nonetheless turned down and it was declared that he did not appear to be juvenile.

Indian security forces apprehended Ajmal Amir Qasab on the first day of Mumbai terror attacks in November 2008. He has been in Indian custody ever since. The Pakistani national has been accused of murder and waging war on India.

Together with Qasab, two Indians, Fahim Ansari and Sabauddin Ahmed, are also on trial, charged with being members of the outlawed Lashkar-e-Taiba (leT) militant group and of spearheading the Mumbai attacks.

Relations between New Delhi and Islamabad have been tense since the death of over 170 people in last November's terror attacks on India's financial hub -- Mumbai.

India blamed banned Pakistan-based militants for the raids, alleging that the perpetrators were 'clients and creations' of the Pakistani Inter-Services Intelligence (ISI) -- an allegation Islamabad has frequently rejected.

The Mumbai crime branch has filed a long chargesheet in a Mumbai court but without any proof of involvement of ISI in Mumbai attacks. Mumbai's Joint Commissioner of Police Rakesh Maria told newsmen that investigations have not thrown up anything that could speak about the involvement of Pakistan's Inter-Services Intelligence agency. "It is an operation carried out by the LeT and we have not yet come across the involvement of ISI," he added. In a jam-packed court room, the Special public prosecutor Ujjwal Nikam informed the judge that some of the wanted accused have been arrested by Pakistan's Federal Investigation Agency. All 12 cases registered in the attack were clubbed as one in the chargesheet, which lists a total 2,202 witnesses. Meanwhile, the chargesheet proved local support to the attacks as Indian nationals Fahim, Sabahuddin provided marked maps, details to help terrorists to strikes. Fahim Ansari and Sabahuddin Mohammed along with Ajmal Kasab will face trial in the coming weeks in a special court set up inside the Arthur Road Jail in Mumbai. The trial into the 26/11 attack case will begin in the first week of March. Special Public Prosecutor Ujwal Nikam said "We would try to complete the trial within three to six months".
