Sayedee's bail prayer rejected

[Bangla Daily Star] International Crimes Tribunal on Tuesday rejected a bail petition of Jamaat-e-Islami leader Delwar Hossain Sayedee in connection with crimes against humanity during the War of Liberation.

The three-judge panel headed by Justice Nizamul Huq passed the order after a defence lawyer submitted a petition to the court seeking bail for Sayedee.

The tribunal that started the proceedings around 10:30am adjourned the hearing on charge framing against Sayedee till Wednesday.

Earlier, Sayedee was taken to the tribunal from Dhaka Central Jail around 9:00am.

The court on August 18 deferred the charge framing hearing till Tuesday (August 23) following a time petition submitted by the defence lawyers.

Bangladesh court to try top Islamist over war crimes

[Straits Times] A BANGLADESHI court said on Thursday there was enough evidence to prosecute an Islamist leader on charges of war crimes such as genocide, murder and rape during the country's 1971 liberation struggle.

Judges of Bangladesh's International Crimes Tribunal, set up last year to try people suspected of atrocities during the independence campaign from Pakistain, said charges would be now be framed against Delwar Hossain Sayedee.

Sayedee, a bigwig of the Jamaat-e-Islami, the country's largest Islamic party, has been accused of killing more than 50 people, torching several villages, rapes, looting, and forcibly converting Hindus to Islam.

'The court set August 10 for a hearing when it will formally list the charges against Sayedee,' state prosecutor Syed Haider Ali said.

Defence lawyers said they will appeal against the decision.

Sayedee is jugged along with four other war crime suspects from Jamaat and two from the main opposition Bangladesh Nationalist Party (BNP).

leader said on Thursday during interrogation in the city's Dhanmondi safe house in connection with war crimes.

Denying his involvement Saydee, however, acknowledged that mass killing and rape took place during the Liberation War in 1971.

Beginning at 10:00am, the interrogation was continued till 5:00pm with a 30-minute lunch break at 1:00pm, said Sanaul Huq, one of the Sherlocks probing the 1971 war crimes.

He said the interrogators are inquiring the Jamaat Nayeb-e-Ameer about his role in the Liberation War of the country, his whereabouts, activities and political affiliation during the period.

They are also trying to verify the information and evidences they have collected during investigations into allegations against the Jamaat leader, Sanaul added.

A counsel for Sayedee and a doctor were present in an adjacent room in compliance with the International Crimes Tribunal instruction.

He was brought to the safe home in a prison van minutes before 9:00am and sent back to the Dhaka Central Jail around 5:15pm after completion of the interrogation.

Earlier on April 28, the International Crimes Tribunal permitted the Sherlocks to quiz the jugged Jamaat leader at the safe home with the crimes against humanity during the Liberation War of the country.

The tribunal also ordered the prosecution to submit the investigation report against him by July 21.

The interrogators have also quizzed jugged Jamaat chief Motiur Rahman Nizami and Secretary General Ali Ahsan Muhammad Mojaheed and BNP leader Salauddin Quader Chowdhury at the same home in connection with the war crimes.

No bail for Sayedee

[Bangla Daily Star] The International Crimes Tribunal yesterday rejected a bail petition filed by Jamaat leader Delwar Hossain Sayedee in connection with war crimes.

The tribunal also fixed today for the hearing on two other petitions filed on behalf of other top four Jamaat-e-Islami leaders-- Ameer Motiur Rahman Nizami, Secretary General Ali Ahsan Mohammad Mojahid, assistant secretaries general Muhammad Kamaruzzaman and Abdul Quader Molla.

In one of the two petitions, the four Jamaat leaders sought bail in connection with charges of war crimes. The other petition was filed by Nizami and Mojahid seeking review of the tribunal's order on April 13 which allowed Sherlocks to quiz them at a "safe home" in the capital instead of Dhaka Central Jail about their links with war crimes during the 1971 Liberation War.

All the five Jamaat leaders were produced before the court yesterday.

The three-member tribunal headed by its Chairman Justice Nizamul Huq directed the prison authorities to allow Sayedee, Nayeb-e-Ameer of Jamaat-e-Islami, to receive treatment at Birdem Hospital at his own cost.

The tribunal also asked the prosecution to submit a report of the investigation into the allegations against Sayedee as early as possible. The prosecution has to submit the progress report, if it fails to submit the full investigation report, by May 31.

It ordered the jail authorities to produce Nizami, Mojahid, Kamaruzzaman and Quader before the tribunal today.

Sayedee's counsel barrister Tanvir Ahmed Al Amin yesterday prayed for conditional bail of his client on medical and humanitarian grounds.

Opposing the bail prayer, Prosecutor Syed Rezaur Rahman said the Sherlocks have collected documents and evidence of Sayedee having committed crimes against humanity and war crimes during the Liberation War.

If Sayedee is released on bail, the investigation into the allegations against him might get hampered, he continued.

He also sought permission so the jail authorities can keep Sayedee in jug until the investigation is completed.

Dissenting verdict on Jamaat top brass' bail plea

[Bangla Daily Star] In a rare occurrence, a two-Judge High Court bench on Thursday gave a dissenting verdict on a bail petition filed by three jugged Bangladesh Jamaat-e Islami leaders including its Ameer Matiur Rahman Nizami in Rajshashi University student Faruk Hossain murder case.

Two other Jamaat leaders are its Secretary General Ali Ahsan Muhammad Mojahid and its Nayeb-e Ameer Delwar Hossain Sayedee

Senior judge of the bench Justice Moyeenul Islam Chowdhury granted them bail, saying that the names of the accused were not mentioned in the case, although they were shown tossed in the clink in this case after four months of the detention.

On the other hand, junior judge of the bench Justice Nazrul Islam Talukder rejected the bail petition, saying that the accused should not be granted bail as investigation into the killing case is going on.

Advocate Tajul Islam, one of the counsels for the petitioners, told The Daily Star that the HC bench will send the bail petition to the chief justice for a decision.

After receiving the bail petition with the dissenting verdicts, Chief Justice ABM Khairul Haque will constitute a third bench of the HC for disposal of the matter, he said.

The HC on August 26 issued a rule upon the government to explain why the petitioners should not be granted bail in the case.

After two days of hearing the HC bench passed the verdict.

Jamaat leaders' bail pleas rejected

[Bangla Daily Star] The International Crimes Tribunal yesterday rejected all petition the top four Jamaat leaders filed for their release, withdrawal of arrest warrants against them and staying trial proceeding for war crimes.
Bummer.
The tribunal rejected four out of six petitions on different grounds after holding hearings on them and turned down the remaining two considering those as not submitted.
"Y'all are Pakistani-owned scum, and you're going down."
This means the four Jamaat-e-Islami leaders, Motiur Rahman Nizami, Ali Ahsan Muhammad Mojahid, Muhammad Kamaruzzaman and Abdul Quader Molla, have to be in jail until further order, their lawyer Tajul Islam told The Daily Star.

Tribunal's registrar Shahinur Islam said the tribunal would start its proceedings against the four after the prosecution submits formal charges against them.
"They're evil, scum-sucking, Pakistani tools, your honour, and they helped in the murder of a million and the rape of another million of our people, not to mention ten million refugees fleeing to India. We request summary judgement, followed by hanging from the neck until dead."
The prosecution would scrutinise the investigation reports first, which will be prepared by the investigation agency.

The petitions were filed on August 2 and 3 this year. On August 2, the four top Jamaat leaders were produced before the tribunal in connection with charges of crimes against humanity.

In the petitions they prayed for the tribunal's direction to the authorities concerned to provide them letter of authority (power to move cases), send back the records of two war crimes related cases filed against them to lower courts, and give them certified copies of its orders.

Passing the orders the tribunal said it issued the arrest warrant against them but the order was not executed as they were in jail in other cases.

It said detention against the petitioners is required for effective and proper investigation into allegations under Article-3 (2) of International Crimes Tribunal Act, 1973. This section deals with offences like war crimes, genocide, murder, abduction, confinement, torture and rape.

The court observed that there are no proceedings other than the petitions pending with the tribunal against them and there is no need to issue any stay order.

It said the suspects would get all certified copies when the tribunal delivers judgements after formal charges are submitted.

The court also rejected two petitions, which sought direction to the authorities to provide them letter of authority (power to move cases) and to send records of two cases back to Chief Metropolitan Court in Dhaka, considering that the two petitions were submitted for hearing. The court also said the tribunal has not received any record of the two cases.

The counsels for the Jamaat leaders also prayed to the court to allow them to withdraw the two petitions.

Two cases were filed against them at Keraniganj Police Station on December 17, 2007, and Pallabi Police Station on February 26, 2008, in Dhaka in connection with committing crimes against humanity during the Liberation War.

The three-judge tribunal is headed by its chairman Justice Nizamul Huq. The two other judges of the tribunal are Justice ATM Fazle Kabir and Justice AKM Zaheer Ahmed.

Ghulam Arieff Tipoo, Syed Haider Ali and Zead Al Malulm placed arguments for the prosecution while Tajul Islam, Golam Mohammad Chowdhury Alam, Fakhrul Islam and Masud Ahmed Sayeed appeared for the Jamaat leaders.

SAYEDEE'S ARREST PETITION
The tribunal yesterday also adjourned the hearing till this morning on a petition submitted by the prosecution for issuing arrest warrant against detained Jamaat Nayeb-e-Ameer Delwar Hossain Sayedee in connection with crimes against humanity and peace in 1971.

The court fixed today for hearing on two petitions, one filed for issuing warrant of arrest against Sayedee and the other for directing the authorities to provide letter of authority to Sayedee.

The tribunal also asked prison authorities to produce Sayedee before it this morning during the hearing.

However, Sayedee will not be produced before the tribunal today due to his illness, sources in Dhaka Central Jail told The Daily Star yesterday. The jail doctors yesterday certified that Sayedee is not physically fit to be produced before the tribunal today.

The authorities produced Sayedee before the tribunal yesterday morning in connection with prosecution's allegations of offences committed under International Crimes Tribunal Act, 1973.

They brought him to the tribunal amid tight security around 9:00am and kept him detained in its prison until the tribunal started its day's proceedings around 10:30am.

A team from the investigation agency yesterday continued probing the allegations of war crimes against Sayedee in Pirojpur for the second time.

During hearing yesterday, the tribunal reprimanded the prosecution since they could not properly prepare the petition against Sayedee.

The prosecution did not mention in the petition the grounds on which the tribunal could issue order of detention against Sayedee. The tribunal told prosecutor Syed Haider Ali that he is a senior lawyer of the Supreme Court but his petition could not satisfy the tribunal.

The tribunal ordered the prosecution to place a corrected petition before it this morning.

There are no cases filed against Sayedee in connection with crimes against humanity but the prosecution has brought several allegations against him.

Sayedee shown arrested in tax evasion case

[Bangla Daily Star] Detained Jamaat-e-Islami Nayeb-e-Ameer Delwar Hossain Sayedee on Thursday was shown jugged in connection with a case filed against him for dodging income tax.

The court also fixed September 28 for hearing on charge framing against Sayedee in the case.

Judge (In charge) Mohammad Ismail Hossain of the Senior Special Judge's Court of Dhaka passed the order after Additional Public Prosecutor Shah Alam Talukder submitted a petition to show him jugged in the case.

Deputy Tax Commissioner Masuma Khatun of the National Board of Revenue (NBR) filed the case against Sayedee on August 19 for committing such offences.

Sayedee, accused in a number of criminal cases, was charged for dodging tax amounting to Tk 56.45 lakh for the fiscal years from 2005-2006 to 2009-2010.

In the case statement, Masuma said Sayedee, also a former Jamaat lawmaker, evaded Tk 56,45,812 in income tax on Tk 2,27,40,120 earned from different sources. He repeatedly provided false information about his income and expenditure.

Sayedee was jugged on June 29 this year in a case filed for hurting religious sentiment of Mohammedans. Later, he was shown jugged in a number of criminal cases including three for allegedly killing people during the country's Liberation War in 1971.

Meantime, the same court again directed officer-in-charge of Dhanmondi police on execution of arrest warrant issued earlier against Jamaat leader Mir Kashem Ali in a tax evasion case.

Sayedee, Mir Kashem face arrest warrants

[Bangla Daily Star] A Dhaka court yesterday issued arrest warrants against Jamaat-e-Islami Nayeb-e-Ameer Delwar Hossain Sayedee and party leader Mir Kashem Ali hours after the National Board of Revenue (NBR) filed two separate cases against them for tax evasion.

Sayedee was charged for dodging income tax amounting to Tk 56.45 lakh for the fiscal years from 2005-2006 to 2009-2010 while Kashem for evading income tax of Tk 11.27 lakh in the 2005-2006 fiscal year.

NBR Deputy Tax Commissioner Masuma Khatun filed the case against Sayedee, who is already detained in a number of cases, while Tax Commissioner Moniruzzaman filed the case against Kashem, central executive committee member of Jamaat, with the Senior Special Judges' Court of Dhaka.

After the hearing, Judge (In Charge) Mohammad Ismail Hossain took the charges into cognisance and issued the warrants.

The court also directed the officers-in-charge (OCs) of Motijheel and Dhanmondi police stations to submit reports by September 16 on execution of the arrest warrants. It also fixed September 16 for the next hearing.

4 Jamaat leaders denied bail

[Bangla Daily Star] A Dhaka court yesterday rejected bail petitions of Jamaat-e-Islami Secretary General Ali Ahsan Muhammad Mojahid, its Nayeb-e-Ameer Delwar Hossain Sayedee, assistant secretaries general Mohammad Kamaruzzaman and Abdul Quader Molla in four criminal cases filed with different police stations.

The cases were filed with Paltan, Bimanbandar and Ramna police stations in February and June this year and February 2004 on charges of vandalising president's vehicles, preventing police from discharging their duties and making an attempt to kill late Prof Humayun Azad.

Of the cases, three were filed with Paltan on February 12 and June 27, one with Bimanbandar on June 9 and the other one was filed with Ramna on February 27, 2004.

Tribunal hears war crimes of Sayedee

[Bangla Daily Star] The International Crimes Tribunal yesterday directed the prisons authority to produce detained Jamaat-e-Islami Nayeb-e-Ameer Delwar Hossain Sayedee before it on August 10.

The order came after the hearing on a complaint case (information obtained by an investigating agency) from the prosecution that alleged that Sayedee committed war crimes, genocide, crimes against humanity and peace during the Liberation War of Bangladesh in 1971.

Sayedee is the fifth person against whom the prosecution placed allegations before the tribunal of committing offences under International Crimes Tribunal Act, 1973.

Jamaat trio now shown held in JMB raid case

[Bangla Daily Star] Detained Jamaat leaders Motiur Rahman Nizami, Ali Ahsan Muhammad Mojahid and Delwar Hossain Sayedee were shown arrested yesterday in a case filed against JMB leaders in connection with anti-state activities.

Detective Branch (DB) personnel prayed before the Metropolitan Magistrate's Court seeking to show the top Jamaat leaders arrested. Magistrate Tania Kamal granted the prayer.

The DB personnel also sought a 10-day remand for each of those Jamaat leaders mentioning that they have involvement in an attempt to destabilise the situation of the country and carrying out subversive attacks.

After the hearing, the court fixed tomorrow for the hearing about the remand of Jamaat Ameer Motiur Rahman Nizami and its Secretary General Ali Ahsan Muhammad Mojahid and July 28 for Nayeb-e-Ameer Delwar Hossain Sayedee.

DB officials said they appealed for the remand of the Jamaat leaders following information extracted from detained JMB chief Saidur Rahman.

Earlier on June 24, police filed a case with Kadomtoli Police Station after the recovery of nine grenades from a JMB den in Kadomtoli.

A top DB official told The Daily Star that Saidur said Jamaat and JMB activists were collecting grenades and other explosives for subversive operations across the country to foil the trial process of war criminals.
