NIA Court in Delhi orders attachment of Hurriyat office in Srinagar

[GREATERKASHMIR] A special court of the National Investigation Agency has ordered the attachment of the office of All Parties Hurriyat Conference situated at Rajbagh area in summer capital Srinagar.

Dot Com (KDC) reported that the order passed by the Additional Sessions Judge New Delhi Shalinder Malik has stated that "Immovable property i.e; building office of All Parties Hurriyat Conference at Rajbagh which was earlier used as office of APHC is ordered to be attached. In its application, the NIA claimed that there is sufficient evidence against Naeem Khan — the accused Hurriyat leader — who "partly owns the property".NIA has submitted in the court that the "property was being used for planning and execution of terrorist and secessionist activities" and for other offenses and thus invoked the provisions of Section 33 (1) of UAPA to seek attachment of the property."

In this case Nayeem Ahmad Khan was arrested during the investigation of this case on 24.07.2017 and was arraigned as accused no.5. Charge sheet filed against 12 accused persons so far in this case.

The NIA stated there is sufficient evidence in the form of documentary, electronic and oral to substantiate the charges framed against the accused Naeem Khan, it is prayed that the above said building which was being used by members of APHC for unlawful activities by A-5."They further stated that "Accused Nayeem Khan is a co-owner of that property and facing prosecution. There is an evidence that above mentioned immovable property was being used for planning and execution of terrorist and secessionist activities and for offences for which accused has already been charged, therefore above said property i.e. building/office of APIIC situated to Rajbagh Srinagar (UT of J&K) may be attached u/s 33(1) of UA(P) Act."

Citing several judgments, the court of Additional Sessions Judge New Delhi noted that section 24 expands the expression of the "proceeds of terrorism" and makes it clear that such expression shall also include "any property intended to be used for terrorism".

"APHC was the place where meetings were held to strategize different protests, funding activities of stone pelting on security forces, recruiting unemployed youths to carry out unlawful activities as well as terrorist activities to create an unrest in the erstwhile State of Jammu & Kashmir to wage war against the Government of India," were the major points that were noted by the Delhi court court.

State-run APP reported that since Thursday, India has arrested several prominent Islamic scholars, including Maulana Sarjan Barkati, Maulana Abdul Rasheed Dawoodi, Maulana Mushtaq Ahmed Veeri and Abdul Majeed Dar Almadni, and booked them under the Public Safety Act (PSA) in Kot Bhalwal Jail in Jammu.

The draconian PSA allows detention without charges for up to two years.

"This all is aimed to force Kashmiris to forsake their demand for freedom," APP quoted Mahmood Ahmad Sagar, convener of the All Parties Hurriyat Conference Azad Kashmir chapter, as saying.

The illegal detention of the Kashmiri Islamic scholars ... is yet another Indian attempt to rob the Kashmiri people of their distinct religious and cultural identity," the FO said in its statement.

It said that arrests under the draconian PSA were a "deplorable preemptive step" by Indian authorities planning to "illegally occupy" religiously significant waqf board properties.

"Apprehensive of widespread protests and unrest in the face of such a malicious move, these scholars have not only been unjustifiably arrested but shifted from [Indian-occupied] Kashmir to a prison in the Hindu-majority Jammu.

"These politically motivated arrests are clearly meant to stifle the voice of the Moslems of IoK and further marginalise them," the FO said.

It added that Pakistain called for the immediate release of the scholars and other illegally detained Kashmiri prisoners.

"We also urge the international community to take note of the dangerously growing trajectory of Islamophobia

In a report titled, "’We are being punished by the law’: Three years since of abrogation of Article 370 in Jammu & Kashmir", the human rights watchdog observed that in recent years, civil society members, journalists, lawyers and human rights defenders in the region had faced relentless interrogations, arbitrary travel bans, revolving door detentions, and repressive media policies.

Lawyers write to Registrar General HC to seek termination of Mian Qayoom's license under Advocate's Act

Greater Kashmir is in exclusive possession of a copy of the letter written by a group of lawyers seeking Advocate Qayoom’s immediate suspension and termination of licence under the Advocates Act and other relevant provisions of the law.

The group of six lawyers, in this letter to the Registrar General, has written, "Advocate Qayoom committed misconduct of a grave nature by declaring that he does not believe in the constitution of the country. Still, with his unlawful immunity, he with his nefarious character manages to remain on the rolls as a practising lawyer holding a licence issued under the Advocates Act of 1961, a statute created and emanating from our constitution."

A group of lawyers has also sent copies of the letter to the Chief Justice of India, Prime Minister of India, Union Law Minister, Chief Justice of J&K, Lt Governor J&K, Chairman Bar Council of India, and Chief Secretary of J&K.

The letter quotes the group of lawyers as saying, "Advocate Abdul Qayoom Dar alias Mian Abdul Qayoom internationally tried to malign the Indian state’s integration with Jammu and Kashmir by unlawful means to wage a war against the Indian state and to upkeep the narrative of Pakistain’s agenda using the platform of being a lawyer backed by the power of gun at the sole instance of ISI and Pakistain. This is even though he is using a bar enrolment with License No 472/1979, which ex-facia is a fake and fraudulent license or suspected to be procured by fraudulent means."

The letter of the group of lawyers states: "Advocate Qayoom a patriarch, an ideologue, and a frontline activist of the secessionist-terrorist campaign in J&K has gone all out to weaponise his professional position as a lawyer against the county in collusion with terror networks. He owes his ideological leanings originally to the radical outfit Jamaat-e-Islami

According to the contents of the letter, Advocate Qayoom was solely responsible for making the High Court Bar Association (HCBA) a constituent part of the All Parties Hurriyat Conference (APHC) and drafting the constitution of HCBA wherein it was provided in the aims and objectives to secure secession of J&K from the Union of India.

"He albeit practising the Indian law declared in the open court in 2010 that he does not believe in the Constitution of India which is the main source of all laws of the land. By deposing in a matter before the High Court at Srinagar on April 6, 2010, in Contempt Petition No 11/2010 (OWP No 767/2010) titled Bar Association versus Mirza Saleem Beigh and another of J&K and others, he said, ’I am not the citizen of India. I am a permanent resident of J&K State. I do not have faith in the Constitution of India as it has been eroded by you,’" the letter mentions Advocate Qayoom.

The letter also states, "Heading the legal cell established and funded by Pakistain’s ISI, he along with a battery of lawyers would plead and secure favourable decisions in all the cases about entities involved in terrorism and secessionism since 1990 funded by ISI. This gang of lawyers headed by him would also ensure that no one pleads on behalf of the State and government lawyers would most often resort to mere tokenism than actual pleading for fear of getting killed at the hands of turbans who would be so directed by Advocate Qayoom."

on Thursday appealed to the Indian government to let Moslem worshippers offer the important last Friday prayers of Ramazan — Jummat ul Vida — at Srinagar’s central Jama Masjid as per tradition, but there was no sign of New Delhi yielding.

"Given the worsening human rights and religious freedom situation for minorities and the Modi government’s lack of actions, it is important that USCIRF’s recommendation to include India to be a "Country of Particular Concern" (CPC) be accepted by Sec. of State Blinken," American Moslem Institution said in an appeal.

The group said it applauded the decision of USCIRF to designate India as a CPC country, given that "religious freedom conditions in India significantly worsened in 2021." It said systemic intimidation and violence has moved from the real world and has substantially increased online by "both official and non-state actors...to spread hatred and misinformation."

Furthermore, the Bharatiya Janata Party (BJP)-led "government, leaders emboldened Hindu-nationalist groups have advocated, instituted, and enforced sectarian policies seeking to establish India as an overtly Hindu state, contrary to India’s secular foundation and at grave danger to India’s religious minorities."

In Srinagar, APHC chairman Mirwaiz Umar Farooq, denounced the repeated closure of Srinagar’s central Jama Masjid by the Indian government.

"Not allowing congregational prayers on the occasion of Jumatul Vida at the central Jama mosque of the valley, which is thronged by lakhs of valley Moslems on this blessed day — when offering prayers at Jama Masjid has greater blessings for the namazis, is outrageous, and against the fundamental human right to religious practice."

The Mirwaiz said in a statement that the same holds true for barring people from praying at Jama Masjid on the holy occasion of Lailatul Qadr. APHC said that such orders against Moslems and circulars being issued by authorities in valley school asking the staff members not to wear hijab, "in a place where Islam is the religion of the vast majority is deeply distressing, causing great angst and hurt to people and further deepening the conflict."

The statement said Mirwaiz asked the authorities to revoke the ban on prayers and allow Moslems across the valley access to central Jama Masjid on these very important and holy days of Ramzan."

APHC said that, people as in the past, will observe Jumatul Vida as ’Youm e Quds’ and Youm e Kashmir’ to stress "the urgent need for a peaceful resolution of the lingering Paleostinian issue and the Kashmir conflict and the human lives they consume."

Masarat Alam will remain a non-starter in J&K thanks to Centre’s zero tolerance towards separatism

[OneIndia] Six days after the passing away of Syed Ali Shah Geelani, his protege, the notorious Masarat Alam was appointed his successor. Masarat Alam Bhat, who is in jail was appointed as the chairman of the All Parties Hurriyat Conference.

The APHC also appointed Shabir Ahmad Shah and Ghulam Ahmad Gulzar as vice chairmen. One of the key reasons behind appointed Alam as chairman is that he is a hardliner. He started off as a stone pelter and was later groomed by Geelani. He is said to have a good clout among the youth and could instigate violence in the Valley.

However the BJP led government in the Centre has a zero tolerance policy towards separatism and this has left these outfits redundant.

Senior Hurriyat leader Syed Ali Shah Geelani is no more

Senior separatist leader Syed Ali Shah Geelani passed away after a long illness in Srinagar on Wednesday night, reports said.

He was 92.

Reports said that Geelani breathed his last around 10:30 pm at his residence in Hyderpora in uptown Srinagar.

Geelani, who was suffering from multiple ailments, had been keeping unwell for the past many years.

Quoting sources, news agency KNO reported that Geelani developed serious complications on Wednesday afternoon. "He had chest congestion and breathing problems. He passed away at 10:30 PM," the report quoted the sources as having said.

Authorities imposed a security clampdown in Kashmir late Wednesday after the death of separatist icon Syed Ali Geelani at the age of 92.

Troops put up barbed wire and barricades on roads leading to Geelani's house in the main city of Srinagar after the family announced the death, news agency PTI reported.

Announcements were made from loudspeakers of the main mosque near Geelani's residence asking people to march towards the house.

But police said no one in the Kashmir valley would be allowed to leave their homes. Thousands of security forces were immediately deployed and mobile internet services were cut across the area.

Scores of armoured vehicles and trucks patrolled main roads in Srinagar.

The hardliner Islamist leader had resigned from politics and Hurriyat in 2020. His exit comes after he had headed it for 17 years.

Several Kashmiri political leaders have blamed Geelani for the rise in militancy and bloodshed in Kashmir. The Hurriyat leader has called for numerous general strikes or shutdowns, in response to the deaths of unnamed suspected militants, local militants and death of civilians in Kashmir.

Reportedly, Geelani calls Islamist leader and founder of the Jamaat-e-Islami, Abul A'la Maududi as his mentor.

Syed Ali Geelani was born in a town Sopore Baramulla, North Kashmir, on 29 September 1929, was viewed as a key separatist leader in Kashmir.

He was previously a member of Jamaat-e-Islami Kashmir but later on founded Tehreek-e-Hurriyat. He has served as the chairman of All Parties Hurriyat Conference, a conglomerate of pro separatist parties in Jammu and Kashmir. He was an MLA from the Sopore constituency of Jammu and Kashmir in 1972, 1977 and in 1987.

Afridi directs PTA to take action against Facebook's approach towards Pakistani, Kashmiri activists

Chairman Sheharyar Khan Afridi on Thursday directed the Pakistain Telecommunications Authority (PTA) chairman to take cognizance of the ’selective action’ by the Facebook management against Pak and Kashmiri social media activists and take appropriate action in this regard.

The directions were passed during the 18th meeting of the committee chaired by Sheharyar Afridi. Officials of the Ministry of Foreign Affairs, PTA chairman, delegation of All Parties Hurriyat Conference (APHC) and others also attended the meeting. Canada-Pakistain Global Congress President Chaudhry Zafar also attended the meeting as an observer from Canada.

The committee also passed two unanimous resolutions to denounce the recent Indian maneuvers and army deployment in Indian Indian Kashmire and the recent terrorist attack on a Moslem family in Canada amid rise of Islamophobia

Sheharyar Afridi confronted the PTA chief and asked why managements of Facebook and Twitter did not set up their offices in Pakistain yet. To a recent statement of Facebook management about suspension of several accounts and pages of Pak users, he asked what action had been taken by the PTA against the Facebook team.

He said that why the Facebook team had refused to turn up in the Kashmir Committee meeting and directed PTA to ensure that Facebook representative must attend the next meeting of the committee. The PTA chairman said that PTA was engaging with the Facebook management and would do whatever it takes to protect rights of the Pak and Kashmiri users in accordance with the Pak laws.

He said that Pakistain had directed Facebook management to set up its office in Pakistain. Sheharyar Afridi argued how Facebook management was not adhering to directives of a country with 220 million population and how can any company violate basic rights of over 220 million people. He said why PTA had failed to take action against Facebook management and why the Facebook was not blocked in Pakistain if it fails to comply with the directions of the government.

Chairman Shehryar Khan Afridi on Thursday pledged to give representation to the All Parties Hurriyat Conference (APHC) leaders in his committee’s diplomacy with the global community on Kashmir.

Addressing central Hurriyat leaders at the APHC headquarters, he said that since overtaking affairs of the government, Prime Minister Imran Khan

The Kashmir Committee chairman said that humanity was suffering even in the 21st century as the disputed state was the place where barbaric crimes were being committed against humanity. He said Pakistain has a commitment towards the Kashmir cause and no one can change the love bond between Pak and the Kashmiri people.

Whether it is the statement at the UN General Assembly in 2019 or today, the commitment of Imran Khan was unwavering towards Kashmir and its people, he said. He also said that whether it was Indian occupation or the Israeli occupation, Pakistain had a principled stance against the occupational regimes, he told the Hurriyat leaders.

"We will never compromise over our commitment with Kashmiris and Paleostinian people fighting for freedom from occupational forces," he said. In line with directions of Prime Minister Imran Khan, he said that he had activated the Kashmir Committee to help raise Kashmir issue at all national and international forums.

He said that though the Covid-19 pandemic had badly hurt campaign of the Kashmir Committee on the issue still the committee had adopted innovative measures to help connect with the international organizations and politicians of the world through virtual meetings. He said the Kashmiris needed to be provided international platforms to build the case of Kashmiri freedom struggle and the Kashmiris could convince the world on freedom movement.

He said that Pak and Kashmiri youth and rights campaigners must join hands and build campaigns on social and conventional media. He said that he was engaging the Pak youth to sensitize them on the Kashmir issue as due to the failure of the past governments, the youth stands disconnected from the Kashmir cause.

He said that Prime Minister Imran Khan’s recent statement on trade with India has left no doubt on Pakistain’s loyalty to Kashmiris. APHC Convener Syed Faiz Naqshbandi said that APHC values steps taken by the Kashmir Committee under the chairmanship of Shehryar Afridi.

, Hurriyat leaders and organizations expressing serious concern over the escalating tension between Pakistain and India on the Line of Control have called for peaceful resolution of the Kashmir dispute for ensuring durable peace in South Asia.The Hurriyat forum led by Mirwaiz Umar Farooq in a statement in Srinagar expressed deep grief over the repeated escalation on the LoC that has resulted in the loss of human lives and property. It reiterated its appeal to both India and Pakistain to resolve the Kashmir dispute through peaceful means for the sake of humanity and millions of humans living in the region.

Hurriyat leaders and organizations including Zamruda Habib, Abdul Samad Inqilabi, Jammu and Kashmir Liberation Front and Tehrik-e-Wahdat-e-Islami in their statements issued in Srinagar strongly condemned the unprovoked shelling by Indian Army along the LoC. They appealed to the UN to take practical measures for settling the Kashmir dispute to prevent further bloodshed.

the All Parties Hurriyat Conference General Secretary, Molvi Bashir Ahmed, in a statement issued in Srinagar said that Indian Army in gross violation of the international laws was refusing to hand over dead bodies of the Kashmiri martyred youth to their families and secretly burying them in unmarked graves at far-off places in IIOJK. He said India is afraid of massive participation of people in deaders’ funerals as it fears that the funerals of martyred youth further incite anti-India sentiments in the occupied territory.

It recounted that around 8,000 individuals have been affected by pellet guns, with more than 250 youth blinded either fully or partially and another 930 on the verge of losing their eye sight. Further, 697 women have reported molestation by Indian forces. Over 19,000 Kashmiris in all have been injured and around 18,000 incarcerated
